Guy Nickleson called the 577"Civil Service Board hearing to order at 6-02 pm.
Item#1: Review and approve the minutes of the 576" Civil Service Board
hearing held on August 20, 2015.
Item#2: Review and consider the appeal filed by Keith Rhodes, Utility
Technician 111, with Gas on his termination.
Paul Grivich moves to approve agenda item R 1.The motion is seconded by Tammy McDonald.
Mr.Nickleson moves to Item#2, and reads.
Mr.Nickleson swears in the witnesses. The City then invokes the rule.
Assistant City Attorney Renatto Garcia makes thea ening statement about the ten-nination of it Rhodes.
He explains Mr. Rhodes was a Utility Tech III with the Gas Department. He states Mr. Rhodes was given
several opportunities to correct his performance and driving conditions.
Keith Rhodes makes his opening statement. Mr. Rhodes stated he filed his appeal because based on the
Performance Improvement Plan he was on said he successfully passed.
The City calls Debbie Marroquin as a witness.
Renatto Garcia asks Debbie Marroquin to state her name and position for the record, then goes on to
question the witness. Mr. Garcia refers to Exhibits 1, 3, and 5-11 as evidence. The board its it. Mr.
Garcia continues to question Ms. Marroquin about the Exhibits.
No further questions of the witness.
Keith Rhodes questions Debbie Marroquin. Mr. Garcia objects Mr. Rhodes question because the scope is
limited to Mr. Rhodes termination, not the driving records of other employees. Mr. Rhodes continue to
question Ms. Marroquin.
Mr. Rhodes has no further questions.
Mr. Garcia calls John Miranda as the next witness for the City.
Mr. Garcia asks John Miranda to state his name and position for the record. He then begins to question Mr.
Miranda regarding the City's Exhibits previously admitted as evidence. Mr. Garcia asks that Mr. Miranda
give an overview of the complaints that had been received regarding Mr. Rhodes driving.
Mr. Garcia has no further questions of the witness.
Mr. Rhodes has no questions for the witness, Mr. Miranda.
Mr. Garcia calls John Flores as the next witness for the City.
Mr. Garcia asks John Flores to state his name and position for the record. He then begins to question Mr.
Miranda regarding the City's Exhibits previously admitted as evidence. Mr. Garcia refers to Exhibit 8 and
asks the witness to review the document.
Mr. Garcia has no her questions of the witness.
Mr. Rhodes questions the witness,John Flores.
No further questions by Mr. Rhodes.
Mr. Rhodes presents himself as a witness to the Civil Service Board. Mr. Garcia then questions him.
Mr. Garcia has no further questions of witness.
Mr. Garcia gives his closing statement for the City. Mr. Garcia states the evidence in the case has shown
that Mr. Rhodes had several incidents and several opportunities to correct his driving record,yet he chose
to ignore the policies and rules. He asks the board to uphold the termination.
Mr. Rhodes gives his closing statement.

Open session called at 7:24 pm.
Motion was made to uphold the termination of Keith Rhodes by Tammy McDonald. Member Paul
Grivich seconds the motion.
