Hines, Secretary II The meeting was called to order by Pastor Walter James, Chairman at 1: 30 p.m. in the Council Chambers of City Hall. A quorum was present. The meeting was opened by informing those present that the appropriate notices had been sent to the property owners and notices published in the newspaper. A slide presentation showing the condition of each property was conducted by staff. The following are summaries of action taken by the Board on the respective properties. 321 Mirror This residential structure is set on a beam foundation that is not vented. Sills and. joists are rotted. Exterior walls consists of combination wood and stucco siding. Roof consists of composition shingles. Roof rafters are sagging. Porch landings are missing. Window unit and window screens are rotted, broken and/or missing. Floor, sub-flooring, wall covering and ceiling covering are rotted, torn and/or water-damaged. Light fixtures are broken and missing. Bathroom is severely water-damaged. Kitchen drainboard and cabinets are rotted and/or missing. Plumbing and electrical systems are in disrepair. Accessory structure - garage Consists of a garage. Tin roof and rotted plywood walls. Concrete slab is cracked. STAFF RECOMMENDATION Under the provisions of Section 13-26 (G) , (1) , (a) of the City Housing Code and due to the substandard and dilapidated condition of the structure, a hazard to the health, safety and welfare of the public is henceforth declared. Therefore the owner be required to start repairs or demolition within thirty (30) days. If repairs are started, an additional sixty (60) days be allowed to complete repairs to City Code Standards. If demolition is started, an additional thirty (30) days be allowed to complete the demolition. If repairs or demolition are not started and completed as required, the City be authorized to demolish. SCANNED Mr. Michael Ogden, the owner, was present and addressed the board. Mr. Ogden stated that he had tried to obtain a building permit but had been denied. Staff explained that since the structure was over 50% deteriorated he would have to also provide a foundation plan before a permit would be issued. He stated that he had several contractors advise him that the structure was repairable and would like the opportunity to do so. City staff questioned Mr. Ogden about an accessory structure used as a detached garage. He stated that he would agree to demolish it but would need ample time to do so. Mr. Ewing made the motion to amend staff recommendation by allowing, the owner to prepare a foundation plan in order to obtain a building permit, demolish an accessory structure used as a detached garage, and start repairs or demolition on the primary structure within thirty (30) days. If repairs are started, an additional ninety (90) days be allowed to complete repairs to City Code Standards, seconded by Mr. Grande. Motion passed unanimously. SUMMARY OF THE BOARD DECISION: Under the provisions of Section 13-26, (G) , (1) , (a) of the City Housing Code and due to the substandard and dilapidated condition of the structure, a hazard to the health, safety and welfare of the public is henceforth declared. Therefore the owner be allowed to prepare a foundation plan in order to obtain a building permit, demolish an accessory structure used a detached garage, and start repairs or demolition on the primary structure within thirty (30) days. If repairs are started, an additional ninety (90) days be allowed to complete repairs to City Code Standards. If demolition is started, an additional thirty (30) days be allowed to complete the demolition. If repairs or demolition are not started and complete as required, the . City be authorized to demolish. 2917 Sunrise This residential structure is set on concrete piers that are sunken. Floor joists and sills are rotted. Roof consists of composition shingles which are worn. Windows are broken and screens missing. Porch steps are rotted and broken. Floor, wall and ceiling covers are either broken, torn and/or missing throughout. Kitchen sink and faucets are missing. Bathroom lavatory and hot water heater are missing. Interior has been vandalized throughout. Electrical and plumbing systems are obsolete. STAFF RECOMMENDATION Under the provision of Section 13-26 (G) , (1) , (a) of the City Housing Code and due to the substandard and dilapidated condition of the structure, a hazard to the health, safety and welfare of the public is henceforth declared. Therefore the owner be required to start repairs or demolition within thirty (30) days. If repairs are started, an additional sixty (60) days be allowed to complete repairs to City Code Standards. If demolition is started, an additional thirty (30) days be allowed to complete the demolition. If repairs or demolition are not started and completed as required, the City be authorized