HomeMy WebLinkAboutMinutes Cable Communications Commission - 09/18/2006 MINUTES ` CABLE COMMUNICATIONS COMMISSION September 18,2006 `;' PRESENT Chairperson Robert"Bob"White,Vice Chairperson Dr. Bruce Stratton, Fred Greenberg, Connie_ Gutierrez, Steve West City Staff Susan Cable, Director of E-Government Services, Lisa Aguilar, Assistant City Attorney and Holly Houghton, E-Government Services Cable Operators Paula Smith,Time Warner Cable Chairman Bob White called the meeting to order at 6:00 p.m. and verified the necessary quorum. The minutes from August 21, 2006 meeting were reviewed. Fred Greenberg motioned to approve the minutes and Connie Gutierrez seconded the motion. All Commissioners approved. 1. REVIEW AND POSSIBLE ACTION REGARDING VIOLATION APPEALS— a. Mark DiCarlo—The Commissioners received Mr. DiCarlo's letter to withdraw his appeal to the Commission. The Commissioners, City Staff and the Channel 10 PAUG President discussed the application and scheduling process. Bob White motioned to deny the appeal. Connie Gutierrez seconded. All Commissioners approved. Bob White motioned to move the other appeals by Mr. Ramirez, Mr. Henneberger, and Mr. Garza to the end of the meeting to allow time for attendance. Dr. Bruce Stratton seconded. All Commissioners approved. 2. CABLE OPERATOR REPORT — Paula Smith, Time Warner Cable, discussed their community projects. 3. STAFF UPDATE—Susan Cable informed the Commission that Mr. DiCarlo's appeal to the City Council will be heard at the October 10, 2006 meetings which begins at 10:00 a.m. She also stated that a few of the Commissioners need to complete the Texas Open Meeting Act training. 4. PAUG UPDATES — Jack Gordy, Channel 10 PAUG, remarked that Mr. Mark DiCarlo was notified of the PAUG Board meeting on September 18th, but he chose not to attend that meeting. Jessie Nesmith, Channel 18 PAUG, stated that half of their producers are now using DVDs and most are complying with the Rules and Procedures. 5. PUBLIC COMMENT—Robert Reyna stated that Ms. Latrice Sellers accusation of the Channel 10 PAUG of racial profiling is untrue and he does not feel it is right for producers to appeal to the Cable Communications Commission and then not be present for the meeting. 6. REVIEW AND POSSIBLE ACTION REGARDING VIOLATION APPEALS— a. Fernando Ramirez— Jack Gordy stated that Mr. Ramirez failed to turn in tapes for two weeks. Dr. Bruce Stratton motioned to deny the appeal. Steve West seconded the appeal. All Commissioners approved. SCANNED b. William Henneberger — Jack Gordy stated he has talked with Mr. Henneberger and he now understands the rules regarding commercial advertising and has resolved the issue. Steve West motioned to grant the appeal under the condition the issue is not violated again. Fred Greenberg seconded the appeal. All Commissioners approved. c. Roland Garza—Jack Gordy stated that Mr. Garza's last violation was almost a year ago. Fred Greenberg motioned to grant the appeal subject to no other future violations. Dr. Bruce Stratton seconded the appeal. All Commissioners approved. 7. COMMISSIONERS COMMENTS—Fred Greenberg thanked Mr. Reyna for his comments. Dr. Bruce Stratton stated he feels if the producers are going to appeal PAUG violations, they should attend the meetings. Bob White stated he thinks the integrity of the Rules and Procedures need to be upheld and it's the responsibility of the Commission to enforce the Rules and Procedures. 8. ADJOURNMENT — Fred Greenberg motioned to adjourn the meeting and Connie Gutierrez seconded the motion. All Commissioners approved. The meeting adjourned at 7:11 p.m.
