Guy Nickleson called the 57811 Civil Service Board hearing to order at 9:22 am.
Item 91: Review and approve the minutes of the 5771„ Civil Service Board
Hearing held on October 14, 2015.
Item #2: Review and consider the appeal filed by Leonor Cuellar,Customer Service
Representative,with Finance/UBO on her termination.
Item#3: Review and consider the appeal filed by Deborah Merlo,911 Dispatcher
11, with MetroCom on her to ination. (Meeting originally scheduled
October 30, 2015)
Tammy McDonald moves to approve agenda item #1. The motion is seconded by Mr.Nickleson.
Mr.Nickleson moves to Item #2,and reads.
Mr.Nickleson swears in the witnesses.The City then invokes the rule.
Assistant City Attorney Renatto Garcia makes the opening statement about the termination of Leonor
Cuellar. He explains Ms. Cuellar was a Customer Service Representative with the UBO/Finance
Department.
Ms,Cuellar makes her opening statement. Ms.Cuellar states she is not here to sway the board in her favor.
She states she visited her friend whom had cancer and she received second hand smoke, despite wearing a
face mask.
The City calls Sylvia Guzman as a witness.
Renatto Garcia asks Ms.Guzman to state her name and position for the record,then goes on to question the
witness. Mr.Garcia refers to Exhibits 1-5. The board admits the Exhibits. Mr. Garcia continues to question
Ms. Guzman about the Exhibits.
No further questions of the witness.
Ms. Cuellar has no questions for Ms. Guzman.
Mr. Garcia calls Margaret Morin as the next witness for the City.
Mr. Garcia asks Ms. Morin to state her name and position for the record. He then begins to question Ms.
Morin regarding her position and responsibilities for the City. Mr. Garcia refers to Exhibits 6 & 7 and
questions Ms. Morifi about the Ms. Morin talks about her role in the termination of Ms. Cuellar.
Mr. Garcia has no further questions of the witness.
Ms. Cuellar has no questions for Ms. Morin.
Ms.Cuellar presents herself as a witness and gives her testimony. Ms. Cuellar states she was hired in April
2014. Ms. Cuellar states she regrets being exposed to Marijuana,but doesn't regret spending time with her
friend.
Mr.Garcia briefly questions Ms. Cuellar.
Mr.Garcia has no further questions.
Mr. Garcia gives his closing statement for the City. Mr. Garcia states it is the City's burden of proof to
prove for Ms. Cuellar's termination was for violating policy. He asks the board to uphold the termination.
Ms. Cuellar gives her closing statement.
Closed session called at 9:55 am.
Open session called at 10:03 am.
Motion was made to uphold the termination of Leonor Cuellar by Tammy McDonald. Chairperson
Nickleson seconds the motion.
57801 Civil Service Board hearing is adjourned for a recess at 10:04 am.
The 5781 Civil Service Board hearing is called back in session at 10:06 am.
Mr.Nickleson reads agenda item #3. Ms. Merlo is not present for the hearing.
Ms. McDonald makes the motion to uphold Ms. Merlo's termination as it is required for Ms. Merlo to be
present at her hearing. Mr.Nickleson seconds and approves the motion.
The 57811 Civil Service Board hearing is adjourned at 10:07 am.
