The Commissioners approved the January 25,2010 minutes as presented. REVIEW AND POSSIBLE ACTION REGARDING VIOLATION APPEALS In the month of February,there were 16 violations including 12 from January in which producers identified with violations failed to appear. Various producers were present and/or represented regarding violations. Each producer or representative appears below with action noted regarding the violation. Sylvia Dancer(Sylvia D. Show) Ms. Dancer respectively disagreed that the show did not include advertising. The DVD was present and the Commission watch the segment in which a violation was alleged. After discussion Ms. Moon motioned, Ms. Sellers seconded. Violation was issued. Ms. Sellers did note that Mr. Gordy failed to return programming to producers in order to bring to the Commission meeting. Dan Fields (Westhaven Baptist Church)Mr. Fields respectively agreed with the violation but was concerned about the amount of money spent to send certified mail to producers. Ms. Moon and Mr. West discussed why this practice was done. Ms. Moon motioned, Mr. Estrada seconded, all were in favor except for a no vote from Ms. Sellers.Violation was issued. Susan Booker (Half Hour of Deliverance) Mr. Booker represented his wife regarding the violation. He felt the violations reported by Mr. Gordy were discriminatory against churches. Ms. Moon motioned, Mr. Estrada seconded, all were in favor except for a no vote from Ms. Sellers. Violation was issued. Rusty Maddox (Harbor View Chapel). Discussion took place in regard the violation and ten second rule. Mr. Maddox showed his DVD and the timing was access regarding program identification. Ms. Moon motioned, Ms. Sellers seconded, all were in favor except no violation was issued. Church of Acts Programming. There were four shows in question regarding program identification all were shown. After watching the videos, it was determined that all shows were in compliance. Harvey Griffin(Church of Acts—Teaching)Ms.Moon motioned to dismiss the violation, Mr.Estrada seconded all were in favor.No violation was issued. SCANNED Corey Endsley (Church of Acts -ROC) Ms. Moon motioned to dismiss the violation, Ms. Sellers seconded all were in favor.No violation was issued. Corey Endsley (Church of Acts —ROC Youth) Ms. Moon motioned to dismiss the violation,Ms. Sellers seconded all were in favor.No violation was issued. Debbie Eddy (Church of Acts -Women) Ms. Moon motioned to dismiss the violation, Ms. Sellers seconded all were in favor.No violation was issued. Cornelius Winchester represented Cynthia Winchester (Pulse Fellowship 2). The show was played for purposes of noting the violation for the Commission. After viewing the show it was found that no violation existed. Ms. Moon motioned to dismiss the violation, Ms. Sellers seconded all were in favor. No violation was issued. Mr. Winchester did note his suggestion to determine a punishment for people who report violations that turn out false. The following producers were not in attendance to the February 15, 2010 meeting. The following programs were taken off the air for 60 days. Scott Downey (BCTV-2). Ms. Moon motioned, Mr. Estrada seconded, all were in favor except for a no vote from Ms. Sellers.Program was removed. Cesar Chavez(Faith Talk). Ms. Moon motioned, Mr. Estrada seconded, all were in favor except for a no vote from Ms. Sellers. Program was removed. Hector Gomez, Sr. (Tiempo De Jubileo). Ms. Moon motioned, Mr. Estrada seconded, all were in favor except for a no vote from Ms. Sellers.Program was removed. Hector Gomez, Jr. (Tiempo De Jubileo). Ms. Moon motioned, Mr. Estrada seconded, all were in favor except for a no vote from Ms. Sellers. Program was removed. David Rodriguez (Sinai Evangelistic Center PM). Ms. Moon motioned, Mr. Estrada seconded, all were in favor except for a no vote from Ms. Sellers. Program was removed. During some of the violation discussions, especially those Ms. Sellers voted "no", she felt that a warning should have been given instead of a violation by the Cable Communications Commission and that the Commission had that discretion. She also noted she did not agree with Mr. Gordy giving the DVD to the Commission instead of the producer. REVIEW AND POSSIBLE ACTION REGARDING COPY RIGHT LAW AND MEMORANDUM CONCERNING COMMERICAL PRODUCTS AND SERVICES A brief update was given regarding the subcommittee work and recommendations would be coming to the full commission in the coming months regarding both copyright and advertising guidelines. The subcommittee had met and brought forth recommendations for the Copyright Memorandum and update of the producer application. Both were included in the Commission packet. Mr. West moved that the items be table until next meeting when a full Commission was present, Ms. Moon seconded. Ms. Moon also noted the application was incorrect in the packet and it contained a channel 10 application only. Ms. Womack noted and said she would get with Mr. Gordy regarding updates to the application. The subcommittee's next meeting is scheduled for Thursday,February 25th at Noon. 0 , REVIEW AND POSSIBLE ACTION REGARDING CABLE OPERATOR COMPLAINTS No cable operator representative was in attendance at the meeting. Staff did note that some internal Time Warner meetings were occurring with hopes of pursuing additional options of compliance by the cable operator.Both PAUG and multiple producers are unhappy with the Time Warner response. REVIEW AND POSSIBLE ACTION REGARDING MEDIA DELIVERY LOGS All was well with the media logs PAUG UPDATES Channel 10: Mr. Gordy briefly discussed status of channel 10 and beyond Time Warner complaint issues everything is going well. Channel 18: Mr.Nesmith was not in attendance. PUBLIC COMMENT Mr. Holescher complained about audio interference regarding his television and Time Warner. Mr.West did speak to Mr. Holescher during and after the meeting regarding the possible a setting on his television causing the problem. Mr.Booker requested a grace period for producers regarding programming violations. COMMISSIONERS COMMENTS Ms. Moon recognized Grande Communications for their excellent response in getting a technical problem worked out with Channel 18 and Channel 10. She felt their response time was excellent. ADJOURNMENT OF MEETING Ms. Moon moved that the meeting be adjourned. Commission agreed and the meeting adjourned at 1:16 p.m.
