Chairman Skrobarczyk called the meeting to order at 1:33 p.m. , in
the Human Resources' Conference Room on the second floor of City Hall.

APPEAL NO. 91-11
The public hearing was opened on Appeal No. 91-11. The appellant
was the City Of Corpus Christi requesting a variance to Section 1121
Guardrails of the Corpus Christi Building Code.
Property Description: Cole Park, 200 Block of Ocean Drive.
Mr. Lorenzo Gonzalez, Building Official, stated that this was a
community oriented project for a playground area with a series of
recreational structures. He explained that Section 1121 of the Building
Code requires unenclosed floors raised more than 30" above grade to have
guardrails that are at least 42" in height. Mr. Gonzalez added that the
plans submitted call for a 38" guardrail height.
Mr. Malcolm Matthews, Director of Park and Recreation, explained
that the Leathers Group, project architects, designed the project
according to a standard set of specifications used around the country for
similiar recreational projects and that the building regulations did not
quite match. He added that a conflict in the guardrail height existed.
Mr. Matthews clarified that the project architect feels that the 42"
guardrail height is a problem since the required rail height would
prevent kids from seeing over the rail and parents from observing their
children.

Mr. Gonzalez responded to a question concerning liability by
explaining that from a code standpoint the City's liability is
non-transferable.
After a brief discussion a motion was made by Mr. McDonald, seconded
by Mr. Graham and passed with Mr. Bennett abstaining to grant the
variance to allow a guardrail height of 38", since it is the Board's
opinion that to require enforcement there of would do manifest injustice,
and would be contrary to the spirit and purpose of the Code or public
interest.
A motion was made by Mr. Bennett, seconded by Mr. Kramer and passed
unanimously to approve the minutes of September 26, 1991 as submitted.
Under current concerns and events Mr. Gonzalez reminded the Board of
the meeting scheduled for Thursday, November 21, 1991. He also gave a
brief update on the Ad-Hoc Foundation Standards Committee.
The meeting was adjourned at 1:55 p.m.
