Chairman Miles Graham called the meeting to order at 1:30 p.m., in the Committee Room
on the first floor of City Hall.
The first item of business was the approval and correction of the previous meeting minutes,
Motion by Bill Braselton, second by Brian Barnett ,to approve the minutes as written.
Motion passed unanimously.
APPEAL NO. B98-02
The public hearing was opened on Appeal No.B98-02. The appellant Mr.Teti and
Mr. Craven, (the contractor) requesting a variance from the Building Code Appeals to
Section 1108.5.5 of the Building Code.
Property Description: 15373 Mutiny Court
Mr. Kendall stated that on 6/9/97 a permit was issued to construct dwelling at 15373 Mutiny
Court. The plans indicated handrail which were in compliance with the code, during
construction the design was changed.
Building Code Section(1108.5.5) requires that handrail alone open-sided stairs shall have
intermediate rails or an ornamental pattern such that a 6 inch diameter sphere cannot pass
through any of the openings.
Mr. Craven provided the Board members with as built drawing of the handrails installed in
the dwelling, he stated that the handrail design was changed for appearance.

The appellant stated that(Mr.Teti)is retired and they have no children or grandchildren that
would be in danger due to the design of the handrails. Mr. Fulton questioned the
discrepancies on the final design and plans approved, and if the City had been informed.
Mr. Craven stated it was an oversight on his behalf not informing the City.
Jay Reining stated that the violation would be a (liability) on the property owners. He also
stated that the appellants should be required to disclose the handrail variance to future home
owners. Jay Reining also mentioned that he would be requiring a"disclaimer" filed so that
future home buyers would be aware of the variance.
Miles Graham, Chairman stressed the importance of the public being made aware that the
handrail variance and requested that a copy of the minutes and an affidavit be filed on
property deed.
Mr. Craven agreed to file the affidavit with deed records and submit a copy to John Kendall,
Acting Building Official.
John Kendall requested that a copy of affidavit be submitted to the "lien holder".
After discussion, Mr. Fulton motion to grant the variance on handrail second by Bill
Braselton. Motion passed unanimously

There were no petitions from the audience.
Vice-Chairman Jerry Kramer motioned to adjourn the meeting and second by Bob Bennett.
