March 20, 2018
MINUTES
I. Call to Order: 1:27pm
II. Roll Call:
• Present: Garry Camp, Robert Knowles, Randy Farrar, Chuck Anastos, and Ramiro Munoz, III.
• Absent: Ray Jones.
• Staff: Gene Delauro – Building Official, Yvette Dodd - Floodplain Manager, Kathleen Holmes –
Project Manager, and Stacy Canfield – Board Secretary.
III. Discussion and possible action regarding a variance request to the Code of Ordinances, Chapter 14,
Article V, Division 5, Section 14-552 (2). Appellant: Scott Cross, Property Owner: Nueces County,
Project: Padre Bali Park, Reason for Request: To allow for a constructed restroom/shower facility below
the required base flood elevation without floodproofing. (2)
Nonresidential construction. New construction and substantial improvements of any commercial, industrial,
or other nonresidential structure must either have the lowest floor (including basement) elevated to or above the base flood level or together with attendant utility and sanitary facilities, be designed so that below the base flood level the structure is watertight with walls substantially impermeable to the passage of water and with structural components having the capability of resisting hydrostatic and hydrodynamic loads and effects of buoyancy. A registered professional engineer or architect shall develop and/or review
structural design, specifications, and plans for the construction, and shall certify that the design and methods of construction are in accordance with accepted standards of practice as outlined in this subsection. A record of such certification which includes the specific elevation (in relation to mean sea
level) to which such structures are flood-proofed shall be maintained by the floodplain administrator.
• Ramiro Munoz, III read the appeal. Gary Camp recused himself from the discussion due to possible conflict. Gene Delauro gave Staff’s presentation regarding this item. Stating the structure is non- inhabitable and only open to registered RV guests and was constructed without permits. When submitted to city for review it was shown to be below base flood elevation. Options are to ask them to mitigate the building to the best they can to meet the flood standards. Several questions and some discussion was had with staff on the process of inspections form this point
forward.
• Randy Farrar made a motion to approve. After some further discussion and with several members stating that they did have some reservations. They did agree that the best solution would be to approve the motion with some stipulations.
• Randy Farrar made a motion to approve the appeal stating, “the Structure to remain below base flood elevation with installed flood vents, must mitigate fixtures as needed, floodproofing the sanitary sewer system to the lift station, and meeting all windstorm requirements.” Ramiro Munoz, III Seconded, all were in favor. 0 opposed. Motion carried.
