I. CALL TO ORDER
A quorum was declared and the meeting was called to order by Chairman Mauck
at 1:30 p.m.
II. PUBLIC HEARING AGENDA ITEMS

Andrew Dimas presented a PowerPoint presentation of the subject property and
surrounding area. The appellant is requesting the variance to accommodate tandem
parking for the property owner which has been needed in their previously built homes.
There were seventeen notices mailed with one received in favor and zero received in
opposition.
Public hearing was opened.
Carolyn Smith, Habitat for Humanity, 3409 Derby Drive, Corpus Christi, Texas
stated that most of their homeowners only own one vehicle and the driveways go back far
enough to easily accommodate two vehicles if needed. Mr. Smith stated that their homes
are approximately 1270 square feet. The lot is less than 47 feet so we are asking
permission to move it as far to one side as possible to accommodate the tandem
driveway.
Public hearing was closed.
Staff recommendation is approval of the Variance to allow for tandem vehicle
parking on a single lane driveway; a Variance to reduce the lot width requirement; and a
Variance to reduce the side building setback requirement
Motion for approval was made by Board Member Tinney and seconded by for a
Variance to allow for tandem vehicle parking on a single lane driveway; a Variance to
reduce the lot width requirement from 50 feet to 46.6 feet; and a Variance to reduce the
side yard setback requirement to the foundation from 5 feet to 3 feet. Motion passed
unanimously with Board Member Molina abstaining from the vote and Board Member
Ornelas and Winship being absent.
2. New Appeal(s)

Johnny O'Neal: Special Use Exception to allow for the installation
and operation of a wind energy system
Oak Terrace Unit 1 Subdivision, Block 1, Lots 1 & 2 at 9829
Compton Blvd.
Andrew Dimas presented a PowerPoint presentation of the subject property and
surrounding area located in the Flour Bluff area. Mr. Dimas stated we concluded that to
satisfy the 150% requirement, the setback would have to be over 6Q feet. There were
twelve notices mailed with two received in favor and one received in opposition.
Mrs. Alvaro, 9834 Compton Road, Corpus Christi, Texas stated her property is
adjacent to the subject property and stated she was concerned but after looking at its
location find it to be aseptically more pleasing that I expected. I question whether it will
affect the property values in the neighborhood.

In response to Mrs. Alvaro, Board Member Tinney stated as a real estate
appraiser, it would not have a negative effect on property values at its present location.
The wind-load requirements are for 140 mph winds that is a category 3 type hurricane.
Billy Ruzicka,9817 Compton Road, Corpus Christi,Texas stated that his property
was next door to the subject property and is in favor of the request. Mr. Ruzicka stated
he had spoken to the association and there is no language in the covenants that restrict
the wind energy system.
Public hearing was closed.
Staff recommendation is approval of the Special Use Exception to install and
operate a Skystream 3.7 Wind Turbine.
Motion for approval of the Special Use Exception was made by Board McDonald
and seconded by Board Member Molina. Motion passed unanimously with Board
Member Ornelas and Winship being absent.
b. ZBA 1008-02
Luis Gomez: Variance to allow for the reduction of the
residential lot size from (5,900) square feet to (5,667) square
feet
South Fork Unit 4 Subdivision, Block 9, Lot 19 at 7422 Oak
Hollow Court.
Mr. Dimas reviewed the subject property was platted nonconforming with the
house being built in the five foot side yard setback. Mr. Gomez is asking to correct it by
moving the building line side yard setback into the adjoining lot. Mr. Dimas stated there
were thirty-six notices mailed with one returned in favor and zero returned in opposition.
The board discussed reasons which caused the lot reduction and the need to place
a narrow house in the adjoining property.
Public hearing was opened.
Luis Gomez (Gray Arc Homes-builder for the project), 2510 Wishbone Ct,
Corpus Christi, Texas stated in response to Mr. Dimas' concern about the size of the lots,
Mr. Gomez stated, from speaking to a designer, the maximum square footage for the
smaller sized lot would be 2200 square feet. My plans are to build a house between
1700-1800 square feet. Mr. Gomez stated his foundation contractors located an incorrect
pin on one of the corners which was the pins from the lot behind it. Those two pins were
five feet apart which made a five foot difference. When the final survey was done, the
mistake was realized.

Staff recommendation is approval of the Variance to allow for the reduction of the
lot width requirement from 6,000 square feet to 5,667 square feet.
Motion for approval of the Variance was made by Board Member Molina and
seconded by Board Member Molina. Motion passed unanimously with Board Member
Ornelas and Winship being absent.
c. ZBA 1008-03
Tommie Edwards: Special Yard Exception to allow for the
reduction of the side yard setback from(25) feet to (10) feet
Flour Bluff Estates Subdivision, Block G, Tract D of Lot 26,
West 50 feet of Lot 27, and East 150 feet of Lot 28 at 910
Mounts Drive.
Andrew Dimas presented the appellant is interested stating in subdividing these
three lots into three sections "C, "B" and "A". These lots are within the 50 foot width
requirement under the"R-1B"District. Lot 28 meets the requirement on the frontage and
on the square footage but for it to be more developable the appellant the setback line
needs to be moved. The existing right of way line of Lakeside Drive is a standard 50
line. There were thirty-three notices mailed with four received in favor and three
received in opposition.
Public hearing was opened.
David Royles, (representing Tommie Edwards, applicant), 413 Claride, Corpus
Christi, Texas stated one of the reasons for the request is that there is a good size ditch on
Lakeside that flows from west to east toward Laguna Madre and we wanted to put our
approaches on mounts which would include three driveways and we wouldn't have to add
any culverts.
Public hearing was closed.
Staff recommendation is approval of the Special Exception to allow for the
reduction of the side yard setback to ten(10) feet.
Motion for approval was made by Board Member Johnson and seconded by
Board Member Molina. Motion passed unanimously with Board Member Ornelas and
Winship being absent.

Corpus Christi Community Improvement Corporation: Special
Use Exception to allow for tandem parking and a Variance to
allow for the existing undersized lot and reduced lot width
C.A. Meuly's Addition Subdivision, Block 5, Lot 6 at 901 15th
Street.

Andrew Dimas presented the above request describing the subject property and site
plan. Mr. Dimas stated the 50 foot requirement is met in the front but is deficient at the
back of the property. There were thirty-three notices mailed with zero returned in favor
and one received in opposition.
Public hearing was opened.
Diana Zertuche Garza, Model Block Progran-City of Corpus Christi stated this is
another one of the homes that have been purchased for the Model Block Program and the
main issue is that the residence that the lot size is non-conforming for the "A-1" District.
We should be able to do a nice two bedroom home on that lot.
Public hearing was closed.
Staff recommendation is approval for reduction of the lot size requirement to 3,556
square feet, reduction of the lot width requirement to 49.88 feet and the Special Use
Exception to allow tandem parking.
Motion for approval was made by Board Member McDonald and seconded by
Board Member Molina. Motion passed unanimously with Board Member Ornelas and
Winship being absent.
III. APPROVAL OF MINUTES
1. September 22,2008
Motion for approval was made by Board Member McDonald and Board Member
Molina with the notation that Board Member Winship was shown present when he should
be shown as absent on the September 22, 2008 minutes. Motion passed unanimously
with Board Member Ornelas and Winship being absent.
V. ADJOURNMENT
Motion was made and seconded for adjournment at 3:30 p.m. Motion passed
unanimously with Board Member Ornelas and Winship being absent.