to demolish. Mr. Robert W. Hurst, the owner was present and addressed the Board. Mr. Hurst stated at the time this house was built he had a partner and everything was up to code. Mr. Hurst stated every time he received a letter from the city he forwarded a copy to his absentee partner. After the last notification was sent regarding the recommendation, the partner decided to quit claim his half of the property to him. He is asking that the board allow him ninety (90) days to start repairs instead of the thirty days recommended by staff. Mr. Grande made the motion to accept staff recommendation with the exception that the owner be required to start repairs or demolition within ninety (90) days and secure the property within seven (7) days, seconded by Mr. Anslinger. All four buildings are set on concrete piers that are sunken and not level. Wood sills and floor joists are rotted and sagging. Exterior wood siding is loose, rotted and badly in need of paint. Windows are broken and screens are either torn or missing. Porch floor and supports are rotted and steps missing. Doors and door screens are either broken and/or missing throughout. Floors, floor coverings, walls and ceiling coverings are either broken, rotted, torn and/or missing throughout. Roofs consist of composition shingles that are worn and deteriorated. These four buildings have all been badly vandalized. STAFF RECOMMENDATION Under the provisions of Section 13-26 (G) , (1) , (c) of the City Housing Code and due to the substandard and intrinsic state of disrepair of the structure, a hazard to the health, safety and welfare of the public is henceforth declared. Therefore the owner be required to demolish the structure within thirty (30) days. If the demolition is started, an additional thirty (30) days be allowed to complete the demolition. If demolition is not started and completed as required, the City be authorized to demolish. Mr. John Campbell, the owner, was present and addressed the board. Staff stated that these structures had previously been presented to the Board for repairs at another hearing. Mr. Campbell stated that his main purpose was to repair these structures and prevent their demolition. He also, stated that if allowed, he would immediately secure the structures to prevent further vandalism. Furthermore, he plans to initiate repairs on . two structures at a time and bring them up to City Code Specifications. Mr. Campbell is asking the board to allow him to immediately board up the structures and thirty (30) days to draw up plans and obtain the proper permits for repairs. After the initial permits are obtained, Mr. Campbell is asking for one hundred eighty (180) days allowing him ample time to perform all repairs. Mr. Grande made the motion to amend staff recommendation by allowing owner to start repairs and/or demolition within thirty (30) days and allow him one hundred eighty (180) days to complete the work and board up all four (4) structures within seven (7) days, seconded by Mr. Ewing. Motion passed unanimously. SUMMARY OF THE BOARD DECISION: Under the provisions of Section 13-26 (G) , (1) , (a) of the City Housing Code and due to the substandard and intrinsic state of disrepair of the structures, a hazard to the health, safety and welfare of the public is henceforth declared. Therefore, the owner be allowed to immediately board up all four to prevent any further vandalism. Prepare proper plans and obtain the required building permits within thirty (30) days. If repairs are started, an additional one hundred eighty (180) days be allowed to complete repairs to City Code Standards. If demolition is started, an additional thirty (30) days be allowed to complete the demolition. If repairs or demolition are not started and completed as required, the City be authorized to demolish. 1656-18th Street This occupied structure is set on concrete pier foundation. Windows are missing. Front and rear door broken. Interior ceiling covers are missing. Plumbing and electrical are inadequate. STAFF RECOMMENDATION Under the provisions of Section 13-26 (G) , (1) , (a) of the City Housing Code and due to the substandard and dilapidated condition of the structure, a hazard to the health, safety and welfare of the public is henceforth declared. Therefore the owner be required to start repairs or demolition within thirty (30) days. If repairs are started, an additional sixty (60) days be allowed to complete repairs to City Code Standards. If demolition is started, an additional thirty (30) days be allowed to complete the demolition. If repairs or demolition are not started and, completed as required, the City be authorized to demolish. The tenant, Annabel Perkins was present and addressed the Board. Mrs. Perkins mentioned to the board that several things needed to be fixed in the building such as the electrical cords, smoke detectors, a few windows, etc. The Board received a letter from the property owner, Mr. Peter Siracusa stating that he had started some of the repairs. Mr. Rivera also advised the tenant that if the owner does not follow through with the repairs the city staff would file charges in Municipal Court. Mr. Anslinger made the motion to accept staff recommendation, seconded by Ms. Cuellar. Motion passed unanimously. If repairs or demolition are not started and completed as required, the City be authorized to demolish. 