HomeMy WebLinkAboutMinutes Cable Communications Commission - 11/21/2011MINUTES CABLE COMMUNICATIONS COMMISSION PRESENT Chairperson Steve West, Trina Garcia, Drew Reining LCE ABSENT Connie Gutierrez, Leo Estrada CITY STAFF Kim Womack, Director of Public Information Mr. West called the meeting to order at 12:00 p.m. and verified the necessary quorum. REVIEW AND POSSIBLE ACTION REGARDING ABSENCES Mr. West motioned Ms. Reining's absence be counted as excused as her out of the country trip had been planned prior to her appointment to the Commission. Ms. Garcia seconded and all Commissioners present were in favor. REVIEW AND POSSIBLE ACTION REGARDING MINUTES Commission tabled both September and October minutes for the December meeting until legal clarification can occur and /or more Commissioners in attendance. Each set of minutes only two Commissioners present were in attendance resulting in lack of quorum to verify accuracy of minutes. REVIEW AND POSSIBLE ACTION REGARDING 2012 CALENDAR The calendar of possible meeting dates for the Commission was presented based on the previous year. Ms. Reining motioned to accept the calendar as presented. Ms. Garcia seconded and all Commissioners present were in favor. REVIEW AND POSSIBLE ACTION REGARDING VIOLATION APPEALS Mr. Gordy received a letter from Corpus Christi Christian Fellowship 44 from Marva Leavell who acknowledged the problem with the program identification and provided it to the Commission. Mr. West motioned to issue a violation on complaint. Ms. Garcia seconded with all. Commissioners present in favor. Joshua Salinas with Tabernacle of Praise PM was present and addressed the Commission regarding the complaint for commercial programming. He noted the church is a 503(c) and the program promoted a lecture series and optional lunch for $10. Mr. West referenced a portion of the Rules & Procedures about 503(c) organizations but nothing specifically is referenced in the commercial programming memorandum. The Commission asked that Ms. Aguilar research the subject and provide input regarding the options either for violation or dismissal. There was one producer with a program that had the opportunity to appeal for failure to turn in tapes: Alicia Villareal producer of Day of Pentecost failed to appear or provide a written appeal. Mr. West motioned to remove the program from the air with Ms. Reining seconding, all present were in favor. REVIEW AND POSSIBLE ACTION REGARDING PROGRAM IDENTIFICATION The agenda item was added two months ago to facilitate a discussion regarding the slate at the beginning of the programs and necessary information. Mr. Logan had requested the Commission take up the issue. Mr. Logan was not present. The Commission briefly discussed some of the issues. Mr. West motioned that the Commission take no action. Ms. Garcia seconded with all Commissioners in favor. REVIEW AND POSSIBLE ACTION REGARDING CABLE OPERATOR COMPLAINTS No cable operator representative was in attendance at the meeting. REVIEW AND POSSIBLE ACTION REGARDING MEDIA DELIVERY LOGS Mr. West motioned to accept the Channel 10 PAUG media log and was seconded by Ms. Reining, with all Commissioners in favor. Mr. West motioned to accept the Channel 18 PAUG media log, Ms. Garcia seconded motion with all Commissioners in favor. PAUG UPDATES Channel 10: Mr. Gordy noted the lottery went very well and they were still getting applications. Channel 18: Mr. Nesmith noted that the PAUG had a minor computer glitch at the beginning of the lottery but soon fixed and the lottery resumed on schedule. PUBLIC COMMENT Mr. Gordy addressed the Commission for public comment noting 4 issues including updating the standard letters the City sends to producers who receive a complaint, online ordinances, complaint forms and the City issued letter to PAUG 18.
