Chairman Graham called the meeting to order at 1:30 p.m., in the Committee Room on the first floor of City
Hall.
The first item of business was the approval of the November 11, 1997 meeting minutes, Motion by Mr.
Braselton, second by Mr. Fulton, to approve the minutes as written. Motion passed unanimously.
Chairman Graham stated the appellant for Appeal No. B97-19 was not present so the Board would go to B97-
12.
APPEAL NO.B97-12
The public hearing was opened on Appeal No.B97-12. The appellant, David R. Richter,Richter Associates,
Architects, Inc., requested a variance to the Building Code to approve the compartment requirements for the Tower
II (for unsprinkled floors)be satisfied by considering the"core"as a compartment separated.
Property Description: Lots 10-A, 10-B, 10-C, Block 12, Bluff Portion, 555 N. Carancahua,Corpus Christi,
Texas.
Mr.Kendall stated that this appeal was a portion of an appeal the Board heard on August 15, 1997. He stated
that at that time the Board requested that the appellant and staff meet to discuss the clarification requests. Mr.Kendall
stated that they had met and resolved all of the items with the exception of number five which concerned the
compartmentation versus the sprinkler system on the floors that are not sprinkled in the building.
Mr.David Richter,Richter and Associates stated that this is the identical request that was presented in August.
He explained that the basis for item five was that the code that this building was built under considers
compartmentation an equal substitution for sprinkling,therefore sprinkling should be equal to compartmentation. He
stated that a portion of the building is compartmentalized and the remaining portion is fully sprinkled.
Mr. Kendall stated that the Legal Department felt the best way to resolve this is with a variance rather than
a clarification.

After a discussion, motion by Mr. Fulton, second by Mr. Barnett,the grant the appeal as submitted. Motion
passed unanimously.

Appeal No.B97-19
The public hearing was opened on Appeal No.97-19. The appellant,Arthur N. Sosa,Facilities Manager/City
Architect requested a variance to the Flood Hazard Prevention Code to approve the construction of a building below
the base flood elevation requirement.
Mr. Kendall stated that the Flood Hazard Prevention Code requires that he make note of Section 60-6 items
1-7 concerning the insurability of structures built below the base flood elevation requirement. He stated that the permit
was denied on the basis that the proposed building will be at grade level on the L-Head. He stated that it is a V-22 with
a 14 foot finish floor elevation requirement.
Mr. Art Sosa, Facilities Manager/City Architect stated that the City is designing the facility in-house. He
stated that he has been working closely with Malcolm Matthews, Director of Park& Recreation and their request is
to put this slightly above grade simply because the building's proposed use is more conducive to being at grade level.
He stated that people going to buy bait prefer not to walk up the ramp of stairs carrying an ice chest. He also stated
that restroom facilities will be serviced often and it will be more convenience from that standpoint. Mr. Sosa stated
that they also believe that this will be a substantially reduced amount of maintenance. He stated that the building is
owned by the City and wood frame construction with a finish level of 8 to 12 inches above the level of the asphalt.
After a discussion, motion by Mr. Fulton, second by Mr. Kramer to grant the appeal in the public interest,
convenience for the public and accessibility to the handicapped. Mr. Fulton then recommend approval of the appeal
subject to the City explaining fully to any tenant the insurance ramifications. Mr. Bennett seconded the amendment.
Motion and amendment passed unanimously.