3139 Millbrook This residential property is set on a concrete slab foundation. Exterior walls consists of brick veneer and wood siding. Roof consists of composition shingles. The structure has been involved in a fire which has damaged the entire structure. STAFF RECOMMENDATION Under the provisions of Section 13-26 (G) , (1) , (c) of the City Housing Code and due to the substandard and intrinsic state of disrepair of the structure, a hazard to the health, safety and welfare of the public is henceforth declared. Therefore the owner be required to demolish the structure within thirty (30) days. If the demolition is started, an additional thirty (30) days be allowed to complete the demolition. If demolition is not started and completed as required, the City be authorized to demolish. Mr. Steven Lee Switzer, the owner was present and addressed the board. Mr. Switzer stated that he was debating whether to repair or demolish the structure. He said he would like the opportunity to repair the structure if feasible and if not demolish the structure. Mr. Switzer said he has a bid of $20. 000. 00 for demolition of the structure from a local. He is asking the board for an extra sixty (60) days to consider his options and move forward. He also stated that he will try to sell this property by advertising in the local newspaper. Ms. Cueller made the motion to amend the staff recommendation so the owner be required to start repairs or demolition within thirty (30) days. If repairs are started, an additional ninety (90) days be allowed to complete the repairs to City Code Standards, seconded by Mr. Grande. Motion passed unanimously. If repairs or demolition are not started and completed as required, the City be authorized to demolish. 1400 Comanche This commercial structure is set on a concrete slab foundation that is cracked. This structure which at one time served as. a service station, is built of wood covered with stucco. Wood walls are rotted and the stucco veneer is cracked andbrokenthroughout. Windows and doors are broken. The electrical and plumbing systems are obsolete and fixtures are broken. The built-up roof is rotted and a large portion of the roof has since caved in. The interior stucco walls are also cracked and broken and the structure has been badly vandalized. STAFF RECOMMENDATION Under the provisions of Section 13-26 (G) , (1) , (c) of the City Housing Code and due to the substandard and intrinsic state of disrepair of the structure, a hazard to the health, safety and welfare of the public is henceforth declared. Therefore the owner be required to demolish the structure within thirty (30) days. If the demolition is started, an additional thirty (30) days be allowed to complete the demolition. If demolition is not started and completed as required, the City be authorized to demolish. Mr. Gerald Benavides, son and Executor of the deceased owner of record, was present and addressed the board. Mr. Benavides stated that the Estate does not have any funds available for repairs or demolition. He stated that he has tried to keep the structure secured but vandals and transients keep breaking into the structure. He further stated that he has tried to donate the structure to a charity but had no success. Ms. Cuellar made the motion to amend the staff recommendation that the owner be allowed sixty (60) days in which to commence demolition of the structure, seconded by Mr. Anslinger. SUMMARY OF THE BOARD DECISION: Under the provisions of Section 13-26 (G) , (1) , (c) of the City Housing Code and due to the substandard and intrinsic state of disrepair of the structure, a hazard to the health, safety and welfare of the public is henceforth declared. Therefore the owner be required to demolish the structure within sixty (60) days. If the demolition is started, an additional thirty (30) days be allowed to complete the demolition. If demolition is not started and completed as required, the City be authorized to demolish. 