APPEAL NO. 92-11 The public hearing was opened on Appeal No. 92-11. The appellant was Blackbeards On the Beach requesting a variance to Article 3, Sections B, C, and D and Article 5, Sections A and B of the Flood Hazard Prevention Code. Property Description: Lots 103 and 104. Block 40, Beach Hotel, 3117 Surfside. Mr. Lorenzo Gonzalez, Building Official, referenced federal regulations regarding National Flood Insurance Program Section 60.6 and read a portion for the record regarding variances, flood insurance rates, and the serving of written notices to the appellant. Mr. Gonzalez explained that the proposed method of construction had been denied on the grounds that it did not meet the required top of finish floor elevation of 12 feet for a structure located in an A18 flood zone as designated in the Community's Flood Insurance Rate Maps. He added that a portion of the existing structure was being converted to habitable space to accommodate handicap facilities and that a patio was being converted in use for outdoor dining. Mr. Steve Bonillas and Mr. Mike Assin partners in Blackbeards Restaurant, explained that the area is question was part of the existing structure used as an unenclosed storage area. Mr. Bonillas added that their contractor had informed them that a permit was not needed since, it was an existing storage area. They later found out that a variance was Necessary because of the change in use from storage to business habitable space. SCANNED P.O. Box 9277 • Corpus Christi, Texas 78469-9277 • (512) 880-3000 V%."r0 L.itV CI Building Code Board Of Appeals Iay 23, 1992 ' hristi cage 2 war After a brief discussion a motion was made by Mr. McDonald, seconded by Mr. Graham and passed unanimously to grant the variance to Article 3, Sections 3, C and D and Article 5, Sections A and B of the Flood Hazard Prevention Code for the reasons that this action is the minimum necessary required to provide relief , the appellant has been served with notice that flood insurance rates may be higher for the property and to require raising the building to the required minimum finish floor elevation would create an undue hardship since it is an existing structure. APPEAL NO. 92-12 The public ~-.earing was opened on Appeal No. 92-12. The appellant was the City of Corpus Christi requesting a variance to Article 3, Sections B and D and Article 5, Sections A and B of the Corpus Christi Flood Hazard Prevention Code. Property Description: Nueces River Park, 6667 IH 37/US 77 Mr. Gonzalez identified the location as the Nueces River Park on IH 37. He explained that the proposed method of construction was denied on the grounds that it did not meet minimum top of finish floor elevation of 15 feet for a structure and its supporting facilities to be located in an A6 Flood Zone as identified in the Community's Flood Insurance Rate Maps. He added that the entire site is located in a Floodplain floodway area. Mr. 'Angel R. Escobar, Assistant Director of Engineering, stated that the proposal was to build a men and women restroom facility, approximately 400 square feet in area with a total concrete deck area of approximately 600 square feet (20'-0" x 30'-0") on concrete pilings with a handicap access ramp designed to meet all handicapped accessibility requirements. He described 'low the sanitary system would work and be maintained to minimize discharge in the flood plain. He explained that the bottom of the floor would be at 13.5 feet which is the elevation for that particular section of the floodplain and that the variance request supports the fundamental use of the park. A motion was made by Mr. Graham, seconded by Mr. Bennett and passed unanimously to grant the variance on the basis that it would create an undue hardship to do otherwise, does not represent an increase in flood hazard, will not '-esult in the release of contaminates and is a functionally dependent use. :************************************************************************ A motion was made by Mr. Graham, seconded by Mr. McDonald and passed unanimously zoapprove the minutes of the previous meeting. Bud Colwell briefly updated the Board on the status of the U.S.S. Lexington project and requested a special meeting for the purpose of requesting a variance to allow the construction of an approachway structure in accordance with Section 60.6 of the National Flood Insurance Program (NFIP) and FEMA regulations. The Board agreed to hold a special meeting on Thursday, June 4th at 1:30 p.m. to hear the appeal request. The next ;.tem was the discussion of recommendations contained in the Final Report submitted by the Ad Hoc Foundation Standards Committee. The Chairman reminded the Board that some action to approve had already been taken regarding post tension slab design. Mr. Bill Sanderson explained that he was not an engineer but that he had a considerable amount of experience, and the longest operating post tension slab company in the City. He added that in his opinion the Board had not hit of the real issue and that the issue is to get the design engineers more involved. A lengthy discussion followed regarding design, field practices, project coordination, soil testing, inspections, certification and the involvement of the Design engineer. Following the discussion Mr. Graham made a motion, seconded by Mr. Bennett that prior to the issuance of a Certificate Of Occupancy for any structure that has a post tension foundation design that a letter of certification, from the permit holder, be issued to the City stating that the foundation has been constructed in accordance with plans and specifications. The Board agreed to defer action on the motion until the next regular meeting and concluded that additional input was needed from the engineering community.
