Vice-Chairperson Butler called the 542nd Civil Service Board hearing to order at 9:03 a.m.
ITEM #1: Review and approve the minutes of the 541st Civil Service Board Meeting held on
April 9,2009.
Vice-Chairperson Butler passes on Item#1 until Chairperson Silvas is present.
ITEM #2: Review and consider the termination of Juan Ramon, Wastewater Collection
Technician, Wastewater Department.
All witnesses present were given the oath and the meaning of invoking the rule was explained
by Vice-Chairperson Butler. Opening statements were made by Jennifer Knox-Walker, Asst.
City Attorney. Mr. Ramon waived his opening statement.
The City called Deanna Galan, Human Resources Analyst. Ms. Galan testified having taken
the post-accident call from Eloy Ceballos on September 12,2008.
The City called Ray Zuniga, former employee of Concentra. Mr. Zuniga testified to collecting
the urine specimen for drug testing from Mr.Ramon at the department.
The City called Dr. Rodriguez, employee of Concentra. Dr. Rodriguez testified to being the
Medical Review Officer for the City of Corpus Christi at the time of Mr. Ramon's post-
accident drug/alcohol testing.
The City called Foster Crowell, Director of Wastewater. Mr. Crowell testified to issuing the
contemplated and termination letters to Mr. Ramon.
Mr. Ramon asked Mr. Crowell how many employees been positive and have maintained their
jobs. Mr. Crowell stated he adheres to city policy and clarified it is mandatory termination.

The City rest and Vice-Chairperson Butler took a break until 10:35 a.m.
The hearing resumed at 10:37 a.m.
Mr. Ramon stated he felt underprepared. Ms. Garcia asks Mr. Ramon if he'd like to say
anything before he called Regina Lee,his witness. Member Bonilla stated the board would like
to hear his side.
Mr. Ramon gave a statement.
Regina Lee was called by Mr. Ramon.Mr. Ramon asked Regina if she remembered going over
the policy with him and he asked why he wasn't told about the split specimen.
Member Bonilla asked what Ms. Lee's duties were. Ms. Lee stated she did meet with Mr.
Ramon but that it was about the contemplated letter and the next steps but does not remember
the part about the additional testing. Ms. Lee stated the meeting wouldn't have been
documented.
Mr. Ramon wanted to ask someone about the consequences for not signing the paperwork
because he didn't witness anything.
Member Bonilla asked Mr. Ramon if he had any other disciplinary issues. Mr. Ramon stated
only not showing up on time.
Vice-Chairperson Butler breaks at 10:58 a.m. Hearing resumed at 11:07 a.m.
Mr. Zuniga was called and stated he would have called the Human Resources contact about a
refusal to sign as to what would be the next step.
Asst. City Attorney Knox-Walker made her closing statement. Mr. Ramon made his closing
statement.
Vice-Chairperson Butler went into closed session at 11:46 a.m.
The hearing was resumed at 11;56 a.m.
Member Bonilla made a motion to uphold the termination and Vice-Chairperson Butler second
motion.
The hearing was adjourned at 11:47 a.m.
