Hines, Secretary II Vice Chairman Veteto opened the public hearing at 1 : 36 p.m. , in the Council Chambers at City Hall and explained the procedure to be followed. ***************************************************************** APPEAL NO. 3024 - Property located at 1115 W. Broadway REQUEST: William H. Sharp, representing C.C. Paintball Warehouse, Lots 4 & 5, Block 76, Bluff, located in a I-2, Light Industrial District requesting a special yard exception to reduce the minimum required 114 parking stalls to zero. REPLIES RECEIVED IN FAVOR: 0 REPLIES RECEIVED IN OPPOSITION: 0 APPEARING IN FAVOR: William Sharp Robert Casares Lloyd Myers APPEARING IN OPPOSITION: None STAFF RECOMMENDATION: Denial MOTION: Motion was made Mr. Gonzalez, seconded by Ms . Garza and passed unanimously to approve the special exception to reduce the minimum required 114 parking stalls to zero, but in lieu there of approve reduction to 30 spaces which must be available in thirty (30) days for paintball facility only on Lots 4 & 5, Block 76, Bluff, since the Board finds that n its opinion, as a matter of fact, such special yard exception will not substantially adversely affect the adjacent property. Motion was made by Mr. Gonzalez, seconded by Mr. Barrera to take appeal off the table. A motion was made by Mr. Barrera, seconded by Ms . Garza to put appeal back on the agenda. Garza and passed to deny the variance, according to Zoning Ordinance Section 29-5 . 01, to reduce the minimum required 5 foot sideyard setback to zero feet for a screen enclosure on Lot 16, Block 6, Country Club Est. Unit 16, 5050 Wooldridge, since the Board finds that in its opinion, as a matter of fact, such variance will substantially affect adversely the uses on adjacent and neighboring property and there is no finding of hardship. REPLIES RECEIVED IN FAVOR: 0 REPLIES RECEIVED IN OPPOSITION: 0 APPEARING IN FAVOR: James Burkhardt, Representative APPEARING IN OPPOSITION: None STAFF RECOMMENDATION: Approval Motion: Motion was made Mr. Gonzalez, seconded by Mr. Barrera and passed unanimously to approve the variance to reduce the minimum required 25 foot sideyard setback to 22 . 68 feet due to shape of lot on Lot 4A, Rolling Acres, 201 Princess, since the Board finds that in its opinion, as a matter of fact, such variance is due to unique condition and will not substantially affect adversely the uses on adjacent and neighboring property. REPLIES RECEIVED IN FAVOR: 0 REPLIES RECEIVED IN OPPOSITION: 0 APPEARING IN FAVOR: Raul Ortiz, Owner APPEARING IN OPPOSITION: None STAFF RECOMMENDATION: Denial Motion: Motion was made by Mr. Gonzalez, seconded by Ms . Garza and passed unanimously to approve the special exception to reduce the minimum required 20 foot sideyard setback to one foot subject to a maximum height being the same as the existing structure and per site plan submitted, on Lots 6-7 , Block 2, Home Place, 1902 Laredo, since the Board finds that in its opinion, as a matter of fact, such special yard exception will not substantially adversely affect the adjacent property. Garza and passed unanimously to approve the variance to reduce the minimum required 10 foot front yard setback to 2 feet 3 inches for existing pool only, due to slope of the lot and subject to maintenance of masonry fence, on Lots 5 & 6, Block 32 , Point Tesoro Unit 4, 15258 Cartagena, since the Board finds that in its opinion, as a matter of fact, such variance is due to the unique condition and will not substantially affect adversely the uses on adjacent and neighboring property.
