Chairman Meinrath opened the public hearing at 1 : 35 P.M. , in
the Council Chambers at City Hall and explained the procedure to be
followed.

the March 23, 1994 hearing.

Motion: Motion was made by Mr. Veteto, seconded by Mr. Barrera to
table the case for sixty days, subject to the neighbors and
appellant discussing possible solutions . The motion carried by a
vote of 3 to 2 .

REQUEST: Regional Transportation Authority representing 1st
Commerce Bank for the property at Lot A-2 & Annex B, Block B-i,
Port Ayers Suburban Center, 4321 Ayers in a B-4, General Business
District is requesting a special yard exception to reduce the
minimum required 20 foot front yard setback to zero feet.

Motion: Motion was made by Mr. Barrera, seconded by Ms . Tamez and
paw unanimously to grant the special yard exception in
accordance with the Zoning Ordinance Section 29-4 . 02 to reduce the
minimum required 20 foot front yard setback to zero feet, since the
Board finds that in its opinion, as a matter of fact, such a
special exception will not substantially adversely affect the
adjacent property on Lot A-2 & Annex B, Block B-1, Port Ayers
Suburban Center, 4321 Ayers.

minimum required 20 foot side setback to 10 feet, since the Board
finds that in its opinion, as a matter of fact, such a special
exception will not substantially adversely affect the adjacent
property on Lot 6, Block 7, Bessar Park, 223 Oleander.

Motion: Motion was made by Mr. Veteto, seconded by Mr. Barrera
and passed unanimously to approve the special yard exception in
accordance with Zoning Ordinance Section 29-4 . 02, to reduce the
minimum required 25 foot front yard setback to 20 feet, applicable
to the existing encroachment only, since the Board finds that in
its opinion, as a matter of fact, such a special exception will not
substantially adversely affect the adjacent property on Lot 13F,
Bluff Estates, 337 Paloma.

MISCELLANEOUS
A motion was made by Mr. Barrera, seconded by Mr. Veteto and
passed unanimously to approve the minutes of the prior meeting as
submitted, also motion was made by Mr. Barrera, seconded by Mr.
Meinrath to appoint Mr. Veteto as Vice Chairman and passed
unanimously.
The meeting was adjourned at 3 : 45 p.m.
