MINUTES RECEIVED CABLE COMMUNICATIONS COMMISSION NOVEMBER 15,2010 JAN 0 6 2011 PRESENT CITY SECRETARY'S OFFICE Chairperson Connie Gutierrez,Leo Estrada, Carolyn Moon, Steve West ABSENT Latrice Sellers CITY STAFF Lisa Aguilar,Assistant City Attorney, Kim Womack, Director of Public Information Ms. Gutierrez called the meeting to order at 12:00 pm and verified the necessary quorum. REVIEW AND POSSIBLE ACTION REGARDING ABSENCES Ms. Moon motioned to excuse Ms. Seller's October absence due to work related issues. Mr. Estrada seconded the motion.All Commissioners present were in favor. REVIEW AND POSSIBLE ACTION REGARDING MINUTES Ms. Moon made the motion to accept the minutes as presented and Mr. West seconded. All Commissioners present were in favor. REVIEW AND POSSIBLE ACTION REGARDING APPOINTING COMMISSION CHAIRPERSON AND VICE-CHAIRPERSON Ms. Moon motioned to nominate Mr. West for Chairperson with a second from Ms. Gutierrez. All present were in favor. Ms. Moon motioned to nominate Ms. Gutierrez as Vice-Chairperson with Mr. Estrada seconding the motion.All present were in favor. REVIEW AND POSSIBLE ACTION REGARDING MEETING ADMINISTRATION Ms. Moon motioned to table the discussion again until December to allow Ms. Sellers to be present. Mr. Estrada seconded and all were in favor. REVIEW AND POSSIBLE ACTION REGARDING VIOLATION APPEALS Producers Brian Cobos (La Cocina Politica) and Lisa Ann Torres (Kitchen Politics) were not present both had alleged program identification violations. There second meeting to appear or provide a written statement is scheduled for December 20, 2010. Bernice McMillian (Divine Revelations) had the opportunity to appeal a failure to turn in tapes complaint and did not attend. Ms. Moon motioned to keep the program off the air with a second from Mr. Estrada. All present were in favor. Staff noted there was another Divine Relations program produced by Mr. McMillian that failed to make the agenda and also had the opportunity to appeal for failure to turn in tapes. Staff noted this program/producer would be included in the December agenda. REVIEW AND POSSIBLE ACTION REGARDING REPEAT PROGRAMMING After a request from Mr. Gordy in October to pursue the option of allowing repeat programming Lisa Aguilar provided a legal opinion stating that nothing in the franchise prohibited. Discussion occurred regarding how producer's shows would be eligible for repeat programming. Mr. West suggested a third round during the lottery and further clarified after discussion to use the lottery number in each sixth month lottery. Mr. Moon motioned staff to come back with an update to the SCANNED Rules & Procedures to include repeat programming, Mr. Estrada seconded the motion and all present were in favor. REVIEW AND POSSIBLE ACTION REGARDING CABLE OPERATOR COMPLAINTS No cable operator representative was in attendance at the meeting. Mr. Gordy described two conversations with local Time Warner representatives regarding the stations being off the air over an entire weekend. He further went on to say that representatives were unreachable by phone over the weekend and had tried three times both on Saturday and Sunday. The local number feeds into a customer service call center not the local control room. After Mr. Gordy finally got in touch with representatives of Time Warner (local) on Monday the programming was back on the air within 10 minutes. REVIEW AND POSSIBLE ACTION REGARDING TIME WARNER CABLE ANTICIPATED DIGITALIZATION OF PEG CHANNELS Lisa Aguilar provided a brief updated on the legal action regarding the Time Warner migration of PEG channels. REVIEW AND POSSIBLE ACTION REGARDING MEDIA DELIVERY LOGS All was well with the media logs. Ms. Moon requested PAUG Presidents provide cover sheets when turning in their program logs in the future. PAUG UPDATES Channel 10: Mr. Gordy noted the PAUG had a good lottery and had 82 programs as of this meeting and has several others interested in producing. Channel 18: Mr. Nesmith said everything went well with their lottery as well. The Channel 18 PAUG currently has 64 shows and is adding shows daily. PUBLIC COMMENT None. ADJOURNMENT OF MEETING Ms. Moon moved that the meeting be adjourned, Mr. Estrada seconded the Commission agreed and the meeting adjourned at 12:33 p.m.
