Chairperson Bonilla called the meeting to order at 9:01 AM,
Chairperson Bonilla read Item #I from the agenda.
Item 41: Review and approve the minutes of the 490' Civil Service Commission meeting
held June 15, 2011.
Commission Member Saenz made motion to approve the minutes and Board Member Lutz seconded. All
Members agreed.
Chairperson Bonilla read Item #2 from the agenda.
Item #2: Review and consider the appeal submitted by Eire Captain Michael Gilley of
question 450 frozen the l=ire Battalion Chief promotional examination
administered on November 17, 2011.
Jennifer Freeman read the question being appealed and all possible answers for the question.
Chairperson Bonilla read an email submitted by Michael Guilley in defense of his appeal of the question,
asking for allowing more than one correct answer.
Kenneth Lrben stated that the best answer was the answer from the key, choice "C"
Jennifer Freeman read the analysis provided by the test creator. The test creator recommends denying the
appeal.
Javier Jasso stated that the test creator sighted a page number in the question therefore he was specifically
looking for the answer from that page, and nowhere else.
Patrick (inaudible last name) said that he understands the argument ftom Mr. Guilley; however, that's not
what the question was asking.
Chairperson Bonilla read Item # 3 from the agenda.
Item #3 Review and consider the appeal submitted by hire Captain "Wed Vicha and Fire
Captain Kenneth Erben of question #53 from the Fire Battalion Chief
promotional examination administered on November 17, 2011.
Jennifer Freeman read the question being appealed and all possible answers for the question.
Kenneth Erben presented his argument of why the appeal should be granted, and he asked that botli "C"
and "D" be marked as correct.
Ted Vicha stated that choice "C" was the only option because "D" was not an option. Two "C "s were
listed on the exam instead of option "D ".
Javier Jasso stated that he asked Jennifer Freeman during the exam about the typo and he was instructed
that the second "C" was option "D
Patrick (inaudible last name) stated argued that "C" should be counted as correct.
(Did not identify himself) Agreed that both C and D should be marked as correct.
Jennifer Freeman read the analysis provided by the test creator. The test creator recommends allowing
both answer choices "C" and "D"
Chairperson Bonilla read item #4from the agenda.
Item IN Review and consider the appeal submitted by Fire Captain Leroy Barbosa of
question #59 from the Fire Battalion Chief promotional examination
administered on November 17, 2011.
Jennifer Freeman read the question being appealed and all possible answers for the question.
Leroy Barbosa presented his argument to support his appeal to delete the question.
Kenneth Erben stated that the keyed answer should be marked as the correct answer.
(Did not identify himself) agreed that the question should be deleted.

appeal.
Chairperson Bonilla read Item #5 from the agenda.
Item #5 Review and consider the appeal submitted by Fire Captain Leroy Barbosa of
question 461 from the Fire Battalion Chief promotional examination
administered on November 17, 2011.
Jennifer Freeman read the question being appealed and all possible answers for the question.
Leroy Barbosa presented his argument to support his appeal of the question.
Kenneth Erben stated the best choice for this answer was the keyed answer.
Jennifer Freeman read the analysis provided by the test creator. The test creator recommends denying the
appeal,
Chairperson Bonilla announced that the meeting went into closed session at 9:21 AM pursuant to the
authority Section 551.074 of Texas Open Meetings Act to discuss the appeals.
At 9:28 Chairperson Bonilla announced that the meeting was back.on the record.
Chairperson Bonilla announced the decisions the following:
Item #1 2 -Deny Appeal
Item 4 3- Accept both C 8l, D
Item #4 -Deny Appeal
Item 115 -Deny Appeal
All Members agreed with the decisions.
Chairperson Bonilla adjourned the meeting at 9:30 AM.
