Butler, Senior Secretary Chairman Dykema opened the public hearing at 1:30 p.m. , in the Council Chambers at City Hall and explained the procedure to be followed. ************************************************************************ APPEAL NO. 2987 - Property located at 2217 Savoy REQUEST: Application by Ronald W. Magee, Lot 20, Block 6, Windsong #2, in an R-1B, Single Family Dwelling District requesting to reduce the minimum required 20 foot side yard setback to 10 feet. REPLIES RECEIVED IN FAVOR: 0 REPLIES RECEIVED IN OPPOSITION: 0 One petition received with 13 signatures from residents in the area. APPEARING IN FAVOR: Ronald W. Magee, Appellant APPEARING IN OPPOSITION: None STAFF RECOMMENDATION: Denial BASIS FOR RECOMMENDATION: The purpose of the 20 foot setback requirement ( u is to make sure that there is adequate driveway area to park a vehicle in front of a garage without blocking a sidewalk. This garage is set back beyond the required setback, however the carport structure is not. Carport structures can become future problems if they are eventually enclosed. Staff cannot go on record to recommend the encroachment. Mr. Gunning pointed out that the zoning ordinance, via the special exception c) section for corner lots, does permit the Board to take into consideration the information provided by the applicant and the circumstances surrounding the addition. Staff does not see any adverse impact on the P.O. He asked that if the Board grants the special exception, that the approval be for the encroachment area only provided that the carport structure will never be enclosed. MOTION: Motion was made by Mr. Ortmann, seconded by Mr. Welsh and passed unanimously to grant the special exception according to Zoning Ordinance Section 29-4.02, to reduce the minimum required 20 foot side yard setback to 10 feet on Lot 20, Block 6, Windsong #2, 2217 Savoy with the condition that the special exception is for the encroachment area only provided that the carport structure shall never be enclosed. NOTE: For detailed information on testimony, refer to the tape retained on file in the Building Inspection Department. ************************************************************************ APPEAL N0. 2986 - Property located at 7002 Adcote REQUEST: Application by David & Gayle Villarreal, Lot 113, Block 2, Buckingham Estates, located in a R-1B, Single Family Dwelling District and PUD, Planned Unit Development requesting a special exception to reduce the minimum required 10 foot side yard setback to 9.3 feet. REPLIES RECEIVED IN FAVOR: 0 REPLIES RECEIVED IN OPPOSITION: 0 APPEARING IN FAVOR: David Villarreal, Appellant APPEARING IN OPPOSITION: None STAFF RECOMMENDATION: Approval MOTION: Motion was made by Mr. Ortmann, seconded by Mr. Gamboa and passed unanimously to grant the special exception according to Zoning Ordinance Section 29-4.02 to reduce the minimum required 10 foot side yard setback to 9.3 feet on Lot 113, Block 2, Buckingham Estates, 7002 Adcote, since the Board finds that in its opinion, as a matter of fact, such exception will not substantially affect adversely the uses of adjacent and neighboring property.
