Call to Order C SECRET ARY,S OFFICE The meeting was called to order at 1:30 p.m. II. Roll Call Board members present: John Dykema, Bill Ewing Chris Hamilton,John Kendall, Mike Lippincott, and Ricardo Martinez Staff members present: Stephen Draper, Steve Van Patten, Russ Arney, Deborah Brown, and Catherine Garza III. Discuss and Act as Appropriate on Re-alignment of Officers No action was taken on this item. IV. Approval of Minutes: November 19,2009,Regular Meeting Mr. Kendall made a motion to approve the minutes of the November 19, 2009, meeting; the motion was seconded by Mr.Lippincott. The motion carried unanimously. V. Review, Discuss, and Act as Appropriate on the Proposed Local Amendments to the 2009 International Building Code Steve Van Patten and Russ Arney provided a review of the proposed local amendments to the 2009 International Building Code. Items discussed: Recommendations to include Sections 907.2.3 and 12.2.3 as provided by the Fire Department staff Recommendation to propose adoption of Chapter 10, Means of Egress, as written in the 2009 IBC. Mr. Dykema inquired about the feasibility to do an amendment in the future if necessary. Mr. Draper informed that the 2009 IBC and amendments are living documents and can be modified;. Recommendation to propose adoption of Chapter 11 with the noted changes appearing in Column B of the code review document prepared by Building Services dated January 21, 2010, 8:48 a.m.; Recommendation to propose adoption of Chapter 14 as written in the 2009 IBC; Recommendation to propose adoption of Chapter 15 as written in the 2009 IBC; Recommendation to propose the necessary changes to number sequencing in the amendments applicable to Section 1609.1.1, "Exceptions:,3., as noted in the code review document (Line Item 22C); Recommendation to propose deletion of recommendation made during the review of 2006 IBC regarding 1609.1.1.1 Applicability, and propose adoption of the section as written in the 2009 IBC; Recommendation to propose the necessary changes to number sequencing in the amendments applicable Section 1609.1.4 Protection of openings, as noted in the code review document(Line Item 24C); SCANNED • Minutes of the Building Code Board of Appeals Regular Meeting Agenda January 21,2010 Page 2 Recommendation to propose deletion of Section 1609.1.4.1 in its entirety. These requirements have to be met through state requirements. Recommendation to propose the necessary changes to number sequencing in the amendments applicable Section 1609.1.4 Protection of openings, as noted in the code review document(Line Item 29C); Recommendation to propose the adoption of the text written in the 2009 IBC regarding Section 1612.3 to include the municipality's applicable information reflected in Line Item 31C;. Recommendation to propose the adoption of Chapter 18 through 30 as they are written' Recommendation to propose the deletion of Section 3107 Signs in the local amendments; staff informed that this responsibility is described in Chapter 1 and is assigned to the building official; Recommendation to propose the necessary changes to number sequencing in the amendments applicable Section 3110 Boat Docks and Moorings, as noted in the code review document(Line Item 73C); Recommendation to propose adoption of Chapters 32 through 34 as they are written(Chapter 34 will reflect an insertion on the topic of`permit movers"; Recommendation to propose adoption of Chapter 35 as written; Recommendation to propose adoption of Appendices K and L; however, the 2009 IBC has an Appendix K and therefore, the City's existing Appendix K will need to be renumbered. Mr. Draper and Mr. Arney informed they are still working on Chapter 1 and the appendices; they shared that once these are completed, these will be brought to the board for review. Mr. Ewing made a motion to accept and recommend the changes presented and noted in the code review document prepared by Building Services, dated January 21, 2010, 8:48 a.m.; the motion was seconded by Mr.Hamilton. The motion carried unanimously. VI. Building Official's Report A. Department Updates 1. Status of Federal Emergency Management Agency Audit Dan McGinn shared information regarding FEMA audit. Mr. McGinn provided copies of the response communications prepared by City staff Mr. McGinn informed on the progress of the research and shared that City staff is working to improve the processes, especially the issuance of building permits for properties identified within the flood zone areas, in an effort to address the deficiencies noted by the FEMA and Texas Water Development Board representatives. B. Staffmg Mr. Draper informed that Building Services has lost one employee and that the position will be filled. Mr. Draper shared that Flood Plain Management training will take place in Corpus Christi in February. He added that the Department was also bringing Texas A&M University staff to provide training of the International Energy Conservation Code to staff Mr.Draper extended an invitation to the board members. Public Comments Board members may not deliberate or make a decision on any matter presented at this time. The Open Meetings Act limits Board response to only two options: 1)a statement of specific factual information given in response to an inquiry; or 2) a recitation of existing policy in response to the inquiry. Any deliberation of or decision about the subject shall be limited to a proposal to place the subject on the agenda for a subsequent meeting. Ms.Jeri Morey addressed the following concerns: 1. Who will be checking for fair housing? She understands TDL will not be doing so. 2. Chapter 35 references the IEBC as an alternate to the IBC; she inquired if the City would be adopting the IEBC as well. 3. The IEBC has Chapter 12 that addresses house moving; she recommends that City staff adopt a local amendment to address Chapter 12. 4. Industrialized housing and rules for Texas —site plan review needs to be reviewed locally. She provided an example where there may be multiple portable buildings adjacent to each other in close proximity and in which they may be considered one building, but there is no fire wall separation. 5. Existing Building Code and Chapter 35—performance based standard: enforcement VIII. Identify items to be placed on next agenda Continue discussion and proposed amendments of the 2009 International Building Code; discussion of 2009 International Residential Code. IX.