1606 Amber This multi-unit structure is set on concrete piers. Exterior walls consist of asbestos shingles that are cracked, broken and badly in need of paint. Roof consists of built-up materials. Porches, stairways, railings & landings are either rotted, loose and/or missing. Window units and screens are rotted, broken, and/or missing. Interior floors, floor coverings, wall coverings, wall coverings and ceiling coverings are rotted, torn and/or missing. Electrical outlets, switches, and light fixtures are broken and/or missing. Plumbing and electrical systems are disconnected. STAFF RECOMMENDATION Under the provisions of Section 13-26 (G) , (1) , (a) of the City Housing Code and due to the substandard and dilapidated condition of the • structure, a hazard to the health, safety and welfare of the public is henceforth declared. Therefore the owner be required to start repairs or demolition within thirty (30) days. If repairs are started, an additional sixty (60) days be allowed to complete repairs to City Code Standards. If demolition is started, an additional thirty (30) days be allowed to complete the demolition. If repairs or demolition are not started and completed as required, the City be authorized to demolish. Mr. Michael Sheehan, owner, was present and addressed the board. The repairs on this property were started last May. During the year 1992 $17,500 was spent on fixing this property. He would like ninety (90) to one hundred twenty (120) days to complete everything. He felt the only thing the city was concerned about was the outside of the structure and he has been working on the interior. Mr. Grande made the motion to accept staff recommendation, seconded by Ms. Cuellar. Motion passed unanimously. The sills are rotted. Exterior wood siding is loose, rotted, broken and badly in need of paint. Rear porch floor, steps, railings are rotted, loose, broken and missing. Windows are broken and screens either torn and/or missing. Front and rear doors are broken and screens missing. Composition shingles are worn and eaves rotted. Interior wall and ceiling covers are torn, and is badly in need of paint. Interior has been badly vandalized. STAFF RECOMMENDATION Under the provisions of Section 13-26 (G) , (1) , (a) of the City Housing Code and due to the substandard and dilapidated condition of the structure, a hazard to the health, safety and welfare of the public is henceforth declared. Therefore the owner be required to start repairs or demolition within thirty (30) days. If repairs are started, an additional sixty (60) days be allowed to complete repairs to City Code Standards. If demolition is started, an additional thirty (30) days be allowed to complete the demolition. If repairs or demolition are not started and completed as required, the City be authorized to demolish. Mr. Mike Sheehan, lawyer was present and addressed the Board for Mr. Steve Burkett the owner. He noted that Mr. Burkett is asking for sixty (60) days to repair and/or to apply for demolition permit and (120) days to complete the repairs and/or demolition. Mr. Ewing made a motion to accept staff recommendation and there was no second. Mr. Anslinger made the motion to amend staff recommendation to start repairs or demolition within sixty (60) days. If repairs are started, an additional sixty (60) days be allowed to complete repairs to City Code Standards, seconded by Mr. Grande. Motion passed unanimously. Floor framing is burned, rotted, broken and/or missing. Exterior walls consists of brick veneer. Roof consists of built-up materials. The majority of it is fire damaged or has collapsed. Roof rafters and beams are broken, missing and/or fire damaged. Door and window units are either broken or missing. Walls and ceilings are either broken, missing, rotted or fire-damaged. Plumbing and electrical systems are disconnected and obsolete. STAFF RECOMMENDATION Under the provisions of Section 13-26 (G) , (1) , (c) of the City Housing Code and due to the substandard and intrinsic state of disrepair of the structure, a hazard to the health, safety and welfare of the public is henceforth declared. Therefore the owner be required to demolish the structure within thirty (30) days. If the demolition is started, an additional thirty (30) days be allowed to complete the demolition. If demolition is not started and completed as required, the City be authorized to demolish. Mrs. Louise Vickers, the owner, was present and addressed the Board. Mrs. Vickers gave a summary about the case concerning this structure. She stated that she has previously been before this Board, the Planning Commission and the City Council. This building was purchased from the school system many years ago and a proposal from rezoning was denied by the City. Mrs. Vickers had plans to build several small homes on this . property but the project was never consummated. Mr. Rivera stated that this same case was brought before this board in 1988 and the nuisance has not be abated. Mrs. Vickers mentioned an engineers report stated that something be resolved at this hearing. Mrs. Vickers is asking for ten (10) months to resolve this matter. Mr. Grande made the motion to amend the staff recommendation to allow the owner