REGULAR MEETING
Building Code Board of Appeals
Thursday, May 17, 2018
MINUTES
I. Call to Order: 1:30pm
II. Roll Call and Introduction of Guests and City Staff
o Present: Robert Knowles, Hilary Davis, Randy Farrar, Chuck Anastos, Ramiro Munoz, III.
o Absent: Garry Camp
o Staff: Gene Delauro – Building Official, Stacy Canfield – Board Secretary, Sarah Arroyo –
Assistant Auditor and Aimee Alcorn-Reed – Assistant City Attorney
o Guest: Cathy Taylor, Teresa Carr and Chris Carr
III. Approval of Minutes: Regular Meeting held on February 15, 2018
o Motion to approve made by Robert Knowles seconded by Randy Farrar. 0 Opposed.
Motion passed.
IV. Approval of Minutes: Special Meeting held on March 20, 2018
o Motion to approve made by Robert Knowles seconded by Chuck Anastos. 0 Opposed.
Motion passed.
V. Approval of Absences: Special Meeting held on March 20, 2018
o Ray Jones
o Motion to approve made by Chuck Anastos seconded by Randy Farrar. 0 Opposed.
Motion passed.
VI. Appeal of Building Official determination that a building permit and engineered plans are required
for the construction of a fence in excess of seven feet in height.
o Gene presented the appeal case and staff position. Stating that the applicant had
contacted the department and was given misinformation. Staff feels the applicant acted
in good faith based upon the information she was given.
o Appeal was to have the requirement for the engineering design waived.
o Teresa and Chris Carr who are neighbors of the applicant presented their side stating
that they felt the fence should have to be code compliant as they were concerned it could
fall and damage their property.
o Cathy Taylor, the applicant stated that she felt that she was compliant based on what she
was told by both the Development Services staff and the Code Enforcement officer who
came out to her property.
o Board members discussed their concerns on the way the fence was built. Ramiro stated
that the top portion of the fence would be breakaway based on the way it was built. The
initial fence was not breaking any codes. The main concern was with the top portion that
was added. Board members agreed that they were not impressed with the way the fence
was built, however the problem remained that she was incorrectly advised by City staff.
Board asked if the staff that was involved have been instructed on the proper terms for
fence building. Gene advised that yes, all staff involved had been spoken to and fence
terms have been clarified to them.
o Motion was made to grant the variance for Mrs. Taylors fence not need an engineer’s
design but will require a permit fee. Vote was taken. All in favor, 0 opposed. Motion
passed.
VII. Discussion on proposed Vacant Building Ordinance
o Gene presented the Ordinance, to get feedback from board members.
o Board members did have a few concerns about some of the terms in the ordinance. One
in being the demolition review, not wanting to see the opportunity for new construction
held up. They were concerned with who would designate the building as historical.
Aimee was present, the drafter of the ordinance, she took down notes and concerns of
the board and said they would be included in future discussion of the ordinance.
o Gene also offered Board members to email him their concerns and he would be sure to
move them forward.
VIII. Discussion on Building Code Determinations
A. Fire Sprinkler Requirements for Townhomes
B. Two Family Duplexes – Plat Subdivision
C. Wind Load Certification – Storm Damaged Commercial Buildings
o Gene briefly went over these three code determinations and clarified some questions
for different board members.
IX. Public Comments: None
X. Building Official’s Report
o Gene Delauro presented this item to the Board. Discussed the Department Updates.
XI. Identify items to be placed on next agenda
o Existing Floodplain Maps Vs Future Floodplain Maps
