HomeMy WebLinkAboutMinutes Building Code Board Of Appeals - 01/22/2004 410 City of Corpus = Christi BUILDING CODE BOARD OF APPEALS ADVISORY BOARD MINUTES JANUARY 22, 2004 Board Members Present: Bill Braselton Richard Dodson Jerry Garcia Phillip Skrobarcyzk Board Members Absent: Ernesto Gonzalez Ronald Wheaton Johnny Cotten Staff Members Present: Art Sosa, Building Official Joseph Harney, Assistant City Attorney Alonzo Garza, Plan Examiner Coordinator Julie McCoy, Recording Secretary CALL TO ORDER Chairman Bill Braselton declared a quorum and called the meeting to order at 1:37 p.m. ROLL CALL The first item of business was roll call. Ernesto Gonzalez, Ronald Wheaton, and Johnny Cotten were absent. EXCUSED ABSENCES There were none. APPROVAL OR CORRECTION OF MINUTES —October 23, 2003 A motion was made by Jerry Garcia and seconded by Richard Dodson to accept the minutes with the necessary corrections made. The correction necessary on page two of the minutes needs to read: Jerry Garcia asked the board members to terminate the discussion until someone brought it to the committee. The discussion was terminated. (The discussion terminated was in reference to Jeri Morey's second presentation on The Church of The Good Shepard issues). Development Services P.O. Box 9277 • Corpus Christi,Texas 78469-9277 • (361)880-3240 Building Code Board of Appeal Minutes January 22,2004 Page 2 AGENDA ITEMS Appeal Chairman Braselton skipped agenda item #4 board orientation and item #5 presentation on The Church of The Good Shepard-Munds Hall, and went to the appeal. Appeal No. BCO 0104-01 Robert Earl Kistler II 4038 Claudia Dr. Lot 2 Block 6 Tyler Subdivision Vol. 44 Pg. 194 Mr. Kistler came to the Building Code Board of Appeals to request a variance to the Flood Hazard Prevention Code. Mr. Kistler would like to build a wood frame, single family residence below the base flood elevation for that area. The lowest floor would be built three feet above the lots benchmark of 4.62 ft. Mr. Kistler, owner and builder is disabled and lowering of the building will make it easier to build and access. He provided a letter from the department of Veterans Affairs, showing proof of disability, a letter from the Medical Board, and pictures of the property. A motion was made by Phillip Skrobarcyzk and seconded by Jerry Garcia to approve Mr. Kistler's request for a variance to the Flood Hazard Prevention Code. The motion carried. Board Orientation Board Commission and Committee Orientation Manuals were provided by the City Secretary's Office and were distributed to the members of the board. The orientation manual includes information that covers the policies and procedures of an advisory board in general. The table of contents include: the appointment process, taking the Oath of Office, Policies affecting service, types of authority, summary of the City's Boards, Commissions and Committees, and procedures for conducting a meeting. Election of the Chairman and Vice Chairman Jerry Garcia made a motion to elect Johnny Cotten as Chairman of the board and Richard Dodson as Vice Chairman. The motion carried. Church of The Good Shepard-Munds Hall Presentation Jeri Morey, Architect brought her concerns back to the board for the second time. Her concerns were regarding the building violations at Munds Hall that dated back to 1994. After a brief discussion between the board members, Phillip Skrobarcyzk made a motion to terminate the discussion, and Richard Dodson seconded it. The issue was not an appeal and Mr. Sosa, Building Official decided to meet with her outside from the board. Comments made by Alonzo Garza, Plan Examiner Coordinator: This is not a renovation project. There has not been a change of use and a certificate of occupancy is not necessary. The contractor and design professionals have changed. Building Code Board of Appeal Minutes January 22,2004 Page 3 BUILDING OFFICIAL'S REPORT Mr. Sosa will be working with Jeri Morey on the list and how he will approach mediation. Applications to fill the Commercial builder vacancy on the board are needed immediately. Barbara Bailey, AICP is the new Director of Development Services. Ms. Bailey will be joining the department on January 19, 2004. FUTURE AGENDA ITEMS There were none. PETITIONS FROM THE AUDIENCE Jeri Morey expressed her concerns with Section 14.211.B Changes of Occupancy for buildings. Ms. Morey believes that the section should be eliminated entirely. Fire protection is also not listed anywhere in the section. Ms. Morey was advised by the board to turn in her concerns to the Building Official for the mid year adjustment report.