to immediately clean out the structure, board it up and secure it by erecting a fence around the entire building. In addition, the owner must apply for a re-zoning of the property and make available to this board a progress report consisting of quarterly updates as to the • ongoing improvements on the structure bringing it into substantial compliance within a maximum of one year. SUMMARY OF THE BOARD DECISION: Under the provisions of Section (G) , (1) , (a) of the City Housing Code and due to the substandard and dilapidated condition of the structue, a hazard to the health, safety and welfare of the public is henceforth declared. Therefore, the owner be allowed thirty (3 0) days to clean out the structure, board up the structure and secure it by erecting a fence around the entire building. In addition, the owner must apply for a re-zoning of the property and make available to this board a progress report consisting of quarterly updates as to the ongoing improvements on the structure bringing it into substantial compliance within a maximum of one year. 1223 Ocean Drive This residential two-story duplex is set on concrete piers that are sunken. Small portion of exterior wood siding is missing. Window screen is torn. Rear steps are rotted and loose. Composition shingles are worn. Water heater is not properly vented. Accessory Structure - Carport This accessory structure is used as a carport. The flat roof is rotted with holes throughout the roof area. Exterior wood-siding is rotted, buckled and leaning. The structure is badly deteriorated. STAFF RECOMMENDATION Under the provisions of Section 13-26 (G) , (1) , (a) of the City Housing Code and due to the substandard and dilapidated condition of the structure, a hazard to the health, safety and welfare of the public is henceforth declared. Therefore the owner be required to start repairs or demolition within thirty (30) days. If repairs are started, an additional sixty (60) days be allowed to complete repairs to City Code Standards. If demolition is started, an additional thirty (30) days be allowed to complete the demolition. If repairs or demolition are not started and completed as required, the City be authorized to demolish. The city staff received a letter from Mr. Tony Bonilla along with a copy of a demolition permit obtain from the City Inspection Department. The owner is in progress of demolishing the property. Mr. Anslinger made the motion to accept staff recommendation, seconded by Ms. Cuellar. Motion passed unanimously. The floor joists and sills are rotted. Storage area downstairs has holes and rotted floor. Exterior stucco and wood siding is loose, rotted,- missing and badly in need of paint. Small roof area over porch entrance is sagging and rotted. Porch floor, supports and railings are loose and rotted. Windows are broken and screens torn. Rear door is broken, wood sills are rotted and the hardware is missing on the doors. Interior floors, wall and ceiling covers are cracked with holes throughout the ceiling area. The plumbing and electrical systems are obsolete. STAFF RECOMMENDATION Under the provisions of Section 13-26 (G) , (1) , (a) of the City Housing Code and due to the substandard and dilapidated condition of the structure, a hazard to the health, safety and welfare of the public is henceforth declared. Therefore the owner be required to start repairs or demolition within thirty (30) days. If repairs arestarted, an additional sixty (60) days be allowed to complete repairs to City Code Standards. If demolition is started, an additional thirty (30) days be allowed to complete the demolition. If repairs or demolition are not started and completed as required, the City be authorized to demolish. The city staff received a letter from Mr. Tony Bonilla along with a copy of a demolition permit obtain from the City Inspection Department. The owner is in progress of demolishing the property.. STAFF RECOMMENDATION Under the provisions of Section 13-26 (G) , (1) , (c) of the City Housing Code and due to the substandard and intrinsic state of disrepairof the structure, a hazard to the health, safety and welfare of the public is henceforth declared. Therefore the owner be required to demolish the structure within thirty (30) days. If the demolition is started, an additional thirty (30) days be allowed to complete the demolition. If demolition is not started and completed as required, the City be authorized to demolish. The city staff received a letter from Mr. John J. Mitchell, who is one of the heirs of the property is asking for (120) days to complete the repairs. Ms. Cuellar made the motion to amend the staff recommendation to allow the heir to start repairs or demolition within sixty (60) days. If repairs are started, an additional sixty (60) days to complete the repairs to City Code Standards, seconded by Mr. Ewing.
