Chairman Skrobarczyk called the meeting to order at 1:37 p.m. , in
the Committee Room on the first floor of City Hall.

APPEAL NO. 92-9
The public hearing was opened on Appeal No. 92-9. The appellant was
David Richter requesting a variance to Sections 701.1.1, 702.1.5 and
Table 700 of the Corpus Christi Building Code.
Property Description: Lot 1, Block 1, Glenn Arbor, 5402 South Staples.
Mr. Lorenzo Gonzalez, Building Official, explained that the proposed
method of construction was denied on the grounds that the required one
hour fire resistive construction separations between tenant spaces and a
vertical opening, thus communicating floors and tenants was not provided.
He pointed out that at this time Mr. Richter was only addressing one
space but that it will impact all future tenants within the building.
CO Mr. McDonald abstained from participation in the discussion and vote
because of a conflict of interest.
Mr. David Richter of Kipp Richter and Associates explained the
overall layout of the building and identified the area the first tenant,
CCNB, would occupy. He added that the proposal included upgrading an
existing corridor with one hour fire rated partitions such that an exit
access corridor would connect the two fire exit stairs without exposing
any tenants independent of the atrium. He stated that it was his
understanding that in other cases a sprinkler system installed along a
glass partition had been accepted as equal to a one hour fire rated
separation in buildings other than atrium buildings. Mr. Richter added
that the question was whether sprinklers along a glass partition, in

addition to dampers and other separation devices installed such that
there are no communicating openings, was equal to a one hour fire
resistive rated separation for maintaining tenant separations.
Brett Lacey, Fire Protection Specialist, explained that applying
sprinklers to glass as far as washing the glass provides a fire
separation for which results have been fairly good, but that all of the
testing conducted shows that it works well in facilities that are 100%
sprinkled. He stated that in his opinion the use of sprinklers on glass
without any other protection would not be adequate and would not maintain
the required rating. He added that for different tenants the separations
should be maintained.
After a discussion a motion was made by Mr. Bennett, seconded by Mr.
Graham and passed with Mr. McDonald abstaining to approve the variance
provided that fully protected one hour fire resistive rated corridors be
installed on the second floor, the installation of a sprinkler system
adjacent to all glass partitions as per the Atrium standards and in
accordance to NFPA 13, on both floors such that it will wash the window
walls and all future tenants will comply with all codes, since the
enforcement of the Code would do manifest injustice and would be contrary
to the spirit and purpose of the Code or public interest.

The next item was the discussion of recommendations contained in the
Final Report submitted by the Ad Hoc Foundation Standards Committee. The
Board briefly discussed the following:
1. The need for repair permits.
2. Definition of foundation repair
3. Basic criteria for requiring engineering
4. Site soil compaction
5. Minimum concrete panel size and slab thickness
A follow-up discussion was scheduled for the next regularly
scheduled board meeting at which time it was requested that the Ad Hoc
Foundation Standards Committee be present.
The meeting was adjourned at 2:50 p.m.
