Chairman Huegele opened the public hearing at 1:30 p.m., in the Council Chambers at City
Hall and explained the procedure to be followed:

APPEAL NO. 3164 - Property located at 802 S. Navigation
REQUEST: Thomas Davis representing James S. King c/o Garron Dean, J. C. Russell Farm
Blocks, Block 10, portion of Tract 7A, located in a I-2, Light Industrial District, applicant requesting
a special use exception to allow a 430 foot communication tower within one mile of an existing
tower.
REPLIES RECEIVED IN FAVOR: 0 REPLIES RECEIVED IN OPPOSITION: 0

STAFF RECOMMENDATION: Approval
Motion: Motion was made by Mr. McDonald, seconded by Mr. Mahaffey and passed
unanimously to grant the special exception according to the Zoning Ordinance Section 29-3.12 and
27C-6.01 to allow a 430 foot communication tower within one mile of an existing tower on J. C.
Russell Farm Blocks, Block 10, portion of Tract 7A, since the Board finds that in its opinion, as a
matter of fact, such a special exception will not substantially affect the neighboring and adjacent

property, that the strict application at the regulations would have the effect of prohibiting a
communication service and the exception is consistent with the spirit and intent of the
telecommunication tower ordinance.

APPEAL NO. 3166 - Property located at 5026 Deepwood Circle
REQUEST: Scott Humpal representing Humpal Physical Therapy, Padre Business Park, Lots 6,
7 & 8, located in a B-4, General Business District, applicant requesting a special use exception to
reduce the minimum required 100 parking spaces to 58.

Motion:, Motion was made by Mr. Salazar, seconded by Mr. Grivich and passed unanimously
to grant the special exception according to the Zoning Ordinance Section 29-3.08 to reduce the
minimum required 100 parking spaces to 58 for out patient physical therapy clinic only as
recommended by staff on Lots 6, 7 & 8, Padre Business Park, since the Board finds that in its
opinion, as a matter of fact, such a special exception will not substantially adversely affect
surrounding or adjacent property.

REQUEST: Billy Ruzicka,Oak Terrace Unit 1,Block 1,Lot 3,located in a RE,Residential Estate
District,applicant requesting a special use exception to allow 1,323 square feet of accessory garage
area to a single family residence.

Motion: Motion was made by Mr. Salazar, seconded by Mr. McDonald and passed
unanimously to grant the special exception according to the Zoning Ordinance Section 29-3.02 to
allow 1,323 square feet of accessory garage area to a single family residence due to large lot area,
since the Board finds that in its opinion, as a matter of fact, such a special exception will not
substantially affect the neighboring and adjacent property.
