Hines, Secretary II The meeting was called to order by Pastor James at 1: 30 p.m. in the Council Chambers of City Hall. A quorum was present. Mr. Gorham opened the meeting by informing the board that therewere amendment made to the following addresses: 721-23-25 S. Alameda, 2709 Ayers, 405-10-10-12 Battlin Buc, 2822 Blake, 652 Cheyenne, 2818 Guadalupe, 1614 Morris, 2526 Nimitz, 621 S. Port, 9157 Scapular, 402 Scotland, 2925 Soledad and 718-22 10th Street. Mr. Gorham also stated the appropriate notices had been sent to the property owners and notices published in the newspaper. Presentations on each property were made by staff and slides showing the conditions of the properties were viewed. The following are summaries of actions taken by the Board on the respective properties: 1803 Peabody This residential structure is set on concrete piers that are not level. Wood sills are sagging. Windows are broken and window screens are either torn or missing. Exterior wood siding is cracked, broken and badly in need of paint. The front porch flooring is rotted and broken. Composition shingle roof cover is worn and deteriorated. The accessory structure at the rear of the property is set on concrete piers that are sunken and not level. Exterior wood siding is rotted, cracked and broken. Windows are broken and window screens are torn and/or missing. Exterior stairwell, leading to upstairs apartment unit, is rotted and broken. Composition shingle roof cover is worn and deteriorated. The structure is open and has been badly vandalized. STAFF RECOMMENDATION: Under the providions of Section 13-26 (G) , (1) , (a) of the City Housing code and due to the substandard and dilapidated condition of the structure, a hazard to the health, safety and welfare of the public is SCANNED henceforth declared. Therefore, the owner be required to start repairs or demolition on the primary residential structure within thirty (30) days. If repairs are started, an additional sixty (60) days be allowed to complete repairs to City Code Standards. If demolition is started an additional thirty (30) days be allowed to complete the demolition. If repairs or demolition are not started and completed as required, the City be authorized to demolish. Furthermore, under the provisions of Section 13-26 (G) , (1) , (c) of the City Housing Code and due to the intrinsic state of disrepair of the accessory structure, a hazard to the health, safety and welfare of the . public is henceforth declared. Therefore, the owner be required to demolish this structure within thirty (30) days. If demolition is started, an additional thirty (30) days be allowed to complete the demolition. If demolition on the accessory structure is not started and completed as required, the City be authorized to demolish. Mr. S. M. Cowling, was present and addressed the Board. Mr. Cowling indicated that he wants to repair the rear structure and that he will come before the board at a later date for board action on the rear structure. Mr. Ben Grande made a motion to amend the staff recommendation. On the front structure accept staff recommendation; on accessory structure Mr. Cowling board up and clean up around structure and bring it back to the next board hearing in April 1992; seconded by Bill Ewing,Jr. Motion passed unanimously. SUMMARY OF THE BOARD DECISION: Under the provisions of Section 13-26 (G) , (1) , (a) of the City Housing code and due to the substandard and dilapidated condition of the structure, a hazard to the health, safety and welfare of the public is henceforth declared. Therefore, the owner be required to start repairs or demolition on the primary residential structure within thirty (30) days. If repairs are started, an additional sixty (60) days be allowed to complete repairs to City Code Standards. If demolition is started an additional thirty (30) days be allowed to complete the demolition. If repairs or demolition are not startedand completed as required, the City be authorized to demolish. Furthermore, the owner be required to secure the rear accessory structure within thirty (30) days and appear before this board at their hearing, to be held in April 1992, for final disposition of this structure 2822 Blake This residential structure is set on concrete piers that are sunken and not level. Wood sills and floor joists are rotted, sagging and fire damaged. The siding consists of composition siding over wood siding. Exterior siding is missing and rear and side portion of structure was damaged by fire. The composition shingles roof cover was damaged by fire. All interior walls, studs, ceilings and floors were extensively damaged by fire. All bathroom and kitchen facilities were damaged by fire. The electrical system was damaged by fire. STAFF RECOMMENDATION Under the provisions of Section 13-26 (G) , (1) , (c) of the City Housing Code and due to the substandard and dilapidated condition of the structure, a hazard to the health, safety and welfare of the public is henceforth declared. Therefore, the owner be required to start demolition of the structure within thirty (30) days. If demolition is started, an additional thirty (30) days be allowed to complete the demolition. If