The Commissioners approved the December 21, 2009 minutes as amended with a request by Ms. Sellers to include addressing Mr. Di Carlo's complaint regarding Time Warner and her request to have Time Warner present at the Cable Commission meeting. 2010 COMMISSION CALENDAR A revised calendar was given to the Commissioners in response to the request to reschedule meetings to account for Martin Luther King Day and an evening meeting in December.No action was taken. 2009 ANNUAL REPORT Staff provided the Commission with a copy of the 2009 Annual Report for the Cable Commission. It included highlights of the year including passage of the newest version of the Rules &Procedures. REVIEW AND POSSIBLE ACTION REGARDING VIOLATION APPEALS In the month of January,28 violations were submitted to the Cable Commission for review. 17 Producers were present and/or represented regarding violations. Each producer or representative appears below with action noted regarding the violation. At one point, an audience member had a sign while sitting in council chambers. Ms. Moon asked for it to be removed. Staff did note an ordinance requiring removal of signs in council chambers when in session. Luis Torres, Jr. (Iglesia De Cristo) Ms. Moon motioned, Mr. West seconded, all were in favor except for a no vote from Ms. Sellers.Violation was issued. James Marcus (Flour Bluff Church of Christ #1) Ms. Moon motioned, Mr. West seconded, all were in favor except for a no vote from Ms. Sellers.Violation was issued. Dr. Victor Frazier(Flour Bluff Church of Christ#2)Ms. Moon motioned,Mr. West seconded, all were in favor except for a no vote from Ms. Sellers.Violation was issued. John Maul represented the Summit programming. Both shows were shown regarding the violation in question. After watching the video, it was determined that both shows were in compliance. SCANNED Bonnie Fehlauer (Summit AM) Ms. Moon motioned to dismiss the violation, Mr. West seconded all were in favor.No violation was issued. Hernan Ramirez (Summit ES) Ms. Moon motioned to dismiss the violation, Mr. West seconded all were in favor.No violation was issued. Bernice McMillian (Divine Revelations) Ms. Moon motioned, Mr. West seconded, all were in favor except for a no vote from Ms. Sellers.Violation was issued. Josh Salinas represented the following and noted the group has some technical problems that have been corrected. Alex Martinez (Tabernacle of Praise-Wednesday) Ms. Moon motioned, Mr. West seconded, all were in favor except for a no vote from Ms. Sellers. Violation was issued. Monica Salinas (Tabernacle of Praise —AM) Ms. Moon motioned, Mr. West seconded, all were in favor with the exception of Ms. Sellers with a no vote.Violation was issued. Susan Booker (Half Hour Deliverance) Ms. Moon motioned, Mr. West seconded, all were in favor with the exception of Ms. Sellers with a no vote. Violation was issued. Jesse Nesmith represented Becky Nesmith. Becky Nesmith (Family Harvest-Wednesday)Ms. Moon motioned, Mr. West seconded, all were in favor with the exception of Ms. Sellers with a no vote.Violation was issued. Lively discussion occurred regarding the violation of Ms. Susan Booker in which staff asked city hall security to step into the meeting.Ms. Booker sited her feeling of discrimination regarding her violation and had issues with Mr. Gordy policing the public access channel. Ms. Sellers pointed out than anyone, including Ms. Booker, had the right to appeal the Commission's decision to the City Council. *Requested Addition(Ms. Seller on 2/15/10 after minutes were officially approved) During some of the violation discussions, especially during those Ms. Sellers voted "no", she felt that a warning should have been given instead of a violation by the Cable Communication Commission. She also felt it was wrong that Mr. Gordy turned in Ms. Booker's DVD instead of the producer. REVIEW AND POSSIBLE ACTION REGARDING COPY RIGHT LAW AND MEMORANDUM CONCERNING COMMERICAL PRODUCTS AND SERVICES A brief update was given regarding the subcommittee work and recommendations would be coming to the full commission in the coming months regarding both copyright and advertising guidelines. REVIEW AND POSSIBLE ACTION REGARDING CABLE OPERATOR COMPLAINTS Both Mr. Gordy and Mr. Nesmith commented about Time Warner's lack of response regarding programming errors. No cable operator representative was in attendance at the meeting. Staff did note that some internal Time Warner meetings were occurring with hopes of pursuing additional options of compliance by the cable operator. REVIEW AND POSSIBLE ACTION REGARDING MEDIA DELIVERY LOGS All was well with the media logs PAUG UPDATES Channel 10: Mr. Gordy briefly discussed the producer training and noted that very few producers showed up for the training. Channel 18: Mr.Nesmith said that overall everything was going well with the producers. PUBLIC COMMENT None ITEMS FOR NEXT MEETING Request for Time Warner to attend meeting. ADJOURNMENT OF MEETING Mr. West moved that the meeting be adjourned. Commission agreed and the meeting adjourned at 7:13 p.m.
