CABLE COMMUNICATIONS COMMISSION
April 16, 2012

Lisa Aguilar, Assistant City Attorney, Kim Womack, Director of Public Information
Ms. Gutierrez called the meeting to order at 6:00 p.m. and verified the necessaiv quorum.
REVIEW AND POSSIBLE ACTION REGARDING ABSENCES
Ms. Gutierrez presented an excuse for her March meeting absence. Ms. Garcia motioned to
accept excuse with Mr. Estrada seconding, all Commissioners present were in favor. Ms. Reining
presented an excuse for her March meeting absence. Mr. Estrada motioned to accept excuse with
Ms. Reining seconding, all Commissioners present were in favor.
REVIEW AND POSSIBLE ACTION REGARDING MINUTES
Ms. Gutierrez motioned to approve Februaiv minutes as presented with Ms. Garcia seconding, all
Commissioners present were in favor.
REVIEW AND POSSIBLE ACTION REGARDING VIOLATION APPEALS
Beveriv Howell of The Empowering Word Hour was represented by Mr. Gordy and accepts the
violation. Mr. Estrada motioned to issue a violation with Ms. Garcia seconding, all
Commissioners present were in favor.
HoNI Grasham of Chapel Harbor View - Sundav Evening (first violation) was represented by
PAUG 18 (Becky Nesmith). After viewing the DVD media Mr. Estrada motioned to issue no
violation with Ms. Garcia seconding, all Commissioners present were in favor.
HoNI Grasham of Chapel Harbor View - Sundav Evening (second violation) was represented by
PAUG 18 (Becky Nesmith). After viewing the DVD media Mr. Estrada motioned to issue no
violation with Ms. Garcia seconding, all Commissioners present were in favor.
Rusty Maddox of Chapel Harbor View - Sundav Morning (first violation) was represented by
PAUG 18 (Becky Nesmith). After viewing the DVD media Ms. Reining motioned to issue no
violation with Ms. Garcia seconding, all Commissioners present were in favor.
Rusty Maddox of Chapel Harbor View - Sunday Morning (second violation) was represented by
PAUG 18 (Becky Nesmith). After viewing the DVD media Ms. Garcia motioned to issue no
violation with Ms. Estrada seconding, all Commissioners present were in favor.
Eldridge Sneed of Silverback Show was not present to appeal failure to turn in media. Ms. Garcia
motioned for the program to remain off the air with Ms. Reining seconding, all Commissioners
present were in favor.
Gilbert Casas of The Prophecy Hour was not present to appeal failure to turn in media. Ms.
Garcia motioned for the program to remain off the air with Mr. Estrada seconding, all
Commissioners present were in favor.
Lydia Maher of Monster on the Seawall was not present to appeal failure to turn in media. Ms.
Garcia motioned for the program to remain show off the air violation with Ms. Estrada seconding,
all Commissioners present were in favor.
REVIEW AND POSSIBLE ACTION REGARDING RULES AND PROCEDURES FOR
PROGRAM IDENTIFICATION
Ms. Aguilar presented a proposed ordinance to make definitions between producer and program
identification consistent within Rules and Procedures for Public Access producers. Mr. Gordy
agreed with change. Ms. Reining motioned for it to move forward to Council with Ms. Garcia
seconding, all Commissioners present were in favor
DISCUSSION AND POSSIBLE ACTION REGARDING CAUSE NO. 10 -51113 IN THE
U.S. COURT OF APPEALS FOR THE FIFTH CIRCUIT, TEXAS CABLE
ASSOCIATION AND TIME WARNER V. TEXAS PUBLIC UTILITY COMMISSION
Time Warner continues efforts to get District Court to take action. If state transition occurs Time
Warner will no longer required to do plug and play*. The City has requested meeting with Time
Warner.
REVIEW AND POSSIBLE ACTION REGARDING CABLE OPERATOR(S)
COMPLAINTS
No cable operators present. None at this time.
REVIEW AND POSSIBLE ACTION REGARDING MEDIA DELIVERY LOGS
Ms. Garcia motioned to approve the Februaiv 2012 (PUAG 10) media log as presented with Mr.
Estrada seconding, all Commissioners present were in favor.
Ms. Garcia motioned to approve the Februaiv 2012 (PAUG 18) media log as presented with Mr.
Estrada seconding, all Commissioners present were in favor.
Ms. Reining motioned to approve the March 2012 (PAUG 10) media log as presented with Mr.
Estrada seconding, all Commissioners present were in favor.
Ms. Reining motioned to approve the March 2012 (PAUG 18) media log as presented with Mr.
Estrada seconding, all Commissioners present were in favor.
REVIEW AND POSSIBLE ACTION REGARDING PAUG LOTTERY ATTENDANCE
Two program lotteries will be held in April. Channel 10 lotteiv will held on Saturday*, April 28 at
2 p.m. Ms. Reining and Mr. Estrada will be at attendance. Channel 18 lottery will be held
Tuesday*, April 22 at 4:30. Ms. Garcia and Ms. Gutierrez will be in attendance.
PAUG UPDATES
Mr. Gordy* said he has eveiN -thing ready* for the lotteiv. Ms. Nesmith said everything is running
smoothly and is getting ready* for lotteiv.
