HomeMy WebLinkAboutMinutes Cable Communications Commission - 01/09/2006 MINUTES CABLE COMMUNICATIONS COMMISSION January 9,2006 PRESENT Chairperson Juan Garcia,Jr.,Robert`Bob"White,Dr.Bruce Stratton,and Steve West City Staff • Lisa Aguilar, Assistant City Attorney, Susan Cable, Director of E-Government Services and Holly McCarty,E-Government Services Cable Operators Paula Smith,Time Warner Cable Chairman Juan Garcia called the meeting to order at 12:02 p.m. and verified the necessary quorum. The minutes from December 12, 2005 meeting were reviewed and approved.Bob White motioned to approve the minutes and Dr.Bruce Stratton seconded the motion.All Commissioners approved. 1. DISCUSSION AND POSSIBLE ACTION REGARDING AMENDMENTS TO SECTIONS 2-180 TO 183 — Susan Cable and Lisa Aguilar discussed that changes need to be made to the Cable Communications Commission Sections 2-180 to 183 in the Corpus Christi Code of Ordinances to be consistent with the Master Cable Services Regulatory Ordinance. Juan Garcia explained that Jack Gordy submitted a letter suggesting that Cable Communications Commission be capitalized throughout the ordinance and that access user council be changed to say access user group. Juan Garcia motioned to change access user council to access user group. Bruce Stratton seconded.All Commissioners approved. Bob White motioned to correct capitalization in the document. Bruce Stratton seconded. All Commissioners approved. Juan Garcia motioned to accept the recommended changes.Bruce Stratton seconded.All Commissioners approved. 2. DISCUSSION AND POSSIBLE ACTION ON PROPOSED CHANGES TO RULES AND PROCEDURES FOR PUBLIC ACCESS CABLECASTING — Lisa Aguilar discussed the sentence added to the definition of locally produced programming. Dr. Stratton suggested that a percentage should be established. Juan Garcia motioned to add "local programs must be 25 percent of total programming".Mr.Garcia cancelled the motion.A recommendation was made to make the change on page three instead of page six.Mr. Garcia motioned to change"All programs must be locally produced"to"All programs must be locally produced. In order to be classified as a locally produced program,the program must contain at least twenty-five percent(25%)locally produced content."Dr.Bruce Stratton seconded.All Commissioners approved. 3. DISCUSSION AND POSSIBLE ACTION ON FEDERAL LEGISLATION AND FCC RULEMAKING — Susan Cable reviewed the information in the packets received by the Commissioners regarding cable franchise requirements. 4. DISCUSSION AND POSSIBLE ACTION REGARDING COMPLAINTS — Susan Cable stated that information in the packet was to update the Commission on Channel 10 PAUG complaints about Time Warner broadcast of access programming. 5. CABLE OPERATOR REPORTS —Paula Smith, Time Warner Cable, indicated that they are still in negotiations with the local ABC affiliate regarding the Re-transmission Consent Agreement and hope to have a resolution by the end of January. She also announced they will be starting their"Ask Me About Voting"campaign again this year. SCAN N ED P 6. STAFF UPDATES—Susan Cable discussed that SB286 went into effect on January 1,2006.All Commissioners will be required to attend a one-hour training on the Texas Open Records Act within the year.New commissioners must take the training within 90 days.Ms. Cable also stated that at the next Commission meeting, an agenda item will be included to designate Mr. Armando Chapa, City Secretary, as the commission's Public Information Coordinator. Ms. Cable told the Commission their packet included a copy of the draft annual report, which will be submitted to the City Manger by January 16. Juan Garcia stated he would like to have a workshop in March to prepare a presentation to the City Council on current cable issues and actions of the commission. 7. PAUG UPDATES —Jack Gordy, Channel 10 PAUG, discussed that he needed responses from Time Warner in writing, so he could present something to producers. He also stated that on the FCC Fact Sheet it reads that the franchising authority controls public access. 8. PUBLIC COMMENT—No public comment. 9. COMMISSIONERS COMMENTS — The Commission discussed the possible appointment of Connie Gutierrez to the Commission and the conflict of interest issues related to her being a Commissioner,a producer and a PAUG board member. 10. ADJOURNMENT — Dr. Bruce Stratton motioned to adjourn the meeting and Steve West seconded the motion.All Commissioners approved.The meeting adjourned at 1:30 p.m.
