MINUTES OF THE REGULAR MEETING
OF THE
BUILDING CODE BOARD OF APPEALS
September 26, 1991

Chairman Skrobarczyk called the meeting to order at 1:32 p.m. , in
the Committee Room on the first floor of City Hall.

APPEAL NO. 91-5
The public hearing was opened on Appeal No. 91-5. The appellant was
Linda Yarborough requesting a variance to Table 400, Sections 901.7.1,
930.1.1 and 1704.2.3 of the Corpus Christi Building Code.
Property Description: Lots 1B and 2B, Block 4, Tract 3 J.C. Russell Farm
Lots, 200 block of North Padre Island Drive.
Mr. Lorenzo Gonzalez, Building Official, explained that the
appellant was proposing to build an open wood frame, Type VI, Mercantile
use building that is over area, does not have a fire alarm system or
draft stopping. He stated that the intended use is to have temporary
vendors similar to a flea market operation.
Mr. Chuck Urban and Mr. Richard Shockey explained the project. Mr.
Urban stated that the property is located on North Padre Island between
Bear Lane and Bates Drive. Mr. Shockey showed the Board conceptual
pictures and explained that they would like to construct an open air
market that would be open on both sides. Mr. Urban explained that this
is a unique situation and that the mercantile classification does not
totally apply to the proposed open air use and type construction. He
added that draft stopping would not be practical in this building and
that a sprinkler system, open to the elements, would be a maintenance
nightmare. Mr. Urban added that the design plan included installation of

a typical fire alarm system with several fire hydrants around the
perimeter of the property. A brief discussion followed concerning the
type of stalls, the type of construction, and the partitions that would
be used.
A motion was made by Mr. Sebbert , seconded by Mr. Bennett and passed
unanimously to grant the requested variance with the following
conditions: 1) The variance applies to the open covered building area
only, 2) Minimum aisle width will be 18 feet, measured table to table, 3)
Exits shall be spaced no more than 100 feet apart with exit signs at each
location, 4) Exit cross aisles shall be a minimum of 10 feet in width, 5)
No permanent partitions are permitted, 6) All temporary partitions shall
be a maximum of 6 feet in height, 7) Compliance with a manual pull
station, fire alarm system to NFPA standards is required, 8) All
construction associated with food and business uses shall be in full
compliance with the code; since it is the Board's opinion that full code
enforcement would do manifest injustice, and would be contrary to the
spirit and purpose of the code or public interest.

The next item on the agenda was the presentation and review of the
proposed Repetitive Loss Plan a component of the Community Rating System
(CRS) Program.
Mr. Fred Pena, Building Code Engineer provided the Board an overview
of the Community Rating System (CRS) Program comparing it to the Fire
Insurance Program. He indicated that in both programs premiums are
discounted as a result of prevention programs in place. He identified
Elevation Certificate requirements and a Repetitive Loss plan as the
major components for being in the CRS program. He explained that the
Repetitive Loss Plan contained both short and long range objectives with
the deciding factor being cost of implementation.
The next item was an update regarding the proposed revision of the
Flood Insurance Rate Map (FIRM) panels applicable to the Padre Island
area. Mr. Gonzalez stated that he had provided the Board with a copy of
the Public Notice, to make them aware that the 90 days appeal period will
close on October 23, at which time the revised maps of Padre Island will
become final.
Motion was made by Mr. BeLnett, seconded by Mr. McDonald and passed
unanimously to approve the minutes of August 22, 1991 as submitted.
Mr. Gonzalez stated that the Ad Hoc Foundation Committee was still
in the discussion phase. He explained that concerns have surfaced that
possible remedies, discussed would impact construction cost. He added
that in the process the Committee has reviewed some records and found the
process difficult because it is a manual system.

Motion was made by Mr. Bennett, seconded by Mr. Sebbert and passed
unanimously to excuse Mr. Graham's and Mr. Kramer's absence from the
meeting.
A discussion followed concerning The American Disability Act which
goes into effect January 26, 1992. Mr. Bennett requested that staff
provide the Board a copy of the guidelines for the Board's review between
now and and the effective date.
The meeting was adjourned at 2:46 p.m.
