CALL TO ORDER A quorum was declared and the meeting was called to order by Gene Clancy at 1:30 p.m. Appeal No.ZBA0305-02 Stephen E.Rippstein Request: Variance to reduce the front yard setback from 25 feet to 24.08 feet and the side yard from 5 feet to 3.33 feet. This property located in the Wood Estates Subdivision,Block 49,Lot 17, located on the east side of Iron River Drive and approximately 400 feet north of River Park Drive. Mr.Miguel Saldaiia,Board of Adjustment Administrator, stated that this is a consideration of a case that was heard last month for a variance to reduce the front and side yard setback of subject property located in the Wood River area. A power point presentation of the property location describing the surrounding land use was shown. An enlargement of the plat illustrates the position of two pins that are 2.77 feet from the east property line. These pins denote two street right-of-way tangent points and are in proximity to the subject property front corner stakes. During construction the incorrect tangent pins point to determine the home's foundation location. In the process of selling the subject property,a second survey was preformed using the correct property corner pins/stakes and found that the property was in violation of a front and side yard requirement as defined in the City Zoning Ordinance and is a result of the right-of-way curvature. There were 18 notices mailed out to the surrounding area with two received in favor of the proposal and none received in opposition. Mr.Clancy,Chairman opened the public hearing. SCANNED 0 Zoning Board of Adjustment Minu• June 22,2005 Page 2 Mr. Stephen Rippstein located at 4534 Iron River, Corpus Christi, Texas, 78410 and owner of the subject property, addressed the Board stating that the review of the property was accurate and appreciated the reconsideration shown by the Board. He further indicated that upon approval,the side fence will be moved to the correct location so the next door neighbor will have full access to their property. In answer to Mr. Loeb's question regarding the ability of the neighbor to build on that property,Mr. Rippstein stated there was no hindrance and no interference with drainage. This next door property has been sold and that one of the notices returned in favor of this variance came from this present property owner. Mr. Stephen Dean, 11753 Jacob Street, Corpus Christi,TX 78410 spoke in favor of the variance and stated that a letter of acceptance of this variance has been received by the property owner next door. There was no opposition in attendance. Staff's recommendation finds that due to the unusual location of the property along the curved portion of Iron River Drive and with the confusion and misidentification of the corner stakes with the right-of-way tangent stakes, Staff has no objection to the approval of this variance. Mr. Clancy,Chairman closed the public hearing. Motion for approval was made by Tinney and seconded by Martinez. Motion passed unanimously. APPROVAL OF MINUTES A motion was made by Martinez and seconded by Mauck to approve the May 25, 2005 minutes as approved. Motion passed unanimously. OTHER MATTERS None to report.
