HomeMy WebLinkAboutMinutes Cable Communications Commission - 08/15/2011MINUTES CABLE COMMUNICATIONS COMMISSION NOV 2 9 2011 PRESENT Chairperson Steve West, Drew Reining, Trina Garcia LCIIWYSECRETARY,S OFFICE ABSENT Connie Gutierrez, Leo Estrada CITY STAFF Lisa Aguilar, Assistant City Attorney, Kim Womack, Director of public Information Mr. West called the meeting to order at 12:00 p.m. and verified the necessary quorum. REVIEW AND POSSIBLE ACTION REGARDING ABSENCES The only absence to deliberate was Ms. Latrice Sellers. No action was taken since Ms. Sellers is no longer on the Commission. REVIEW AND POSSIBLE ACTION REGARDING MINUTES Ms. Womack noted one change to reflect an amended clarification "This was a failure to appear for the second time resulting in the programming being off the air for 60 days or the end of the lottery period whichever is longer" for both Alicia Villarreal (Day of Pentecost) and Reynaldo Madrigal (Original Coffee Club). Ms. Reining motioned to approve as amended, Ms. Garcia seconded and all present were in favor. REVIEW AND POSSIBLE ACTION REGARDING VIOLATION APPEALS Kenneth Miller with Understanding the Bible was represented by Mr. Joseph Taylor. The DVD was viewed and the Commission agreed it was a failure to properly identify the program within the first 30 seconds of the program. Mr. West motioned to issue a violation, Ms. Garcia seconded and all present were in favor. Mark DiCarlo with Voices of the Coast Bend was present representing his program. Mr. West noted the memorandum on commercial programming and that three elements of a commercial nature had to be present. In the complaint only one element was present. After discussion, Mr. Gordy rescinded his complaint and no violation was given. Reynaldo Chavira producer of He Is Called asked Mr. Gordy to represent him at the Commission meeting. Mr. Gordy noted that Mr. Chavira agreed he had made a mistake on the program. Mr. West motioned to issue a violation with Ms. Garcia seconding the motion and all present were in favor. Mr. Bryan Fiscus and Mr. Eric Hammond from BCM #1 and BCM #2 were not in attendance at the meeting or provided a written response. Both Producers have until September 19, 2011 to appear before the Commission or provide a written response. There were five producers with programs that had the opportunity to appeal for failure to turn in tapes: Joacim Ramos producer of The X- Movement Morning failed to appear or provide a written appeal. Ms. Reining motioned to remove the program from the air with Ms. Garcia seconding, all present were in favor. Roxanne Pena producer of The X- Movement Northwest failed to appear or provide a written appeal. Ms. Garcia motioned to remove the program from the air with Ms. Reining seconding, all mesent were in favor. John David Pena producer of The X- Movement Eklslesia failed to appear or provide a written appeal. Ms. Reining motioned to remove the program from the air with Ms. Garcia seconding, all present were in favor. Lynda Ramos producer of The X- Movement Evening failed to appear or provide a written appeal. Ms. Garcia motioned to remove the program from the air with Ms. Reining seconding, all present were in favor. Abba Akbar producer of Our Memorial Coliseum failed to appear or provide a written appeal. Ms. Reining motioned to remove the program from the air with Ms. Garcia seconding, all present were in favor. REVIEW AND POSSIBLE ACTION REGARDING CABLE OPERATOR COMPLAINTS No cable operator representative was in attendance at the meeting. REVIEW AND POSSIBLE ACTION REGARDING MEDIA DELIVERY LOGS Ms. Reining motioned to accept the Channel 18 PAUG media log and was seconded by Ms. Garcia, with all Commissioners in favor. Ms. Garcia motioned to accept the Channel 10 PAUG media log, Ms. Reining seconded motion with all Commissioners in favor. PAUG UPDATES Channel 10. Mr. Gordy noted that everyone was going good, he provided an updated schedule and discussed briefly his letter to Time Warner regarding the BCM #1 and BCM #2 programs. Channel 18: Mr. Nesmith noted everything was running smoothly with no complaints. PUBLIC COMMENT Mr. Gordy provided a letter regarding two issues. The first issue was capitalization errors in the online version of the Rules & Procedure in which Mr. Gordy counted 141 errors. The second issue was the strike out version of the Ordnance creating the Cable Communications Commission in the Commission handbook. AGENDA ITEMS FOR NEXT MEETING Online Ordnances and strike out copy of Commission ordnance. ADJOURNMENT OF MEETING Ms. Reining motioned that the meeting be adjourned, Ms. Garcia seconded the Commission agreed and the meeting adjourned at 12 :40 p.m.
