Board Members Present: Gene Clancy, Vice-Chairman David Loeb Taylor Mauck(Alternate) William Tinney(Alternate) Board Members Absent Charles Schibi,Chairman John Martinez Staff Present Miguel S. CALL TO ORDER A quorum was declared and the meeting was called to order by Gene Clancy at 1:32 p.m. It was stated by Vice-Chairman Clancy that to make a quorum we need four board members and since we only have four of our board members in attendance, it will take all four votes to approve an appeal. Consequently,he stated that any cases today have the option to be tabled if so they choose. Flint Hills Resources Appeal No.ZBA0105-01 Request: A Special Use Exception to construct a 160-foot tall radio tower on Nueces Bay Heights, Block 25, Lots 1-4 and 17-20 located east of Nueces Bay Boulevard and south of Moore Street. Mr. Wes Vardeman, Planning Technician, stated that there had been some objections involving this case from the property owners in the area. This case was tabled last month due to the appellant not being in attendance and we have since received a letter from the appellant withdrawing their request. Corpus Christi Housing Authority Appeal No. ZBA0305-01 Request: A Special Use Exception for a reduction from 1.0 to .75 parking spaces per dwelling unit at Sea Breeze Senior Apartments. The property is on Kinney Sectionized Lands, Parcel 1,located west of Lantana Street along the south side of Interstate Highway 37. Mr. Wes Vardeman, City Planner,outlined the location of this request and stated that the appellant is asking to reduce the required off-street parking to 0.75 parking spaces per unit due to the fact that the parking is limited to elderly and handicapped residents at this location and consequently own fewer vehicles. The appellant indicated in their request that shuttles will be provided to assist with transportation needs. Staff recommendation is for approval of the Special Use Exception to 0.75 spaces per unit with a minimum of five parking spaces for the community center which is located on the property. It was also stated that this is limited to the elderly(62 years of age or older)and the handicapped(regardless of age). Mr.Clancy,Vice-Chairman opened the public hearing for discussion. Edel Ruiseco, Corpus Christi Housing Authority Representative, gave a presentation stating the reasons why this request was needed and indicating that retirement facilities in Houston resembling this one have similar ordinances in place. Dennis Peacock in favor of this request stated that he hoped that this motion would be approved. The public hearing was closed. A motion for approval was made by Board Member Tinney and seconded by Vice-Chairman Clancy. Motion passed unanimously. Stephen E.Rippstein Appeal No.ZBA0305-01 Request: A Variance to reduce the front yard setback from 25 feet to 24.08 feet and the side yard from 5 feet to 3.33 feet. This property is in Wood Estates Subdivision,Block 49,Lot 17,located on the east side of Iron River Drive and approximately 400 feet north of River Park Drive. Mr. Miguel Saldana, Board of Adjustment Administrator, stated that Debbie Rippstein, wife of appellant, has requested an one month continuance to give the appellant additional time to review and research their request. Motion to approve continuance was made by Tinney and seconded by Loeb. Motion passed unanimously. APPROVAL OF MINUTES A motion was made by Loeb and seconded by Mauck to approve the February 23,2005 minutes. The motion passed by all present. OTHER MATTERS Mr. Saldana addressed the Board and stated that Robert Broadway's official resignation has been received. Mr. Saldana further stated that due to the number of absences held by Chairman Schibi,he is automatically removed from the Board. If he chooses to,he may submit a request to be reinstated by the City Council. If that does not occur,both of our alternates will become regular members filling the positions by Boardway and Schibi. At our next Board of Adjustment hearing,we will hold elections for Chairman and Vice-Chairman. ADJOURNMENT Motion to close the meeting was made by Loeb and seconded by Mauck.
