Kay Butler, Senior Secretary Chairman Dykema opened the public hearing at 1:30 p.m. , in the Council Chambers at City Hall and explained the procedure to be followed. ************************************************************************* APPEAL NO. 2983 - Property located at 2819 Surfside REQUEST: Application By Leslie B. Mabrey, South 50' North 90' of Lot 117, Block 43, Beach Hotel Subdivision, located in a B-D, Beach Design District requesting a special exception to reduce the front yard setback from the required 7.5 feet to 5 feet with a 4.5 foot overhang in lieu of the required 3.5 foot maximum overhang. REPLIES RECEIVED IN FAVOR: 0 REPLIES RECEIVED IN OPPOSITION: 0 APPEARING IN FAVOR: Dennis Haas, 318 Beverly representing Leslie Mabrey APPEARING IN OPPOSITION: None STAFF RECOMMENDATION: Approval BASIS FOR RECOMMENDATION: Since this is a request for a special exception proving a hardship is not necessary. The site adjoins a permanent public open space so there is no adverse affect on adjacent property. SCANNED P.O. Box 9277 • Corpus Christi, Texas 78469-9277 • (512) 880-3000 City of Corpus Zoning Board Of Adjustment Christi January 22, 1992 Page 2 MOTION: Motion was made by Mr. DeVille, seconded by Mr. Welsh and passed unanimously to grant the special exception according to Zoning Ordinance Sections 14A-6.01 and 29-4.02, to reduce the front yard setback from the required 7.5 feet to 5 feet with a 4.5 foot overhang in lieu of the required 3.5 foot maximum overhang on the South 50' , North 90' of Lot 117, Block 43, Beach Hotel Subdivision, 2819 Surfside, since the Board finds that in its opinion, as a matter of fact, such exception will not substantially affect adversely the uses of adjacent and neighboring property. NOTE: For detailed information on testimony, refer to the tape retained on file in the Building Inspection Department. ************************************************************************* MISCELLANEOUS Motion was made by Mr. Veteto, seconded by Mr. DeVille and passed unanimously to approve the minutes of the previous meeting. A discussion was held concerning the lack of a representative from the legal department being present and what recourse the Board should take.
