Butler, Senior Secretary Chairman Skrobarczyk called the meeting to order at 1:51 p.m. , in the Council Chambers on the first floor of City Hall. ************************************************************************ APPEAL NO. 92-15 The public hearing was opened on Appeal No. 92-15. The appellant representing the Texas State Aquarium was Jack Solka requesting a variance to Article 3, Sections B & D and Article 5, Sections A, B and F of the Corpus Christi Flood Hazard Prevention Code and Sections 1106.1.3, 1111 and Table 400 of the Corpus Christi Building Code. Mr. Bill Osborne abstained from participating in the case due to a conflict of interest, since he had been involved in the design of the area in question. Mr. Lorenzo Gonzalez, Building Official, stated that the proposed method of construction was denied on the grounds that it was not in code conformance with the Flood Hazard Prevention Code for the following 1. a change in use of an existing open area, underneath the main aquarium building, 2. the conversion of grade level area to an assembly use (Food Court) and 3. the evaluation and protection of mechanical equipment. He added that two hour fire rated resistive construction for exit enclosures and exit outlets and a fire sprinkler system were not provided as required by the Building Code. Mr. Gonzalez then referenced the federal regulation sections applicable under the National Flood Insurance Program. In particular, Section 60.6 paragraphs 3 through 7 were addressed to serve notice that the project may be subject to higher insurance rates, that this is the minimum the City can do in granting a variance and that this action will be reported to FEMA as part of the Annual Report process. He briefly explained the project, identifying the following seven items as needing Board consideration: (1.) the installation of 2 - 20 foot diameter, 10,000 gallon tanks. (2.) the installation of 4 - 4 feet x 20 feet, 1,000 gallon tanks. (3.) the installation of a 10 foot x 10 foot chain-link storage area. (4.) the parking of six automobiles on a temporary basis while loading and unloading. (5. ) the location of a food serving line - concession type operation with 100 tables and 400 chairs. (6. ) the location of 20 folding tables and 100 chairs for temporary summer classes and programs. and (7.) the installation of an approximately 4 foot high netting material for a recovering birds containment system. Mr. Solka explained that due to operational changes it was necessary to have the items identified to support the daily operations of the aquarium and which are functionally dependent uses. He added that the engineer's calculations showed that the obstructions would raise the water level 1.2 inches. A motion was made by Mr. McDonald, seconded by Mr. Bennett and passed unanimously with Mr. Osborne abstaining to grant the variance to allow the use of the grade level surface for (1.) the installation of 2 - 20 foot diameter, 10,000 gallon tanks, (2.) the installation of 4 - 4 feet x 20 feet, 1,000 gallon tanks. (3. ) the installation of a 10 foot x 10 foot chain-link storage area. (4.) the parking of six automobiles on a temporary basis while loading and unloading. (5. ) the location of a food serving line - concession type operation with 100 tables and 400 chairs. (6. ) the location of 20 folding tables and 100 chairs for temporary summer classes and programs, and (7.) the installation of an approximately 4 foot high netting material for a recovering birds containment system, since it is a functionally dependent use, engineering calculations show minimal impact, a hurricane evacuation plan is on file and to require otherwise would be contrary to the spirit and purpose of the code or public interest.
