MINUTES OF THE REGULAR MEETING OF THE BUILDING CODE BOARD OF APPEALS November 21, 1991 BOARD MEMBERS PRESENT: Phillip Skrobarczyk, Chairman Miles Graham, Vice Chairman Robert Bennett Jerry Kramer Tommy McDonald Bill Osborne Charles Sebbert BOARD MEMBERS ABSENT : None STAFF MEMBERS PRESENT: Fred Pena, Building Code Engineer Jesse Guzman, Fire Marshall Brett Lacey, Fire Protection Specialist Elizabeth Kay Butler, Senior Secretary Chairman Skrobarczyk called the meeting to order at 1:36 p.m. , in the Council Chambers on the first floor of City Hall. Appeal No. 91-11 The public hearing was opened on Appeal 91-11. The appellant was Gus Cargile requesting a variance to Section 402.4.1 of the Corpus Christi Building Code. Property Description: SHC. 6.5 acres, McBride Partition, 135 Navigation. Mr. Fred Pena, Building Code Engineer, described the building, the requested variance and stated that staff recommends denial of this appeal due to the potential hazard for the loss of human life. Mr. Gus Cargile, applicant, reviewed his proposed plan with the Board and answered questions. During a brief discussion the Fire Marshall stated that the Fire Department did not have a problem with this request provided that the occupants had plenty of exits from the top floor. A motion was made by Mr. Kramer, seconded by Mr. McDonald and passed unanimously to grant the variance with the following requirements: 1) U that the travel distance not exceed 150 feet, 2) that the exit stairs and V J exit corridors be code conforming, 3) that the storage areas be set off D by chain link fences and that the chain link fences also be used as a means to direct people to the exits, 4) that the area be used for auction Z purposes only, and 5) that exit signs be placed at all cross aisles on Z the second floor. m P.O. The appellant • was Joe L. Garcia requesting a variance to Sections 507.2, 507.4.1 and 507.10.3 of the Corpus Christi Building Code. Property Description: Lot 48, Block 2, Behmann Addition, 4981 Ayers. Mr. Pena described the building, the requested variance and stated that staff recommends denial of this appeal due to the potential hazard to human life and the difficult exiting conditions that would be created by installing eight foot high partitions which would block visibility throughout the building. Mr. Joe Garcia described the proposal and stated that they are proposing to hang directional exit signs at all intersections of the aisles at a height that would satisfy the Fire Department. After a discussion a motion was made by Mr. Graham, seconded by Mr. McDonald and passed unanimously to deny the variance based on the fact that as it has been submitted it would in fact be creating a mall and mall requirements were not being met. The meeting was briefly recessed at 4:00 p.m. The meeting reconvened at 4:09 p.m. Mr. Joe Garcia and Mr. Jesse Rodriguez were allowed to express their feelings regarding the Board's decision on Appeal No. 91-12. ************************************************************************* Appeal No. 91-13 The public hearing was opened on Appeal No. 91-13. The appellant was Trian Serbu requesting a variance to Table 400, and Sections 404.45 and 1106.15 of the Corpus Christi Building Code and Article 5, Section B(2) of the Flood Hazard Prevention Code. Property Description: Lot 2, Block G, Brookline Subdivision, 2822 North Shoreline. Mr. Pena described the existing building, the requested variance and stated that the staff recommends: 1) denial since the Code does not allow habitable spaces below the base flood elevation in a velocity zone, and 2) denial of non-rated glass in the exit stairwell due to the potential hazard to the verticle means of egress. Mr. Pena then read for the record Section 60.6 Paragraphs 4 and 5 of the National Flood Insurance Program for the purpose of serving official notice to the appellant of the exposure to higher insurance rates. A motion was made by Mr. Bennett, seconded by Mr. Graham and passed unanimously to approve the variance to Table 400, and Sections 404.45 and 1106.15 with the following conditions: 1) that they have a fire alarm system installed, 2) that two code conforming exits be built, 3) that the glass in the stairwell be laminated to provide one hour fire resistive protection, 4) that the 5,000 square foot storage be accepted with the condition that the open area on the first floor remain open, and 5) that no cooking area be allowed on the first floor. A motion was then made by Mr. McDonald, seconded by Mr. Graham and passed unanimously to grant the variance to Article 5, Section B(2) of the Flood Hazard Prevention Code, based on the fact that: 1) the Board felt that the appellant had showed good and sufficient cause; 2) the Board determined that failure to grant the variance would result in exceptional hardship to the applicant; and 3) the Board determined that the granting of a variance will not result in increased flood heights, additional threat to public safety, extraordinary public expense, create a nuisance, or cause fraud on or victimize the public or conflict with existing laws or ordinances. ************************************************************************* The Board agreed to table the remainder of the agenda until next month.
