HomeMy WebLinkAboutMinutes Cable Communications Commission - 06/18/2012MINUTES CABLE COMMUNICATIONS COMMISSION June 18, 2012 PRESENT Trina Garcia, Drew Reining, Leo Estrada and Steve West ABSENT Connie Gutierrez CITY STAFF Lisa Aguilar, Assistant City Attorney, Kim Womack, Director of Public Information Mr. West called the meeting to order at 12:02 p.m. and verified the necessaiv quorum. REVIEW AND POSSIBLE ACTION REGARDING ABSENCES Mr. West presented an excuse for his April meeting absence. Ms. Reining motioned to accept excuse with Mr. Estrada seconding, all Commissioners present were in favor. Mr. Estrada presented an excuse for his May meeting absence. Mr. West motioned to accept excuse with Ms. Reining seconding, all Commissioners present were in favor. Ms. Garcia presented an excuse for her May meeting absence. Mr. West motioned to accept excuse with Ms. Reining seconding, all Commissioners present were in favor. Ms. Reining presented an excuse for her May meeting absence. Mr. West motioned to accept excuse with Mr. Estrada seconding, all Commissioners present were in favor. REVIEW AND POSSIBLE ACTION REGARDING MINUTES Ms. Reining motioned to amend April minutes as presented with Mr. Estrada seconding, all Commissioners present were in favor. REVIEW AND POSSIBLE ACTION REGARDING COMMISSIONER APPOINTMENT RECOMMENDATION Ms. Womack presented updates on appointments REVIEW AND POSSIBLE ACTION REGARDING VIOLATIONS AND APPEALS Ruben Saldivar of New Vision Apostolic Church (fast violation) was represented by Mr. Gordy and accepts the violation. Mr. Estrada motioned to issue a violation with Ms. Garcia seconding, all Commissioners present were in favor. Ms. Garcia motioned to issue a violation with Mr. Estrada seconding, all Commissioners present were in favor. Margareta Fratila of Flowers Talk the Language of Love was represented by Mr. Gordy and mistaken1v turned in wrong DVD. Ms. Reining motioned to issue a violation with Mr. Estrada seconding, all Commissioners present were in favor. Henry McLeod of Bright Star the Magic Romanian Matchmaker was represented by Mr. Gordy and mistaken1v turned in wrong DVD. Ms. Reining motioned to issue a violation with Mr. Estrada seconding, all Commissioners present were in favor. Gavin Drereiv of Have You Heard was not present to appeal failure to turn in media. Mr. Estrada motioned for the program to remain off the air with Ms. Garcia seconding, all Commissioners present were in favor. Moses Castro of Calvaiv Baptist was not present to appeal failure to turn in media. Mr. West motioned for the program to remain show off the air violation with Mr. Estrada seconding, all Commissioners present were in favor. Willie Lanehart of Apostolic Church of the Living God was not present. The producer has until July to provide a response to complaint. Brian Werkhoven of Shelter from the Storm was not present. The producer has until July to provide a response to complaint. REVIEW AND POSSIBLE ACTION REGARDING RULES AND PROCEDURES FOR PROGRAM IDENTIFICATION A brief update was given on Rules and Procedures changes. DISCUSSION AND POSSIBLE ACTION REGARDING CAUSE NO. 10 -51113 IN THE U.S. COURT OF APPEALS FOR THE FIFTH CIRCUIT, TEXAS CABLE ASSOCIATION AND TIME WARNER V. TEXAS PUBLIC UTILITY COMMISSION Ms. Aguilar and Ms. Womack gave updates regarding the recent court ruling. They further noted that Time Warner had filed for a state franchise with the Public Utilities Commission. They will provide an update as necessaiv next month. REVIEW AND POSSIBLE ACTION REGARDING CABLE OPERATOR(S) COMPLAINTS No cable operators present. REVIEW AND POSSIBLE ACTION REGARDING MEDIA DELIVERY LOGS Ms. Reining motioned to approve the April 2012 (PAUG 10) media log as presented with Mr. Estrada seconding, all Commissioners present were in favor. Mr. West motioned to approve the April 2012 (PAUG 18) media log as presented with Ms. Garcia seconding, all Commissioners present were in favor. Mr. West motioned to approve the May 2012 (PAUG 10) media log as presented with Mr. Estrada seconding, all Commissioners present were in favor. Mr. West motioned to approve the May 2012 (PAUG 18) media log as presented with Mr. Estrada seconding, all Commissioners present were in favor. PAUG UPDATES Mr. Gordv said eveiN -thing is going fine. He also had comments regarding cable operator. No representative from PAUG 18 was present. PUBLIC COMMENT None.