demolition is not started and completed as required, the City be authorized to demolish. Ms. Cecily Carlock Mason was present and addressed the Board. Ms. Mason stated that she and her sister had gone to Legal Aid for assistance and had spoken to an attorney about this case. He advised them to try and resolve the issue of ownership by obtaining an Affidavit of Heirship. She was also advised by the fire department that the structure was heavily damaged by fire and demolition would be in order. She agreed with staff recommendation. Mr. Ben Grande made the motion to accept the staff recommendation, seconded by Mr. Anslinger. SUMMARY OF THE BOARD DECISION: Under the provisions of Section 13-26 (G) , (1) , (c) of the City Housing Code and due to the substandard and dilapidated condition of the structure, a hazard to the health, safety and welfare of the public is henceforth declared. Therefore, the owner be required to start demolition of the structure within thirty (30) days. If demolition is started, an additional thirty (30) days be allowed to complete the demolition. If demolition is not started and completed as required, the City be authorized to demolish. 2012 Mussett This residential structure is set on cedar piers that are sunken and not level. Wood sills and floor joists are sagging and rotted. Exterior wood siding is rotted and covered with asbestos tiles that are cracked, broken and/or missing. Front porch landing and steps are rotted and broken. Windows are broken and screens are either torn and/or missing. Roof cover is rotted and badly deteriorated. The floors are buckled and sagging throughout the structure. STAFF RECOMMENDATION: Under the provisions of Section 13-26 (G) , (1) , (c) of the City Housing Code and due to the substandard and intrinsic state of disrepair of the structure, .a hazard to the health, safety and welfare to the public is henceforth declared. Therefore, the owner be required to start demolition of the structure within thirty (30) days. If demolition is started, an additional thirty (30) days be allowed to complete the demolition. If demolition is not started and completed as required, the City be authorized to demolish. The owner, Mr. Rudy Alvarado, was present and addressed the Board. Mr. Alvarado is asking for more time as he has started demolition of the structure. Ben Grande made the motion to amend the staff recommendation by allowing the owner thirty (30) extra days to complete demolition, seconded by Mr. Ewing. Motion passed unanimously. If demolition is not started and completed as required, the City be authorized to demolish. 3733 Shore These two (2) residential structures are set on a cedar pier and cedar post foundation. Wood sills and floor joists are rotted, sagging, and over spanned. Exterior walls consist of stucco and plywood that are cracked, rotted, missing and badly in need of paint. Both structures are open to the elements. Roof consist of cedar and composition shingles that are rotted, worn and/or missing. Porch floors, supports, steps, stairways, railings and landings are either rotted, loose, and/or missing. Windows, window screens, frames, sills, sashes and panes are either rotted, broken and/or missing. Doors, screen doors and hardware are either rotted, broken and/or missing. Electrical and plumbing systems are disconnected and obsolete. An accessory structure used as a storage shed is set on the ground and not anchored. Walls and roof consist of corrugated metal that is loose, torn and rusted. STAFF RECOMMENDATION: Under the provision of Section 13-26 (G) , (1) , (c) of the City Housing Code and due to the substandard and intrinsic state of disrepair of all three (3) structures, a hazard to the health, safety and welfare of the public is henceforth declared. Therefore, the owner be required to start demolition of the structures within thirty (30) days. If demolition is started, an additional sixty (60) days be allowed to complete the demolition. If demolition is not started and completed as required, the City be authorized to demolish. The owner, Ms. Jeannette Walker, was present and addressed the Board. She claimed that one of the buildings falls under the grandfather clause,and that she is homesteading. She acknowledged that some of the windows are missing out of the old house and the accessory structure is falling down. The owner indicated she had a building permit from 1977 on the structure on stilts but that the structure has never been completed. She does not qualify for any of the loans, because of the area where she is living is not in a CDBG targeted area. Mr. Ben Grande made the motion to amend staff recommendation by allowing the owner thirty (30) extra days to complete demolition, seconded by Mr. Baker. Motion passed unanimously. SUMMARY OF THE BOARD DECISION: Under the provision of Section 13-26 (G) , (1) , (c) of the City Housing Code and due to the substandard and intrinsic state of disrepair of all three (3) structures, a hazard to the health, safety and welfare of thepublic is henceforth declared. Therefore, the owner be required to start demolition of the structures within thirty (30) days. If demolition is started, an additional ninety (90) days be allowed to complete the demolition. If demolition is not started and completed as required, the City be authorized to demolish. 