Chairman Dykema opened the public hearing at 1:31 p.m. , in the
Council Chambers at City Hall and explained the procedure to be followed.

APPEAL NO. 2980 - Property located at 1109 N. Staples
REQUEST: Application by Holy Cross Church, Lots 1-9, Block 51, Bluff
Addition, located in an A-1, Apartment House District requesting a
special exception to reduce the minimum required 25 foot side yard
setback to 22.5 feet.
REPLIES RECEIVED IN FAVOR: 0 REPLIES RECEIVED IN OPPOSITION: 0
APPEARING IN FAVOR: Father Freeman, Pastor
Cecil Brazil, Chief Engineer, Western Steel Company
APPEARING IN OPPOSITION: None
STAFF RECOMMENDATION: Approval
BASIS FOR RECOMMENDATION: This particular setback reduction will have no
adverse effect on the surrounding property or the neighborhood.
MOTION: Motion was made by Mr. DeVille, seconded by Mr. Ortman and
passed unanimously to grant the special exception according to Zoning
Ordinance Section 29-4.02, to reduce the minimum required 25 foot side
yard setback to 22.5 feet for this 30 foot structure only on Lots 1-9,
Block 51, Bluff Subdivision, 1109 N. Staples, since the Board finds that
in its opinion, as a matter of fact, such exception will not
substantially affect adversely the uses of adjacent and neighboring
property.

MISCELLANEOUS
A motion was made by Mr. Meinrath, seconded by Mr. Dykema and passed
unanimously to approve the minutes of the prior meeting as submitted.
Ms. Corey informed the Board that Mr. Serveriano Flores of Portairs
Furniture case has been scheduled for the 94th District Court on November
27th at 9:15 a.m. A brief discussion followed.
The meeting was adjourned at 1:50 p.m.
