Garcia, Director of John Silvas, Member Human Resources Jennifer Knox,Asst. City Attorney Annette Rodriguez, Acting Director of Health Department Deanna Galan,Human Resources Chairperson Farrar called the 532nd Civil Service Board hearing to order at 9:00 a.m. Item#1: Review and approve the minutes of the 531st Civil Service Board Meetings held on December 6, 2005. Motion to approve minutes by Member Silvas. ?, `t Chairperson Farrar would like to amend the motion to add on the second to the last page, with regard to the motion that was made on item agenda#2, to review the tape and add what was said verbatim, the motion verbatim, even though the overall result is the same — it would not change the motion. I just wanted it to be more complete with regards to what was said. Cynthia Garcia: The motion is to adopt the minutes as written with one change and that is to take the motion made on item #2 and add that motion verbatim to the minutes. Chairperson Farrar: OK Cynthia Garcia: Is that correct? Chairperson Farrar: Yes, as far as procedure, are we supposed to vote on his (member Silvas) and then... vote on the amendment? Member Silvas: I agree Cynthia Garcia: You:::::t:: Member Silvas: Yes . SCANNED v Chairperson Farrar seconds the motion. • Item#2: Review and consider the three (3) day suspension of Michael Selph, Animal Control Officer II, Health Department. Asst. City Attorney, Ms. Knox, asked to have rule invoked. Chairperson explains the meaning of invoking the rule and asked to have all witnesses present for the swearing of the oath. Chairperson Farrar gives the oath and asks all witnesses to leave the room. Ms. Knox asks, in an effort to avoid disruption of Animal Control operations, to allow the witnesses scheduled to testify to go back to work and then we can call them back after lunch? Ms. Knox states there are four that were not called by the City. Chairperson states she agrees. Cynthia Garcia asks Mr. Selph if this is ok. Mr. Selph responds it is fine as long as they are available when we need them, he is aware of emergencies arising with Animal Care. Member Silvas asks for a response time. Chairperson Farrar states she does not want to have 10 people come in here and say the same thing, the Board does not want to hear that in the interest of time. Chairperson Farrar asks Mr. Selph if he is in agreement with witnesses leaving. Mr. Selph again states as long as they are able to come back. He states if there is an emergency call it could be handled by one of the witnesses who has the most testimony on Mr. Selph's behalf. Chairperson Farrar states if witnesses are not able to come back, the hearing will be postponed. Cynthia Garcia states we received a phone call regarding a postponement because Mr. Selph no longer had an attorney. Mrs. Selph asks if it's possible to postpone this meeting for another day. She states they were aware until the 4th that they wouldn't have representation. They didn't ''' have enough to find someone else to represent them. Chairperson Farrar asks if there is anything in writing from the attorney. Mrs. Selph states she does not have it. Ms. Knox states she has the email from their attorney, Mr. Ruiseco. Ms. Knox states the email states Mr. Selph wanted to represent himself. Chairperson Farrar asks Mr. Selph if he can present his case. Mr. Selph states he cannot. Mrs. Selph states their attorney didn't give him all the information. Chairperson Farrar asks if Mr. Selph will hire another attorney. Mr. Selph replies yes. Chairperson Farrar states she will grant one postponement. She states the inconvenience and Mrs. Selph states she contacted Ms. Galan and was advised they needed to come in to ask for the postponement. Chairperson Farrar asks if Ms. Knox agrees to postpone one time. Chairperson Farrar states the board will adjourn unless a time for scheduling needs to be discussed. Cynthia Garcia states the notices.will be reissued for witnesses. Witnesses are excused. Cynthia Garcia states March may be a good time to start the monthly meetings. Ms. Knox states she proposes the 2"d or 3rd Thursday. Chairperson Farrar states the 3"d Thursday is Spring Break. Member Silvas states the 2"d Thursday would be good. Chairperson Farrar asks Mrs. Selph if March 9th is ok; Mrs. Selph states yes. Cynthia Garcia would like to discuss the ground rules for the new hearing — will parties by allowed to amend their witness list or request list or what we have should stand. Chairperson Farrar states we will stay with exactly what we have, no new anything. Mrs. Selph states she used the witness list from what Mr. Ruiseco gave her. She states the only person who was not called was Jaime Luna. Ms. Knox states she disagrees and that six additional witnesses were added to the list.Mrs. Selph states she added additional people. Chairperson Farrar states "we are going with it". Mrs. Selph states Mr. Luna was on the list but not present today. Ms. Galan states he was on the original one Mrs. Selph submitted but we asked you to submit... Mrs. Selph states at the last minute she was asked to submit a new list. Ms. Knox states she requested from Mr. Ruiseco, at the beginning of September,to put one list together to make it easier to subpoena witnesses- we received four or five different lists by that time. This is what we were given last week. Mrs. Selph states she needed to do a new list because the list Mr. Ruiseco "he had not submitted again". Cynthia Garcia states the new list doesn't have his name on it. Mrs. Selph states "right", because when she received the email on the 4th, she didn't know this was due. Mrs. Selph states she saw Ms. Galan on the 4`h to drop off the information and gave to Ms. Galan,put together at the last minute. Chairperson Farrar asks if there is anything else she'd like to change. Mrs. Selph replies no. Mr. Selph replies no. Chairperson Farrar states if it's just one person "we'll go with it", states we are not changing anything else. Asks if everyone agrees. Chairperson Farrar states March 9 @ 9am has been agreed upon.