433 Scotland This residential property is set on concrete piers. Wood sills and floor joists are rotted. Foundation is not properly vented. Roof consists of composition shingles that are worn, rotted and admitting moisture to interior of structure. Rear porch floor, supports, steps and landing are rotted, loose and/or missing. Windows, window frames, sills, sashes, and panes are either rotted, broken, and/or missing. Window screens are rotted or missing. Door, door screens, and hardware are either rotted, broken, torn, and/or missing. Interior floors, floor covering and wall cover are rotted, torn and/or missing throughout. Ceiling and ceiling covering are either torn, missing and water damaged throughout. Outlets, switches and light fixtures are broken and missing. Bathroom door and hardware are broken. Kitchen drain board, wall cabinets, faucets are broken. Accessory structure consists of a garage and apartment that is set on a concrete beam foundation. Wood sills are rotted. Porch and stairway, floor steps and railing are either rotted, broken and/or loose. Windows and window screens are either rotted broken and/or missing. Door & door screens are either broken or missing. Interior floor, floor covering, wall and ceiling covering are either torn and broken throughout. Light fixtures, switches and outlets are broken or missing. Kitchen drain board, wall. cabinets, sink and faucets are either broken or missing. STAFF RECOMMENDATION Under the provisions of Section 13-26 (G) , (1) , (a) of the City Housing Code and due to the substandard and dilapidated condition of the structure, a hazard to the health, safety and welfare of the public is henceforth declared. Therefore, the owner be required to start repairs or demolition within thirty (30) days. If repairs are started, an additional sixty (60) days be allowed to complete repairs to City Code Standards. If demolition is started, an additional thirty (30) days be allowed to complete the demolition. If repairs or demolition are not started and completed as required, the City be authorized to demolish. Mr. Carl Greer, the owner was present and addressed the Board. Mr. Greer stated that tenants had done much damage to his property and that he would like to obtain a permit to repair the structure. He would also like to be allowed at least 120 days to repair said structures so as to bring them up to current code. ' Mr. Leslie Baker made the motion to amend the staff recommendation by allowing the owner thirty (30) extra days to complete repairs, seconded by Mr. Anslinger. Motion passed unanimously. SUMMARY OF THE BOARD DECISION: Under the provisions of Section 13-26 (G) , (1) , (a) of the City Housing Code and due to the substandard and dilapidated condition of the structure, a hazard to the health, safety and welfare of the public is henceforth declared. If demolition is started, an additional thirty (30) days be allowed to complete the demolition. If repairs or demolition are not started and completed as required, the City be authorized to demolish. 1807 Comanche This residential structure is set on cedar piers and concrete pyramid piers along the front porch area. Piers are sunken and not level. Wood sills and floor joists are sagging and rotted. Exterior wood siding is rotted, cracked and broken. Windows are broken and screens are either torn and/or missing. Wood shingle roof cover is rotted and covered with composition shingles that are badly deteriorated. Roof rafters are sagging and rotted at the eaves. STAFF RECOMMENDATION: Under the provisions of Section 13-26 (G) , (1) , (a) of the City Housing code and due to the substandard and dilapidated condition of the structure, a hazard to the health, safety and welfare of the public is henceforth declared. Therefore, the owner be required to start repairs or demolition within thirty (30) days. If repairs are started, an additional sixty (60) days be allowed to complete repairs to City Code Standards. If demolition is started, an additional thirty (30) days be allowed to complete the demolition. If repairs or demolition are not started and completed as required, the City be authorized to demolish. The owner, Mr. Pedro Capelo, was present and addressed the board. The owner is in agreement with the staff recommendation. Mr. Rivera stated that the Capelo's had been in the office and were told that the house is over 50% deteriorated and they would have meet minimum standard code. Mr. Baker made the motion to accept staff recommendation, seconded by Mr. Grande. Motion passed unanimously. Floor joists and wood sills are rotted, sagging and over spanned. Exterior walls consists of stucco that is cracked. Roof consists of composition shingles that are rotted, worn and there is evidence of roof admitting moisture to interior of structure. Window & window screens are either rotted, torn and/or missing. Doors & door screens are either rotted, broken and/or missing. Floors, floor covering, wall cover and ceiling cover are either rotted, torn and/or missing