ZONING BOARD OF PUBLIC HEARING COUNCIL CHAMBERS-CITY HALL APRIL 22, 1992 BOARD MEMBERS PRESENT: John Dykema, Chairman Jesse Barrera, Alternate August Meinrath Patrick Veteto N. J. Welsh, Alternate BOARD MEMBERS ABSENT : Ramiro Gamboa, Vice Chairman Steve Ortmann STAFF MEMBERS PRESENT: Susan J. Potjer, Zoning Coordinator Michael Gunning, Senior Planner Elizabeth K. Butler, Senior Secretary Chairman Dykema opened the public hearing at 1:36 p.m. , in the Council Chambers at City Hall and explained the procedure to be followed. ************************************************************************* APPEAL NO. 2984 - Property located at 1913 Mestina (Tabled at the March 25, 1992 meeting) A motion was made by Mr. Veteto, seconded by Mr. Meinrath and passed unanimously to remove the appeal from the table. Mrs. Sue Potjer explained that this appeal had been tabled last month to allow the appellant time to obtain a lease agreement for additional parking spaces. She stated that alternate parking had been obtained therefore the case was rescinded. ****: ******************************************************************** APPEAL NO. 2985 - Property located at 737 Bloomington REQUEST: Application by Mr. Armando R. Flores, Lot 13C, Block 7 , Molina #2, in a R-1B, Single Family Dwelling District. Application requesting to reduce the minimum required 25 foot front yard setback to 22 feet. REPLIES RECEIVED IN FAVOR: 3 REPLIES RECEIVED IN OPPOSITION: 0 APPEARING IN FAVOR: Armando Flores, Owner SCANNED P.O. Box 9277 • Corpus Christi, Texas 78469-9277 • (512) 880-3000 Lit\ OI Corpus Christi Zoning Board Of Adjustment %asovosoos April 22, 1992 Page 2 APPEARING IN OPPOSITION: None STAFF RECOMMENDATION: Denial BASIS FOR RECOMMENDATION: After a review of applicants request it is the staff 's opinion that the request does not meet the hardship provisions of the ordinance as to narrowness, exceptional conditions to lot size, configuration of the lot, or excessive shallowness of depth. Without being able to meet the hardship provision, staff has no choice but to recommend denial. MOTION: Motion was made by Mr. Veteto, seconded by Mr. Welsh and passed unanimously to grant the variance based on the fact that there is an exceptional situation on the property with the "grandfathered" 18 foot setback on a portion of the existing structure on Lot 13C, Block 7, Molina #2, 737 Bloomington, since the Board finds that in its opinion, as a matter of fact, such exception will not substantially affect adversely the uses of adjacent and neighboring property. NOTE: For detailed information on testimony, refer to the tape retained on file in the Building Inspection Department. ************************************************************************* MISCELLANEOUS Motion was made by Mr. Veteto, seconded by Mr. Dykema and passed unanimously to approve the minutes of the previous meeting. Motion was made by Mr. Meinrath, seconded by Mr. Welsh and passed unanimously to excuse the absent members.
