Board Members Present: Gene Clancy, Vice-Chairman David Loeb John Martinez Taylor Mauck(Alternate) William Tinney(Alternate) Staff Present Miguel S. CALL TO ORDER A quorum was declared and the meeting was called to order by Gene Clancy at 1:32 p.m. Stephen E.Rippstein Appeal No.ZBA0305-02 Request: A Variance to reduce the front yard setback from 25 feet to 24.08 feet and the side yard from 5 feet to 3.33 feet. This property is in Wood Estates Subdivision,Block 49,Lot 17, located on the east side of Iron River Drive and approximately 400 feet north of River Park Drive. Mr.Wes Vardeman,Planning Technician,described the land use,location,zoning and site plan of the subject property which is located in the Calallan area. Said property was permitted in 2003 with existing encroachments and has a width of 97 feet and a depth 108 feet. The property is of a rectangular shape and is relatively flat. Staff finds no exceptional topical conditions,crowding of the property or extraordinary conditions to warrant approval of this request. There were 18 notices mailed out to the surrounding area. There were two received in favor and none received in opposition. Mr.Clancy,Vice-Chairman opened the public hearing. Steve Rippstein,Appellant,4434 Iron River,Corpus Christi,Texas. Mr.Rippstein stated his hope that the Committee would approve the variance. He explained that there were discrepancies made on the first survey whereby the surveyor picked up the wrong stakes and house was situated improperly. At closing,a new survey was issued and these discrepancies were shown. It was noted that the title company issued a policy noting these exceptions and that the first surveyor possibly picked up the extra stakes to accommodate the curvature of the road. Original survey was done by Haas Engineering and the more recent survey by Voss Engineering which agrees with the plat. SCANNED Zoning Board of Adjustment M•s April 27,2005 Page 2 Steve Dean, 11753 Jacob Street,Corpus Christi,TX,spoke in favor of the variance and restated that the builder just picked up the wrong stakes and followed the curvature of the road. There was no opposition in attendance. Staff's recommendation is denial of proposed request. Mr.Clancy, Vice-Chairman closed the public hearing. After discussion regarding the reasons for the discrepancies,motion for denial was made by Loeb and seconded by Martinez. Motion passed with Tinney voting against the motion. Parkway Presbyterian Church Appeal No.ZBA0405-01 Request: A Variance to allow the faces of a freestanding sign to exceed the maximum separation between sign faces. The property is on Meldo Park Subdivision,Block 4,located at the southeast corner of Brawner Parkway and Santa Fe Street. Mr.Wes Vardeman,Planning Technician,addressed the Board stating that the appellant is requesting a variance to construct a V-shaped monument sign in lieu of a single wall sign allowing the faces to exceed the maximum separation between faces. Location of this request,which is primarily a residential area,was outlined showing site plan and elevations of the proposed sign. It was noted that style and architecture of the sign redesign matches the church architecture and is a feature element of the Santa Fe Street yard redesign There were 38 notices mailed out to the surrounding area. There was one received in favor and one received in opposition. Mr. Clancy,Vice-Chairman opened the public hearing. David Richter,Richter Architects for Appellant,Parkway Presbyterian Church,201 Upper Broadway,Corpus Christi,Texas. Mr.Richter addressed the Committee stating their full desire to comply with the City's sign code in place. Mr. Richter stated that the proposed elevated sign will better serve the Church and each side of the sign measures less than the 30 feet per sign face which is within the specifications of the sign code. Miguel Saldaiia,Board of Adjustment Administrator, stated that typically a two sided sign has no more separation than 18 inches from face to face. The objection is raised when we look at a V-shaped sign such as the one being proposed,it is viewed as two separate signs. There was no opposition in attendance. Staff recommendation is approval of the variance to construct a V-shaped sign subject to submitted site and elevation plan and removal of the wall sign currently in place. Mr.Clancy,Vice-Chairman closed the public hearing. Motion for approval made by Martinez and seconded by Loeb. Motion passed unanimously. A Zoning Board of Adjustment Minutes • April 27,2005 Page 3 Nextel Partners,Inc. Appeal No.ZBA0405-02 Request: A Special Use Exception to construct an 85 foot monopole telecommunications tower. The property is 1.3 acres out of Lot 23, Section 49,Flour Bluff&Encinal Farm&Garden Tracts located along the south side of Purdue Road west of Waldron Road. Mr. Wes Vardeman, Planning Technician, addressed the Board stating that the appellant is requesting a Special Use Exception to construct a 85-foot monopole and equipment shelter located at 733-B Purdue Road in order to expand and improve the current cellular phone service in the Flour Bluff area. Area location, map, zoning map, site plan and elevation plan describing the subject property was given. There were 30 notices mailed out to the surrounding area. There were none received in favor and two were received in opposition. Mr.Clancy,Vice-Chairman opened the public hearing. Michael Crane, 1821 Westlake Drive in Austin,Texas,representative for Nextel. He addressed the Committee and expressed the difficulty they have had trying to utilize the existing towers and communication signals not being able to penetrate buildings in that area. Flour Bluff Independent School District is one of our major customers and they have had extreme difficulty with their cellular phones. This tower would greatly improve the reception problems being encountered. Mention was made by Vice-Chairman Clancy that he has noted in other cities alternate architecture being placed around the poles to make them look more appealing and that might be something to think about when we construct these types of poles in the future. There was no opposition in attendance. Staff recommendation is approval of the Special Use Exception subject to the site and elevation plan submitted. Mr.Clancy,Vice-Chairman closed the public hearing. Motion for approval made by Loeb and seconded by Tinney. Motion passed unanimously. APPROVAL OF MINUTES A motion was made by Martinez and seconded by Loeb to approve the March 23, 2005 minutes with the following correction to be noted. Stephen E. Rippstein-motion to approve continuance made by Tinney and seconded by Loeb. The motion passed by all present with corrected change. OTHER MATTERS Mr.Martinez addressed the Board requesting his last absence to be excused for reasons of a death in his family. Motion to approve absence made by Clancy and seconded by Loeb. 4 1111 • Zoning Board of Adjustment Minutes April 27,2005 Page 4 Mr. Saldafia addressed the Committee stating that the first item on next month's agenda will be elections for Chairman and Vice-Chairman. Mr. Schibi has been removed from the Board due to excessive absences but has expressed an interest to be reinstated. Mr. Schibi will do the necessary paperwork to accomplish this. Hopefully,we will have a new member on the Board by next month. Mr. Saldana encouraged the members to inform any interested parties that would like to serve on the Board to contact the City Secretary's office. ADJOURNMENT Motion to close the meeting was made by Mauck and seconded by Loeb. The meeting adjourned at 2:32 p.m. Miguel S.
