March 26, 1992

Chairman Skrobarczyk called the meeting to order at 1:31 p.m. , in
the Committee Room on the first floor of City Hall.

APPEAL NO. 92-6
The public hearing was opened on Appeal No. 92-6. The appellant was
Cantu Construction requesting a variance to Section 1112.3.4 of the
Corpus Christi Building Code.
Property Description: Lot 11, Block 7, Country Club Estates #2, 5026
Greenbriar.
Mr. Lorenzo Gonzalez, Building Official, stated that the proposed
method of construction was denied on the grounds that a 6'-6" head room
clearance height was not maintained while descending a second floor means
of egress. He identified the project as new single family residence with
a temporary Certificate Of Occupancy pending the outcome of the appeal.
Mr. Avenio Olivarez explained that the staircase was a secondary
staircase and that the home owners did not need the required 6'-6"
clearance. He express concern on how the height clearance is measured.
He added that it was best to have the secondary staircase as proposed
rather than none at all. Cl)
A motion was made by Mr. McDonald, seconded by Mr. Sebbert and
passed unanimously to grant the variance based on the fact that no public
safety issues were involved, the owners accept the physical condition and
a code conforming stairway is provided, since in its opinion, the
enforcement thereof would do manifest injustice and would be contrary to
the spirit and purpose of the code.

APPEAL NO. 92-7
The public hearing was opened on Appeal 92-7. The appellant was
Corpus Christi Trade Center, Inc. , requesting a variance to Section 507.2
of the Corpus Christi Building Code.
Property Description: Block B & AR, Lexington Village, 2933 South Padre
Island Drive.
Mr. Gonzalez explained that the appeal dealt with the maintenance of
one hour rated fire resistive separations. He added that the proposed
method of construction had previously been denied, and that now a
different type of material was being proposed. He clarified that in
staff 's opinion the proposed method still had the same intent that had
been previously considered in that the intent was to create tenant
separations.
Ms. Nora Garcia, Architect, explained that the current proposal
called for totally collapsible partitions of non-combustible chain link
material at the perimeter of each space. She clarified that the original
proposal called for eight foot high partitions with at least four feet of
combustible material combined with chicken wire or pegboards. She added
that the spaces would be larger than previously proposed and closed only
during non-business hours.
Mr. Tom Pyle, owner, explained that the collapsible walls are
intended to provide the tenants security while maintaining total
visibility.
A motion was made by Mr. Sebbert, seconded by Mr. Kramer and passed
with Messrs. Bennett, Kramer, Osborne, Sebbert and Skrobarczyk voting yes
and Mr. McDonald voting no to accept the proposed method of construction
with the stipulation that the retractable non-combustible partitions be
open and secured any time that the building is opened to and occupied by
the general public and that 100 percent clear visibility must be
maintained, thus no hanging or display of any merchandise, since in its
opinion, the enforcement thereof would do manifest injustice and would be
contrary to the spirit and purpose of the Code.

APPEAL NO. 92-8
The public hearing was opened on Appeal No. 92-8. The appellant was
Blackbeards on the Beach requesting a variance to Article 3, Sections B &
D and Article 5, Sections A, B & F of Flood Hazard Prevention Code.
Property Description: Lots 10 & 12, Block 6, Brooklyn Addition, 2822

Mr. Gonzalez explained that the proposed conversion of an existing
structure from a mercantile use to a business use was denied on the
grounds that the structure did not meet the required base flood elevation
of 15 feet to the soffit of the lowest horizontal structural member. He
added that the property was located in a velocity zone, V22 (EL 15) , on
Corpus Christi Beach. He then referenced Section 60.6 (a) Paragraphs 2,
4, 5, and 6 of the National Flood Insurance Program and read a portion
for the record regarding variances and flood insurance rates.
Mr. Steve Bonillas, a partner in Blackbeards Restaurant, explained
that the restaurant was the former Spanish Kitchen and described changes
in atmosphere to that of casual dining in a beach area. He additionally
described future plans. He identified the site as an existing baitstand,
formerly a small restaurant located near the proposed site of the
Lexington. He showed the Board pictures of the masonry structure which
has withstood previous hurricanes. He explained that a variance was
being requested because it would be difficult to raise the existing
structure to the required elevation.
A motion was made by Mr. Bennett, seconded by Mr. McDonald and
passed unanimously to grant the variance to Article 3, Sections B & D and
Article 5, Sections A, B & F of the Flood Hazard Prevention Code for the
reasons that this action is the minimum necessary required to provide
relief, the appellant has been served with notice that flood insurance
rates may be higher for this property and to require raising the building
to the required minimum elevation would create an undue hardship.

A motion was made by Mr. Bennett, seconded by Mr. McDonald and
passed unanimously to approve the minutes of the previous meeting as
submitted.
(The meeting was recessed for five minutes)
The next item was the discussion of recommendations contained in the
Final Report submitted by the Ad Hoc Foundation Standards Committee.
After a brief review and discussion the Board agreed to place this item
on next months agenda at which time final determinations are to be made.
The Board requested that members of the Ad Hoc Foundation Standards
Committee be invited to attend.
Mr. David Richter, Kipp, Richter & Associates, petitioned the Board
concerning a project that is on a very short development schedule. He
explained the project and requested that either a permit contingent upon
an appeal decision by the Board or whatever other action that may be
necessary be taken such that the project may proceed. (Mr. McDonald

abstained from participating in the discussion) After a brief discussion
the Board agreed to schedule a special meeting of the Board for Thursday,
April 2, 1992, at 1:30 p.m.
The Board also agreed to hold a discussion at the special meeting
concerning the Ad Hoc Foundation Standards Committee Final Report to
establish a consensus before the next regular meeting.
The meeting was adjourned at 3:23 p.m.
