City Attorney I...eslie Vlisides, Member Debbie Marroquin, Director Gas Dept. 'liana. Belock, I IR Analyst 9:00-9:20 'There was a mistake on the posted agenda, with the job title of Mr. Ilerrera. Assistant City Attorney Janet Kellogg left to review the Open Meetings Act, and concluded that the meeting could proceed since the information was not misleading or misrepresenting Mr. Herrera, per the Open Meetings Act. Chairperson Bonilla called the 561 st Civil Service Board hearing to order at 9:20 a.m. ITEM #1 Review and approve the minutes of the 560t" Civil Service Board hearing held on April 14, 2014. ITF M #2 Review and consider the appeal filed by Orlando Herrera, Utility "Technician IV, Gras Department for his demotion. Chairperson Bonilla read agenda Item #1 and Item #2. All witnesses present gook the oath administered by Chairperson Bonilla. Chairperson Bonilla asked if the City wished to invoke the rule. Assistant City Attorney Janet Kellogg invoked the rule, and witnesses were sent to the lobby to wait their turn to testify. Board Member Bonilla made a motion to approve the minutes and the motion was seconded by the Board. The minutes were approved for the 560'x' Civil Service Board I tearing. Janet Kellogg made her opening statement. Mr. llerrera made his opening statement. Assistant City Attorney Janet Kellogg called Debbie Marroquin, Director of Gas Dept, as the first witness. Janet Kellogg introduced as Exhibits four documents, and asked the witness if they are true and correct copies. Ms. Marroquin discussed the demotion of Mr. l-lerrera, and general Gas dept. procedures. Mr. l-lerrera asked the witness some questions. Exhibits: 1. C.'omrnunication Letter 2. Performance Appraisal 3. Contemplated Discipline Letter. 4. Demotion f.,ettcr Board members and Mr. Herrera received copies of the tour exhibits. Assistant City Attorney Janet Kellogg called as a witness and questioned hill Mahaffey, Asst. Director of Utilities. Mr. Herrera questioned this witness as well. Janet Kellogg called as witnesses and questioned Santiago Salinas, Armando Jimenez, Marc Guardiola, and Felix Gonzalez. Mr. I lerrera asked questions of"all witnesses. Janet Kellogg introduced Exhibit 5, a copy of a City Work Order. Copies of exhibit were given to Board members and Mr. Ilerrera. Janet Kellogg called witness Vicente Martinez, and questioned witness. Mr. (lerrera also questioned witness. .Janet Kellogg called witness Corina Saenz. Ms. Kellogg introduced Exhibit 6, Investigation Documents. Copies of exhibit were given to Board members and Mr. I lerrera. Ms. Sacnz testified about the investigation documents. City rests, break until 11:30 AM. Resumed at 11:33 AM. Mr. Herrera called as witnesses Jacob Garcia and Mike Coble. Mr. Garcia and Mr. Coble testify and answer questions pertaining to the Gas department laying pipes on top of or around the pipes of their companies. Janet Kellogg questions both witnesses. Mr. Herrera called witnesses Joe Gonzalez, Sr., Epifanio Zuniga, and Reynaldo Chavez, who answered questions about working with Mr. Herrera. Janet Kellogg questioned all witnesses. Orlando Herrera testifies on his own behalf. Janet Kellogg made closing statements for the City. Orlando Herrera made closing statements on his behalf. 12:22 PM Chairperson Bonilla announced the Board would be going into closed session. 12:47 PM Board reconvened and motion was made to uphold the discipline. Board members seconded motion to uphold. Chairperson Bonilla announced the Board's decision to uphold the demotion of Mr. Herrera. 12:48 Meeting concluded and closed by Chairperson Bonilla.
