Chairperson Bonilla called the meeting to order at 9:04 AM.
Chairperson Bonilla read Item #I from the agenda.
Itcm 41 Review and approve the minutes of the 489 "' Civil Service Commission meeting held
January 18, 2011.
Commission Member Saenz made motion to approve the minutes and Board Member Lutz seconded.
Chairperson Bonilla read Item 42 from the agenda.
Item #2 Review and consider the appeal submitted by Firefighter 11 Morgan Smith of question
#19 from the Firefighter II Engineer promotional examination administered on May 17,
2011.
Karen Harting read the question being appealed, all possible answers for the question, and the analysis
provided by the test creator. The test creator recommends denying; the appeal.
Firefighter 11 Morgan Smith clarified that he believes both his answer and the test creator's answer are
correct and wants them both to be counted as correct. Mr. Smith explained the reasons he appealed the
question and the why lie believes that the answer he marked is also correct.
Firefighter 1I Justin Schroeder agrees with the Morgan Smith that both answer choices should be marked
as correct and explained his reasons.
I"irefighter 11 Anthony Keith agrees with Morgan Smith that both answer choices should be narked as
correct.

Item 43 Review and consider the appeal submitted by Firefighter 11 Morgan Smith of question
963 from the Firefighter 11 Engineer promotional examination administered on May 17,
2011.
Karen I larling read the question being appealed, all possible answers for the question, and the analysis
provided by the test creator. The test creator recommends denying the appeal.

Firefighter 11 Morgan Smith stated that he believes both his answer and the test creator's answer are
correct. Mr. Smith explained the reasons he appealed the question and why he believes that his answer is
the best answer. Mr. Smith requests that both his answer and the test creator's answer be marked as
correct.
Firefighter II Billy Belyeu requested the question be re -read and Karen Flarling re -read the question and
answers. Mr. Belye €r questioned to Mrs. Harling if since Mr. Smith's request is only fior both answers to
be correct; there would be no situation which would allow the Commission Members to mark the test
creator's answer wrong; and Mr. Smith's answer correct. Mrs. Marling confirmed that the Commission
Members could tither accept or deny the appeal. Mr. Belyeu stated he did not have a problem with the
appeal.
Firefighter II Anthony Keith agrees with Morgan Smith that both answer choices should be marked as
correct.
Chairperson Bonilla read Item #4 from the agenda.
Item #4 Review and consider the appeal submitted by Firefighter 11 Anthony Keith of question
#123 from the Firefighter 11 F.ngincer promotional examination administered on May 17,
2011.

provided by the test creator. The test creator recommends denying the appeal.
Firefighter II Anthony Keith believes both his answer and the test creator's answer, and he requested both
answers be marked as correct. Mr. Keith explained the reasons he appealed the question and why lie
believes that his answer and the test creator's answer are correct.

Firefighter 11 Anthony Keith believes both his answer and the test creator's answer are. Mr. Keith
explained the reasons he appealed the question and why Ire believes that his answer and the test creator's
answer are correct.
Firefighter 11 Justin Schroeder agrees that both answers should be marked as correct.
hircfighter 11 Andrew Cortez agrees with the test creator and believes that only the keyed answer be
marked as correct.

#30 from the Firefighter IF Engineer promotional examination administered on May 17,
2011.
Karen Harling read the question being appealed, all possible answers for the question, and the analysis
provided by the test creator. The test creator recommends denying the appeal.
Firefighter Il Justin Schroeder believes both his answer and the test creator's answer are correct. Mr.
Schroeder explained the reasons he appealed the question and why lie believes that his answer and the test
creator's answer are correct.
Firefighter 11 Billy Belyeu requested the question be re -read and Karen Harling re -read the question and
answers. Mr. Belyeu stated that lie agrees with Mr. Schroeder and requests both answers be marked as
correct.
Firefighter It Anthony Keith agrees with Mr. Schroeder that both answers should be marked correct.

Item 47 Review and consider the appeal submitted by Firefighter 11 Justin Schroeder of question
#82 from the Firefighter It Engineer promotional examination administered on May 17,
2011.
Karen I- larling read the question being appealed, all possible answers for the question, and the analysis
provided by the test creator. The test creator recommends denying the appeal.
Firefighter 11 Justin Schroeder believes both his answer and the test creators answer are correct. l le
explained the reasons he appealed the question and why lie believes that his answer and the test creator's
answer are correct. Mr. Schroeder further clarified that he does not want the question thrown out, and lie
Just asks that his answer also be marked as correct.
Firefighter 11 Morgan S[nith asked that all answers be marked as correct instead of just the answer that
Mr. Schroeder
It was requested that Karen I larling re -read the question, and she re -read the appealed question and all
possible answers.
Firefighter 11 Anthony Keith explained that he believes all answers should also be marked correct.
Karen Marling inquired what result Mr. Schroeder wanted from his appeal.
Mr. Schroeder stated that his argument was initially just for his answer to be marked as correct, but now
lie requests that all answers be marked as correct.
Firefighter II Billy Belyeu stated that lie agrees with everyone else that all answers should be marked as
correct.
Firefighter 11 Morgan Sinith agrees that all answers be correct.
Firefighter 1I Andrew Cortez, agrees with the test creator that only the keyed answer be marked as correct.

Chairperson Bonilla announced it is 10:07 AM, and the Commission is going into closed session pursuant
to the authority Section 551.074 of Texas Open Meetings Act to discuss the appeal.
Chairperson Bonilla stated it is 10:41 AM, and the Commission Meeting was back on the record.
Chairperson Bonilla announced the dccisions the following:
Item # 2 -Deny Appeal
Item # 3 -Deny Appeal
Item #4 -Deny Appeal
Ite n #5 -Deny Appeal
Item #6 -Deny Appeal
Item # 7 -Derry Appeal
All Members agreed with the decision.
Chairperson Bonilla adjourned the meeting at 10:43 AM.
