• CALL TO ORDER •
Vice Chairman, Johnny Cotten declared a quorum and called the meeting to order at 1:40 p.m.
ROLL CALL
The first item of business was roll call. Bill Braselton, Richard Dodson, and Ernesto
Gonzalez were absent.
EXCUSED ABSENCES
Mr. Cotten was out of town during the last meeting and asked to be excused. A motion was
made by Ronald Wheaton and seconded by Phillip Skrobarcyzk to excuse Mr. Cotten's
absence. The motion carried.
Mr. Wheaton also asked to be excused for his absence during the previous meeting. A motion
was made by Jerry Garcia and seconded by Phillip Skrobarcyzk to excuse Mr. Wheaton's
absence. The motion carried.
APPROVAL OR CORRECTION OF MINUTES—January 22, 2004
A motion was made by Jerry Garcia and seconded by Ronald Wheaton to accept the minutes
• as written. The motion carried.

Mr. John Kendall, appellant, was hired to represent the owner of TSE Equities, owner of lots
10, 11, & 12 of Block 27, 400 Mann Street. Mr. Kendall came to the Building Code Board of
Appeals to request a variance to allow openings in the exterior north wall of the parking
garage. Reference to Table 704.8 found in the 2003 International Building Code.
The description of the building is an existing parking garage. The classification by occupancy
is a U-open parking garage, and the classification by type of construction is IIB. The reason
for the request would increase visibility for people using the parking garage, and enhance
security and ventilation.
The City's Code Enforcement office sent a letter to the owners of TSE Equities on March 08,
2004. The letter is requesting that repairs be made to the wall. TSE Equities has already
retained a contractor, but they would like to see if they can make openings in the wall before
construction is started.
• The wall will be replaced entirely. either as a one hour fire wall solid, or if the board grants a
variance, they will put as many openings in the parking garage allowable.
The concern that the building inspections department has is that the state of the existing wall
is a life safety issue. It is badly deteriorated and has a potential bigger problem. In the 2003
International Building Code, Table 602 of Chapter 7 of Fire Resistance-Rated Construction
page, you will find that within 5 ft. of the property line, all types of construction would
require a one hour fire wall. Therefore, the wall would have to be solid with no penetrations.
Comments made by Phillip Skrobarcyzk:
If this is economic driven, then we're here being asked to save them money. You don't
compromise life safety issues based on economics. The openings would need fire shutters,
and those are expensive.
Phillip Sckrobarcyzk made a motion to grant the appeal based on the use of any opening
having a code conforming fire shutter on a fuseable link. The motion was withdrawn
momentarily.
After hearing the petitioner, Robin Reames, owner of the adjacent building, Mr. Skrobarcyzk
withdrew his motion.
A motion was made by Jerry Garcia and seconded by Phillip Sckrobarcyzk to deny the
• variance and go back to the original wall as per the City's recommendation with a one hour
fire wall and bring the building back up to code. The motion carried.

QUESTIONS ASKED BY BOARD MEMBERS
• Is the wall you are speaking of the one that has already given way?
Response by John Kendall: Yes.
Was it metal studs?
Response by John Kendall: It is metal studs on an EIFS (Exterior Insulation and Finish
System) type system. It is a concrete parking garage, but they filled in that wall with metal
studs.
How did it fall down?
Response by Alonzo Garza: The elements have taken its toll.
Does it sit on the property line?
Response by John Kendall: Yes.
What is the board's position in this matter?
Response by Alonzo Garza: What they are asking of the board is for us to allow them to build
openings similar to the other three sides of the parking garage.
Has your client indicated that they would put fire shutters with links on it?
Response by John Kendall: They have not. That would be an option we could look at. If it is
going to be a cost issue, then they might just go back to putting up a solid wall.
• Why does the owner want to take down a solid wall that complies?
Response by John Kendall: It is more a ventilation and visual thing. It is very dark and at
night, it may be a security issue.

We are currently working on the mid year adjustment to the ordinance on changes to Chapter
l and the building code. We would break out the non controversial items and take those in
April. Any controversial items will be taken for public hearings as well as a proposed fee
adjustment somewhere around August 2004, the new fiscal year. We are drafting some
ordinance changes and would like to have a rough draft available to you during the April
meeting. Brown Bag sessions are still being held with the designers, and we would like to
discuss initial plan site review prior to plan submittal during our next meeting.
SPEAKER: ALONZO GARZA, PLANS EXAMINER COORDINATOR
We're losing Dan Woods, one of our building inspectors. He is going to the private sector. If
you know of anyone who is a combo inspector with knowledge in electrical, plumbing and
building. let us know. We are looking for code interpreters as well as a rounded person.
• Commercial projects have become problematic
We are doing more thorough code searches

We are finding voids in the information
• If an Architect seals a set of drawings on a commercial project, they need to have supervised
that project.
Encourage pre-submittals on commercial projects
We have three times the work with very little staff. We lost Pete, Erik, and John
Intake Specialist will be handling the plan submittals
FUTURE AGENDA ITEMS
There were none.
PETITIONS FROM THE AUDIENCE
Robin and Linda Reames, owners of Black Tie Roses were present. They own the property
next to the parking garage. Ms. Reames stated that the building is in disrepair all around. The
wall tumbling was not caused by high winds a few weeks ago. The wall has been like that for
the past year. Pens are holding up several pieces on the top. She believes that they do not
want to put the wall up because they cannot afford it, she feels that the wall not being there
will depreciate her property value, and she has lost the use of her yard and property overall.
There has been falling debris and has caused broken windshields in her home. She would like
to see the wall put back.
