Connie Gutierrez called the meeting to order at 12:00 p.m. and verified the necessary quorum. The
minutes from the January 14, 2008 and February 5, 2008 meetings were reviewed. Joan Veith motioned
to approve the minutes and Steve West seconded the motion.All Commissioners approved.
1. REVIEW AND POSSIBLE ACTION REGARDING VIOLATION APPEALS—
a. "West Haven Baptist Church" — Mr. Fields stated that he misunderstood the date in
question. Mr. Fields thought the program in question aired on January 8,2008,however
the correct date in question is December 8th, 2007. Steve West motioned to table the item
in question until the next meeting. Joan Veith seconded.All Commissioners approved.
b. "Iglesia Cristiana Juan 3:16- Sun"—Mr. Melendez stated that he is currently revising
his tapes (program, dates and producers). Steve West motioned to give Mr. Melendez a
warning. Joan Veith second. All Commissioners approved.
c. "Grace Presbyterian Church, Contemporary Service"- New Chairperson, George Seitz
stated that camera and recording equipment was stolen. New equipment is now being
used and Mr. Seitz will make sure he will review the DVD's before they are sent for
showing. Joan Veith motioned to take no action at this time and to give 90 days to take
corrective action, which will then be reviewed. Leo Estrada second. All Commissioners
approved.
d. "Trinity Lutheran Church"-Mr. Phillip Phifer states that there was a violation and it was
a small mistake on the program and the problem has been corrected. Leo Estrada
motioned to dismiss the violation. Joan Veith second. All Commissioners approved.
Mr.Phifer also thinks that there needs to be changes made in the complaint process. Lisa
Aguilar mentioned that the PAUG'S have the ability the make a recommendation of any
changes to the Rules.
e. "The Danger Zone" - Mr. David Cifuentes stated that he was in violation of copyright.
Steve West motioned to warn the producer. Leo Estrada second. All Commissioners
approved. Mr. Cifuentes also states he was in violation of copyright of his second
violation. Joan Veith motioned that he was in violation. Steve West second. All
Commissioners approved.
f. "The Apostolic Church of the Living God" — Mr. Lanehart's certified letter came back
unclaimed. Because he did not receive this letter, Steve West motioned to table this item
for the next meeting and to send two letters (one certified and one regular mail). Joan
SCANNED
Veith second. All Commissioners approved.
g. Studio Thre3 —Mr. Paul Pawlak will be receiving a letter, stating that his show will be
pulled for the remaining lottery period. Joan Veith motioned to file a complaint with the
FCC (Federal Communications Commission). Connie Gutierrez second. All
Commissioners approved.
h. "Sanai Evangelistic Center"— Connie Gutierrez motioned to table this item for the next
meeting. Steve West second. All Commissioners approved.
i. "Calvary Baptist Church"- Moses Castro did not appear. Did not claim his certified
letter. Steve West motioned to table this item for the next meeting. Connie Gutierrez
second. All Commissioners approved.
2. DISCUSSION AND POSSIBLE ACTION REGARDING EMAILS RECEIVED BY JOAN
VEITH FROM THE PRODUCER OF "ANGELS IN HEAVEN", BARBARA SELLERS—
Connie Gutierrez motioned to table for the next meeting. Joan Veith second. All Commissioners
approved.
3. DISCUSSION AND POSSIBLE ACTION REGARDING EXTENSION OF PUBLIC
ACCESS CHANNEL PROGRAM TIME SCHEDULE— A representative from Time Warner
was not present to discuss this action. Connie Gutierrez motion for this item to be tabled for the
next meeting. Steve West second. All Commissioners approved. Connie Gutierrez stated that in
the future if the Commission board be notified before the Cable company.
4. REVIEW AND POSSIBLE ACTION REGARDING CABLE OPERATOR
COMPLAINTS-None
5. REVIEW AND POSSIBLE ACTION REGARDING PUBLIC ACCESS COMPLAINTS —
Jesse Nesmith explained that"Church of Acts"was airing old programs after the passing of Jerry
Vestal and they were not aware that a new ID was needed. Mr. Nesmith has spoken with
"Church of Acts" and will be taken care of Mr.Nesmith also stated that he has set up a T.V. w/
dvd player and the programs will be checked prior to being submitted by his staff. Mr. Nesmith
as hired a staff to help him out, since he is now substitute teaching. This should hopefully narrow
down the channel 18 complaints and violations.
Jesse Nesmith explained to Jack Gordy that during the first week of showing "J.O.B.
Bible Basics", he received a call from Mike and was told there was a possibility that channel 10
and channel 18 were coming off the air. Mr. Nesmith called his producers and advised them not
to turn in any tapes. Since there was no guarantee that they would be shown. The tapes that
Time Warner Cable had were being played consecutively.
6. REVIEW AND POSSIBLE ACTION REGARDING MEDIA DELIVERY LOGS: Holly
Houghton stated that Channel 18 turned their tapes on time. However, letters will be sent to
Channel 10's- "STUDIO THRE3", "The Prophecy Hour", and "The M&E Chronicles", for not
supplying tapes for a period of 4 consecutive weeks in a row.
7. CABLE OPERATOR REPORT—none
8. PAUG UPDATES—Jack Gordy, Channel 10 PAUG, stated that a DVD that aired on channel 18
was put in his box, once again. This DVD did not have the length of the program and there is not
telephone number listed on this DVD. Both of which are required by the Rules and Procedures.
Mr. Gordy also wanted to go over the situation regarding Roland Garza and states the clarity of
the Rules and Procedures. Joan Veith, requested that a workshop be held after elections to do
more treaking on the Rules and Procedures. Jesse Nesmith, Channel 18 PAUG, states that at each
lottery he does issues out packets with the application, rules and guidelines to the producers, so
there shouldn't be anyone having to approach the Commission.
9. STAFF UPDATES — Lisa Aguilar stated that the Legal depaitment has been receiving
complaints regarding Time Warner Cable and should be addressed to Vicki Triplett.
10. PUBLIC COMMENT—none
11. COMMISSIONERS COMMENTS — Connie Gutierrez would like to congratulate Leo Estrada
as the new commissioner member. Joan Veith also welcomed Mr. Estrada. Leo Estrada stated
that he will do his best. Connie reminded the early voting is taking place on February 19 —
February 29t. Don't forget to vote.
12. ADJOURNMENT—Connie Gutierrez motioned to adjourn. Joan Veith seconded the motion. All
Commissioners approved.The meeting adjourned at 1:45 p.m.
