Roll Call Board members present: Ron Wheaton, Don Boyd, John Taylor, John Dykema, and Mike Lippincott. City staff present: Doug Maples, Elsa Martinez. Mr. Jay Reining arrived after the meeting had commenced III. Appeal of Building Official Determination Regarding the North Beach Project Mr. Maples informed the board that the appeal would not take place at this meeting. He asked if the board would please consider reserving this item for future consideration if necessary. Board members consented and proceeded with the order of business. IV. Approval of Minutes of November 12,2008 Meeting Mr. Dykema made a motion to approve the minutes for the November 12, 2008 meeting, seconded by Mr. Lippincott. Motion carried 4-0-1, with Chair John Taylor abstaining. V. Review, Discuss, and Act as Appropriate to Adopt Chapters 2 through 43 of the International Residential Code Mr. Maples informed the board that a definition for the term townhouse would be provided at the next meeting. The board proceeded to review Section 4 of the IRC and opted to retain it as is. No action was taken. * * * * * * * * * * The board reserved Section 7 for reconsideration. * * * * * * * * * * Mr. Dykema moved to delete Section 8, seconded by Mr. Boyd Motion carried 4-0-1, with Mr. Taylor abstaining. * * * * * * * * * * • The board did not act on Section 9. * * * * * * * * * * Section 10 will be relocated to the proper section within the IRC. Mr. Reining recommended that this section needs to be reviewed and reconsidered * * * * * * * * * * SCANNED Irre *if Minutes of the Building Code Board of Appeals Special Meeting November 19, 2008 Page 2 The board recommended that Article 5 be moved to the Unified Development Code. * * * * * * * * * * Sections 11 and 12 will be retained as they read. * * * * * * * * * * Mr. Dykema motioned to delete Section 13 (401.1), seconded by Mr. Wheaton. Motion carried 4-0-1, with Mr. Taylor abstaining. * * * * * * * * * * Mr. Dykema motioned to leave Sections 14 and 15 as amended with noted changes, seconded by Mr. Lippincott. Motion carried 4-0-1, with Mr. Taylor abstaining. * * * * * * * * * * Board members and City staff noted a problem with the number system when they arrived at Chapter 6 (606.10). Mr. Maples asked for the liberty to correct the number system. Mr. Dykema moved to approve the necessary changes to Section 16 as discussed, seconded by Mr. Lippincott. Motion carried 4-0-1, with Mr. Taylor abstaining. * * * * * * * * * * The board reserved the right to reconsider Section 17. * * * * * * * * * * Mr. Dykema moved to delete Section 19, seconded by Mr. Wheaton. Motion carried 4-0-1, with Mr. Taylor abstaining. * * * * * * * * * * No action was taken on Section 25-203. * * * * * * * * * * Mr. Maples informed the board of the necessity to provide definitions for the terms historical building, townhouse, and windstorm regulation and which would be provided at the next board meeting. *tooe VW' Minutes of the Building Code Board of Appeals Special Meeting November 19,2008 Page 3 Mr. Boyd motioned to strike "15 pounds"and go to "30 pounds" in Section 30, seconded by Mr. Lippincott. Motion carried 4-0-1, with Mr. Taylor abstaining. * * * * * * * * * * The board recommended that the hurricane standards be incorporated into the International Residential Code by reference. The board did not have an opportunity to discuss Items VI and VII in the order of business. They reserve the right to consider these items in a future meeting. VI. Review and Discuss Chapters 2 through 15 of the International Existing Building Codes VII. Review, discuss, and Act as Appropriate on Definitions of Chapter 2 of the International Building Code VIII. Review Candidates' Resumes for New Board Members and Determine if a Recommendation Will be Submitted to City Council After review and consideration of applications and resumes provided by the City Secretary's office, the board acted as follows: • • Mr. Dykema moved to submit the Board's recommendations of Mr. Ricardo Martinez (for representation in the engineering field) and Mr. John Kendall (in the building industry) to City Council for the two positions currently available in the Building Code Board of Appeals. The motion was seconded by Mr. Lippincott. Motion carried 4-0-1, with Mr. Taylor abstaining. * * * * * * * * * * IX. Identify of items to be placed on next agenda I. Public Comments Board members may not deliberate or make a decision on any matter presented at this • time. The Open Meetings Act limits Board response to only two options: 1) a statement of specific factual information given in response to an inquiry; or 2) a recitation of existing policy in response to the inquiry. Any deliberation of or decision about the subject shall be limited to a proposal to place the subject on the agenda for a subsequent meeting. No one addressed the board during public forum. XI. Adjourn Mr. Boyd motioned to adjourn the meeting, seconded by Mr. Lippincott. Presiding Cha r •