throughout. Light fixtures, switches, and outlets are broken or missing. Bathroom door and hardware are broken or missing. STAFF RECOMMENDATION Under the provisions of Section 13-26 (G) , (1) , (a) of the City Housing Code and due to the substandard and dilapidated condition of the structure, a hazard to the health, safety and welfare of the public is henceforth declared. Therefore, the owner be required to start repairs or demolition within thirty (30) days. If repairs are started, an additional sixty (60) days be allowed to complete repairs to City Code Standards. If demolition is started, an additional thirty (30) days be allowed to complete the demolition. If repairs or demolition are not started and completed as required, the City be authorized to demolish. The owner, Mr. Wallace Hattery, was present and addressed the board. Mr. Hattery stated that this property falls under the grandfather clause. He would like to repair the structure and live in the house. The owner asked for additional time to accomplish the repairs. Mr. Bill Ewing made the motion to amend the staff recommendation by allowing the owner thirty (30) extra days to complete repairs, seconded by Mr. Anslinger. Motion passed unanimously. If repairs or demolition are not started and completed as required, the City be authorized to demolish. 2925 Soledad This accessory structure used as a garage apartment is set on a concrete slab foundation. All perimeter wood sills are rotted. Exterior wood siding is rotted, buckled, and missing. The structure is also badly in need of paint. The roof consists of composition shingles which are rotted, worn, missing and loose. The rafters are also rotted, sagging, broken and missing. Eaves are also rotted. The electrical is not completely installed and is inadequate. The interior of the structure has never been completely finished. Floors and floor joists are rotted. This structure has no interior walls throughout the building. There is no ceiling cover. The bathroom is missing all fixtures. STAFF RECOMMENDATION Under the provisions of Section 13-26 (G) , (1) , (c) of the City Housing Code and due to the substandard and dilapidated condition of the structure, a hazard to the health, safety and welfare of the public is henceforth declared. Therefore, the owner be required to start demolition of the structure within thirty (30) days. If demolition is started, an additional thirty (30) days be allowed to complete the demolition. If demolition is not started and completed as required, the City be authorized to demolish. The owner, Mr. Charles Smoots, was present and addressed the Board. Mr. Smoots stated he has no quarrel with the staff recommendation. He would like to have ninety (90) days to demolish. Mr. Gorham also suggested to Mr. Smoots that he might want to visit our office and apply for a grant to demolish the structure. Mr. Bill Ewing made the motion to accept the staff recommendation, seconded by Mr. Anslinger. Motion passed unanimously. If demolition is not started and completed as required, the City be authorized to demolish. 1010 N. Alameda This residential structure is set on a concrete pier foundation. Exterior wood siding is rotted, cracked and broken. Windows are broken and window screens are torn and have been boarded up. Structure is vacant and the plumbing and electrical systems are disconnected. STAFF RECOMMENDATION: Under the provisions of Section 13-26 (G) , (1) , (a) of the City Housing Code and due to the substandard and dilapidated condition of the structure, a hazard to the health, safety and welfare of the public is henceforth declared. Therefore, the owner be required to start repairs or demolition within sixty (60) days. If repairs are started an additional sixty (60) days be allowed to complete repairs to City Code Standards. If demolition is started an additional thirty (30) days be allowed to complete demolition. If repairs or demolition are not started and completed as required, the City be authorized to demolish. The owner, Ms. Rosa Gonzales, was present and addressed the Board. Ms. Gonzales stated that she has placed a new roof and foundation on the structure. She has two other structures that are being demolished and the city is working with her on them. Mr. Ben Grande made the motion to accept the staff recommendation, seconded by Mr. Baker. Motion passed unanimously. SUMMARY OF THE BOARD DECISION: Under the provisions of Section 13-26 (G) , (1) , (a) of the City Housing Code and due to the substandard and dilapidated condition of the structure, a hazard to the health, safety and welfare of the public is henceforth declared. Therefore, the owner be required to start repairs or demolition within sixty (60) days. If repairs are started an additional sixty (60) days be allowed to complete repairs to City Code Standards. If demolition is started an additional thirty (30) days be allowed to complete demolition. If repairs or demolition are not started and completed as required, the City be authorized to demolish. 