Chairman Meinrath opened the public hearing at 1 :30 p.m. , in
the Council Chambers at City Hall and explained the procedure to be
followed:

APPEAL NO. 3035 - Property located at 9801 S . Padre Island
REQUEST: Charles Kennett representing Mary Louise Buhidar, Lots 1-
4, Block 2 , Baywood, located in a B-3 Business District requesting
a special use exception to reduce the minimum required 96 parking
stalls to 40 .
REPLIES RECEIVED IN FAVOR: 1 REPLIES RECEIVED IN OPPOSITION: 0
APPEARING IN FAVOR: Charles Kenneth representing the Owner
APPEARING IN OPPOSITION: 0
STAFF RECOMMENDATION: Approval
Notion: Motion was made by Mr. Ortman, seconded by Mr. Barrera
and passed unanimously to approve the special exception according
to Zoning Ordinance Section 29-3 . 08 to reduce the minimum required
96 parking stalls to 50 spaces for a paintball facility only on
Lots 1-3 (excluding Lot 4) , Block 2, Baywood, since the Board finds
that in its opinion, as a matter of fact, such special yard
exception will not substantially adversely affect the adjacent
property.

REOUEST: Robert A. Huegele, Lots 14-20, Block H, Flour Bluff
Estates, located in a B-4 General Business District requesting a
special yard exception to reduce the minimum required 20 ' side yard
setback to 6 feet.
REPLIES RECEIVED IN FAVOR: 2 REPLIES RECEIVED IN OPPOSITION: 1
APPEARING IN FAVOR: Robert A. Huegele, Owner
APPEARING IN OPPOSITION: 0
STAFF RECOMMENDATION: Denial
Motion: Motion was made by Mr. Veteto, seconded by Mr. Barrera
and passed unanimously to approve the special exception according
to Zoning Ordinance 29-4 . 02, to reduce the minimum required 20 '
side yard setback to 10 feet on Lots 14-20, Block H, Flour Bluff
Estates, 10638 S. Padre Island, since the Board finds that in its
opinion, as a matter of fact, such special yard exception will not
substantially adversely affect the adjacent property.

MISCELLANEOUS
A motion was made by Mr. Barrera, seconded by Mr. Ortman and
passed unanimously to approve the minutes of the prior meeting as
submitted.
