Corey, Zoning Coordinator Michael Gunning, Senior Planner Elizabeth Kay Butler, Senior Secretary Chairman Dykema opened the public hearing at 1:30 p.m. , in the Council Chambers at City Hall and explained the procedure to be followed. ************************************************************************* APPEAL NO. 2978 - Property located at 1109 N. Staples REOUEST: Application by Western Steel Company representing Holy Cross Parish, Diocese Of Corpus Christi, Lots 1-9, Block 51, Bluff Addition, located in an A-1, Apartment House District requesting to reduce the minimum required 25 foot side yard setback to 16'8". REPLIES RECEIVED IN FAVOR: 0 REPLIES RECEIVED IN OPPOSITION: 0 APPEARING IN FAVOR: Ernest Carter, Parish Member W. E. Spencer, Western Steel Company Charles Whitson, Parish Member APPEARING IN OPPOSITION: None STAFF RECOMMENDATION: Denial MOTION: Motion was made by Mr. Veteto, seconded by Mr. Gamboa and failed to pass with Messrs. Dykema, Gamboa and Veteto voting yes and Messrs. DeVille and Meinrath voting no, to grant the special exception, according to Zoning Ordinance Section 29-4.02, to reduce the minimum required 25 foot side yard setback to 16'8" on Lots 1-9, Block 51, Bluff Addition, 1109 N. REPLIES RECEIVED IN FAVOR: 0 REPLIES RECEIVED IN OPPOSITION: 0 APPEARING IN FAVOR: Perfecto Rodriguez III, Applicant Moises Perez, Urban Engineering APPEARING IN OPPOSITION: None STAFF RECOMMENDATION: Denial MOTION: Motion was made by Mr. Veteto, seconded by Mr. Gamboa and passed with Messrs. Dykema, Gamboa, Meinrath and Veteto voting yes and Mr. DeVille voting no to grant the variance, according to Zoning Ordinance Section 29-5.01, to reduce the minimum required 6,000 square foot lot size to 2,999 square feet and to reduce the minimum required 20 foot front yard setback to 15 feet on the S.E. 1/2 of Lot 6, Block 11, Southmoreland, 122 Norton, since the Board finds that in its opinion, as a matter of fact, such variance is consistent with the existing neighborhood development and because of the uniqueness of this property's situation. NOTE: For detailed information on testimony refer to the tape retained on file in the Building Inspection Department. ************************************************************************* MISCELLANEOUS A motion was made by Mr. DeVille, seconded by Mr. Gamboa and passed unanimously to approve the minutes of the prior meeting as submitted. A brief discussion followed concerning the procedures for issuing permits. After a brief discussion it was the consensus of the Board to schedule a workshop for Wednesday, October 23, 1991 at 11:30 a.m. , for Board members and staff representatives.