2709 Ayers This commercial structure is set on concrete piers that are not level, sunken and cracked. The structure was involved in a recent fire and a large percentage of all wood sills and floor joists were destroyed. The exterior wood siding sustained much damage. The roof which was consisted of composition shingles, was destroyed by fire. All interior of the structure sustained extensive fire, smoke, and water damage. The electrical system was destroyed. STAFF RECOMMENDATION Under the provisions of Section 13-26 (G) , (1) , (c) of the City Housing Code and due to the substandard and dilapidated condition of the structure, a hazard to the health, safety and welfare of the public is henceforth declared. Therefore, the owner be required to start demolition of the structure within thirty (30) days. If demolition is started, an additional thirty (30) days be allowed to complete the demolition. If demolition is not started and completed as required, the City be authorized to demolish. Mr. Adan Martinez, attorney for Mr. Ray Madrigal was present and addressed the Board. This structure was involved in a recent fire and Mr. Madrigal is involved in an on-going court case as a result of the fire. Mr. Martinez would like sixty (60) days to allow court action to be completed. Ben Grande made the motion to accept the staff recommendation, seconded by Mr. Ewing. Motion passed unanimously. If demolition is not started and completed as required, the City be authorized to demolish. 1614 Morris (rear) This residential structure is set on concrete piers that are not level. Floor joists and wood sills are rotted and sagging. Exterior wood siding is rotted, loose and is badly in need of paint. Windows are broken and frames are rotted and hardware missing. The roll-roofing over wood shingle roof is rotted, torn and eaves are rotted. Roof rafters are sagging and ridge is loose. The plumbing and electrical systems are inadequate and obsolete. STAFF RECOMMENDATION: Under the provisions of Section 13-26 (G) , (1) , (c) of the City Housing Code and due to the substandard and dilapidated conditions of the structure, a hazard to the health, safety and welfare of the public is henceforth declared. Therefore, the owner be required to start demolition of the structure within thirty (30) days. If demolition is started, an additional thirty (30) days be allowed to complete the demolition. If demolition is not started and completed as required, the City be authorized to demolish. The owner, John Yunker, was present and addressed the Board. Mr. Yunker stated that he had just acquired this property and asked for ninety (90) days to allow repairs to be made. He indicated that he has initiated repairs on the units at the front of the property and if allowed would repair this structure to meet current codes. Mr. Ben Grande made motion to amend staff recommendation and allow the, owner the opportunity to repair the structure, seconded by Mr. Ewing. Motion passed unanimously. SUMMARY OF THE BOARD DECISION: Under the provisions of Section 13-26 (G) , (1) , (a) of the City Housing Code and due to the substandard and dilapidated condition of the structure, a hazard to the health, safety and welfare of the public is henceforth declared. If demolition is started, an additional thirty (30) days be allowed to complete the demolition. If repairs or demolition are not started and completed as required, the City be authorized to demolish. 819 Utica This residential structure is set on concrete piers. Floor joists and wood sills are rotted and over spanned. Exterior walls consists of wood siding that is rotted and badly in need of paint and open to the elements. Roof consists of composition shingles thatare worn and deteriorated. Porch floor, supports,steps, railings, and landings are either rotted,loose, or missing. Window frames, sills, sashes, and panes are either rotted; torn, and/or missing. Doors and hardware are either broken, rotted or missing. Interior floor, floor covering, wall covering and ceiling covering are rotted, broken, and/or missing throughout. Light fixtures, switches, outlets are broken or missing. Shower stall and bathroom doors are broken. STAFF RECOMMENDATION Under the provisions of Section 13-26 (G) , (1) , (a) of the City Housing Code and due to the substandard and dilapidated condition of the structure, a hazard to the health, safety and welfare of the public is henceforth declared. Therefore, the owner be required to start repairs or demolition within thirty (30) days. If repairs are started, an additional sixty (60) days be allowed to complete repairs to City Code Standards. If demolition is started, an additional thirty (30) days be allowed to complete the demolition. If repairs or demolition are not started and completed as required, the City be authorized to demolish. The owner, Mrs. Faustino Lucio & daughter, was present and addressed the Board. Mrs. Lucio has initiated some of the repairs but is asking for an extension of ninety (90) days to complete repairs. Mr. Ben Grande made the motion to accept the staff recommendation, seconded by Mr. Anslinger. Motion passed unanimously. Exterior brick is cracked and broken. Window are broken and screens missing. Window frames and sills are rotted. Door on 1st floor has holes and is broken. Interior floor covering is torn or missing.
