• CALL TO ORDER
Vice Chairman, Johnny Cotten declared a quorum and called the meeting to order at 1:36 p.m.
ROLL CALL
The first item of business was roll call. Richard Dodson, Ernesto Gonzalez, and Ronald
Wheaton were absent.
EXCUSED ABSENCES
There were none at this time.
APPROVAL OR CORRECTION OF MINUTES—March 30, 2004
A motion was made by Bill Alford and seconded by John Taylor to accept the minutes as
written. The motion carried.
Introduction of New Board Members
Bill Alford is employed with Broadway Quality Homes and is representing the building
industry. John Taylor is also representing the building industry, and he is the president ABC.

AGENDA ITEMS
• Discussion and possible action to replace the Chairman of the Building Code Board of
Appeals.
• Philip Skrobarczyk made a motion to nominate Johnny Cotten as the Board's
Chairman. The motion was seconded by Bill Alford and John Taylor. The motion
carried.
• Art Sosa & Joseph Harney mentioned that the Board has an option to fill the
Chairman's spot for the remainder of the term or interim and fill it now.
Board Orientation
• The sole purpose of the board is to hear appeals that are brought to the City that vary
from the IBC and Codes and Ordinances. We do not make policies. We hear the
appeal and discuss it and pass it among ourselves with the help of Mr. Sosa and Mr.
Harney. Meetings are held once a month on the fourth Thursday and you will be
notified a week prior to the meeting if the Board is going to have it or not. If an appeal
is not scheduled then we do not meet unless Art has items to share with us.
• Orientation manuals will be sent to the new members of the board. The orientation
manual includes information that covers the policies and procedures of an advisory
board in general. The table of contents include: the appointment process, taking the
Oath of Office, Policies affecting service, types of authority, summary of the City's
• Boards, Commissions and Committees, and procedures for conducting a meeting.
• The Mayor and City Council provided gifts to express their appreciation to all of the
board members for their services.
Variance to the City Building Code- To not have the building sprinkled
• Appeal No. BC0 0504-03 Mineral Processing & Marketing
Representative: John Kendall
Bronco Rd.,North Portion of Lot 9 HB Shepard Farm Lots
Mr. John Kendall, appellant, was hired to represent the owner of Mineral Processing &
Marketing, owner of the North Portion of Lot 9 on Bronco Road. They are requesting a
variance to exempt their building from the sprinkler system requirement that is necessary. A
sprinkler system is required in a building larger than 12,000 sqft; this particular building is
41,000 sqft. The material they would like to store in this structure needs to be housed away
from dust and water. If the substance comes in contact with water, it tends to have a chemical
reaction and heat up.
Robert Harold, President of Mineral Processing and Marketing, stated that the substance is
currently being stored in various places here in Corpus Christi and at the Port. The building
will have a system to prevent dust from coming in. Site plans were provided.
• Trucks will come into the structure, load the product and ship them out. If the material was to
get wet, you would get a front end loader or back hoe and dig it out. You typically smolder it.

Mike Borden, Captain-Arson Investigator, thinks that a sprinkler system is the best way to go.
Flint Hills Refinery has the same operation and they contain the material outdoors. The
• downside to not sprinkling the building would be a health hazard 1. This material is
flammable and it does burn. This material is used as a fuel in Mexico.
Since it does not pose a life safety threat, a motion was made by Philip Skrobarcyk to grant
the variance as long as there is 24 hour manning onsite and video surveillance. John Tucker
seconded the motion. The motion was approved and the Variance was granted.
QUESTIONS ASKED BY BOARD MEMBERS
Does it have a hydration process?
Yes, water helps it react.
What is your setback?
The setback is over 60 feet.
Where are the fire hydrants?
We are preparing to extend a line.
Will there be an alarm system?
We could get one installed.
How is the facility monitored?
• There will be a twenty four hour man watch in and around the building.
Is there an office?
Yes, there is. There is also a control room.

• Ernesto Gonzalez does not have a desire to continue serving with the board, so we will
be soliciting for a public member not affiliated with the Building Industry
• We are working on getting the Ordinance Amendments processed and done for
discussion with the Development Community
• We will bring the amendments to the board as well as the various agencies such as the
AGC, ABC, AIA, and the Builders Association
• We will talk about the proposed changes to the building and residential codes as it
relates to the Windstorm
• We are working on getting the Inspectors Windstorm Certified
• As far as our reduction in staff, we are working on getting one person in Building
Inspections that was not previously budgeted
• Since Dan Woods resigned and Eric Johnson retired, there are two vacancies
• I would like to get Eric's position filled by an Inspector who could come in doing half
inspections and half plan review

• Solicit a recommendation to take Ordinance changes to council in July

A motion was made to adjourn by John Taylor and seconded by Bill Alford. The motion
carried and the meeting was adjourned at 2:15 p.m.
