The first item of business was the approval and correction of the previous meeting minutes, April 24, 1997.(The May meeting was canceled.) Motion by Bill Braselton, second by Bob Bennett,to approve the minutes as written. Motion passed unanimously. The Board determined that the appellant and content were the same in Appeals B97-08 and B97-10 (although the locations were different) and unanimously decided to hear both cases together. APPEAL NOS. B97-08 and B97-09 The public hearing was opened on Appeal Numbers B97-08 and B97-09. Mr. John Folan, the appellant, requested a variance to Section 402.4.1, occupancy area modifications for unlimited building areas,of the City Building Code. Property Description: Home Depot, 5401 SPID, Lot 11, Block 1, Moore Plaza, and Builders Square, 5425 SPID, Lot 14, Block 3, Moore Plaza. Mr. Kendall stated that the variance request is based on Section 402.4.1 which requires unlimited area buildings of type-IV construction, such as Builders Square and Home Depot, be one story, fully sprinkled and surrounded on all sides by a permanent open space of not less than 60-feet. The permit application requests that the structure be allowed within the 60-foot clear zone. Mr.John Folan, owner of"Dogs on The Run," stated extensive reasons to grant the variance for both business locations. He also introduced several people for supportive statements. SCANNED P.O. The Board satisfactorily resolved additional issues: fire safety and access, immobility of the structures on a daily basis, and firewall requirements between structures. After extensive discussion, motion by Bill Braselton to grant the variances for both appeals with the provision that both structures remain within the eave overhangs of Builders Square and Home Depot and not infringe upon the 60-foot buffer zone. Second motion by Joe Fulton. Motion passed unanimously. NOTE: For detailed information on testimony, refer to the tape retained on file in the Building Inspection Division. Chairman Graham welcomed new board member Richard Dodson. Brief discussion regarding whether to adopt the 1997 Standard Building Code or wait for the International Code projected for issuance in 2000. Code Board of Appeals approve the following variance: Allow a small assembly (no working stage) to be placed in an existing type IV building with mezzanine and two upper floors. Only first floor and mezzanine shall be used at this time and NO access would be allowed to upper floors. Subject to the following conditions(i.e., install fire walls instead of sprinklers,etc.): 1) Protect columns, beams, floor /ceiling assemblies per Table 600, type II at first floor only. 2) Install fire alarm system per NFPA 72. Place smoke detectors at 2 & 3 levels. 3) Restrict access to 2nd and 3rd floors. 4) Should upper floors be developed in future, additional exit stairs and protection of Table 600 would be done at that time. For the following reasons (i.e., cost effectiveness, etc.): Existing building is over 50 years old and it would be cost prohibitive to incorporate 2nd & 3rd levels at this time. Since walls, columns, and floor structures are non-combustible, installing a fire alarm system to NFPA 72 standards, monitored, and protecting the columns, beams and floor/ceiling . assemblies per Table 600, will address life safety issues. Based on current regulation Mr. Do will lose a substantial amount of sitting area ADA requirements. An additional exit will remove more square footage from the kitchen and place undo expenses on Mr. Do. Current building conditions will not allow for such exits. Mr. Do will have to remove existing electrical panels and air conditioning units to meet this code requirement. Subject to the following conditions(i.e., install fire walls instead of sprinklers, etc.): Use the kitchen as a planned fire exit. The space in the kitchen proves amble room for emergency use if required. Mr. Do can add smoke detectors in the dining room area. For the following reasons(i.e., cost effectiveness, etc.): The cost of a second exit will place an expensive burden on Mr. Do with the loss of additional space will hamper the movement of kitchen activities. B96-17 BUILDING CODE OF BOARD OF APPEALS Page 2 of 2 Requesting that the Building Code Board of Appeals approve the following variance: Designate the tech dome space as a portion of the exit access corridor with a one-hour fire rating. (see attached drawing) Subject to the following conditions (i.e., install fire walls instead of sprinklers, etc.): This space will be supervised during all hours of the operation. Any threat to life safety will be immediately evident due to the openness of the space. The space will maintain the 1-hour envelope (walls and ceilings) identical to the exit access corridor it will open onto. For the following reasons, (i.e., cost effectiveness, etc.) Advanced technology is the pivotal character difference between the proposed Driscoll Middle School and prior CCISD middle schools. This space represents this difference visually and functionally. For this reason, the tech dome was placed at the entry of the building, much like the planetarium at King High School. To reinforce this concept, the district desires to open the space to students, staff and visitors alike, thereby, producing a constant visual statement of the schools unique character. The district believes this to be a critical element to the successful function of this particular school as an educational facility. I request a hearing before the Building Code Board of Appeals.
