J. Thomas Jennifer Recio Edita Fuentes SCANNED 1. CALL TO ORDER Judge Jim Huff, CBCOG Chairman called the meeting to order at 2:05 P.M. John Buckner called the roll. There were 10 of 12 counties represented and 30 out of 34 votes in attendance. A quorum was noted as being present. Minutes 4 Page 2 March 31, um 2. APPR4Vi OF!MINUTES OF THE February 24, 2006 MEETING A motion was made by Mr. Oscar Soliz to approve the minutes of the February 24, 2006 meeting. Council Member Kemp seconded this motion. The minutes of the February 24, 2006 meeting were approved by unanimous vote of the members present. 3. TREASURER'S REPORT John Buckner presented this report on behalf of the CBCOG Treasurer for the month of February 2006. He referred to the first page of the report mailed to the membership with the agenda. He reportedon cash balances, wire transfers, disbursements and interest earned on both the American Bank and TEXPOOL accounts for February 2006. Mr. Soliz moved, seconded by Judge Simpson, to approve the Treasurer' s Report for February 2006. The Treasurer's Report was approved by unanimous vote of the members present at the end of the meeting. 4. ITEMS REQUIRING ACTION BY THE COUNCIL OF GOVERNMENTS A. CHAIRMAN'S REPORT Confirmation of Committee Appointments Judge Huff made the following appointments to advisory committees: Christelia Arevalo, Brooks County and Lt. Stan Repka, Nueces County Sheriff' s Department to the Public Protection Committee. Mr. Soliz moved to confirm these appointments. Judge Simpson seconded this motion. The appointments were confirmed by unanimous vote of the members present. B. EXECUTIVE DIRECTOR'S REPORT John Buckner presented this report. 1 . RESOLUTION O. 2655 A RESOLUTION PROCLAIMING APRIL AS FAIR HOUSING MONTH IN THE COASTAL BEND REGION. Judge Martinez moved for the adoption of Resolution No. 2655. Council Member Kemp seconded the motion. Resolution No. 2655 was adopted by unanimous vote of the members present. 2. RESOLUTION NO. 2656 A RESOLUTION AUTHORIZING THE ACCEPTANCE OF A TCEQ 319 WATER QUALITY GRANT NOT TO EXCEED $90, 000 FOR A PUBLIC AWARENESS CAMPAIGN AND CLEANUP OF ILLEGAL DUMPING ON PETRONILA CREEK, OSO CREEK AND OSO BAY. Mr. Hennings moved for the adoption of Resolution No. 2656. Commissioner Cazalas seconded the motion. There was discussion as to the extent of the project and the involvement of staff and contractors. Mr. Massey recommended that this project be coordinated with the City of Corpus Christi's ongoing work so that a greater overall benefit would be derived. • Minutes Page 3 - March 31, 2006 It was noted that ongoing work by Nueces County would contribute to the in- kind match requirement for the' grant. Resolution No. 2656 was passed by unanimous vote of the members present. C. COUNCIL ON AGING REPORT Ms. Edalina Amador, Chairman of the Council on Aging, presented this item for consideration. RESOLUTION NO. 2657 A RESOLUTION REVIEWING AND COMMENTING FAVORABLY ON A BY-LAWS REVISION FOR THE AREA AGENCY ON AGING-ADVISORY COUNCIL ON AGING. Mr. Soliz moved for the adoption of Resolution No. 2657. Judge Simpson seconded the motion. Resolution No. 2657 was adopted by unanimous vote of the members present. D. REGIONAL SOLID WASTE ADVISORY COMMITTEE REPORT Rebeca Martinez presented this report on behalf of the committee. RESOLUTION NO. 2658 A RESOLUTION COMMENTING ON A CITIZEN COLLECTION STATION/TRANSFER STATION IN NUECES COUNTY TEXAS THAT IS BEING CONSIDERED FOR DEVELOPMENT BY THE CITY OF CORPUS CHRISTI. Councilman Carlos Villarreal moved for the adoption of Resolution No. 2658 . Judge Simpson seconded this motion. Resolution No. 2658 was adopted by unanimous vote of the members present. E. AFFORDABLY HOUSING COMMITTEE REPORT Richard Bullock presented this report on behalf of the committee. RESOLUTION NO. 2659 A RESOLUTION SUPPORTING THE HOMELESS ISSUE PARTNERSHIP, INC'S PROPOSAL TO EXPAND ITS BOUNDARIES BEYOND NUECES COUNTY TO INCLUDE SURROUNDING COUNTIES THAT ARE ADDRESSING THE ISSUES OF THE HOMELESS. Mr. Soliz moved for the adoption of Resolution No. 2659. Judge Martinez seconded this motion. Resolution No. 2659 was adopted by unanimous vote of the members present. F. PUBLIC PROTECTION COMMITTEE REPORT Dr. Anne Matula, Chairman of the Public Protection Committee presented the report. RESOLUTION NO. 2660 A RESOLUTION ADOPTING THE 2006-2007 REGIONAL CRIMINAL JUSTICE TRAINING PLAN AND AUTHORIZING THE EXECUTIVE DIRECTOR TO SUBMIT THE PLAN AS AN APPLICATION FOR FUNDING IN THE AMOUNT OF $109, 436 TO THE OFFICE OF THE GOVERNOR, CRIMINAL JUSTICE DIVISION. Minutes Page 4 March 31, 2006 Mr. Soliz moved for the adoption of Resolution No. 2660. Judge Saenz seconded the motion. Resolution No. 2660 Was adopted by unanimous vote of the members present. G. CONSIDERATION AND ACTION ON HOMELAND SECURITY MATTER REGARDING STATEWIDE RECOMMENDATION FOR A REGIONAL UNIFIED COMMAND. [This matter was sent out with the original agenda as a report only. A member government representative requested that the item be elevated to the "action" level in the event the CBCOG membership chose to take action. The revised agenda was posted five days before the meeting with the Texas Register as well as the local county clerk' s office. ] Mr. Bill Roberts, Vice Chairman of the CBCOG Homeland Security Advisory Committee explained that this agenda item was expected to address two concerns. One was the "regional response plan" that was under development by a working group within the region and the second was Governor Rick Perry' s Executive Order No. RP57. Sheriff Leroy Moody, Chairman of the Homeland Security Advisory Committee led the discussion on the implications of RP57 as to the authority and functions of mayors and county judges before, during and after major disasters. Judge Simpson explained his views on the matter as to the functionality and legality of the executive order. Judge Martinez stated that the first thing that needed to be done was to establish the legality of what was being imposed by the executive order. Captain Matthews explained his role as DDC (Disaster District Committee Chairman) and that of the Texas DPS in local and regional disasters. He commended the local jurisdictions on how all of them have worked together in the past. He stressed the ambiguous nature of the executive order statements and how broadly these could be interpreted. He said the local officials had the authority to define what roles and authorities would be included in the regional response plan and the regional unified command structure. He added that the DDC would support the needs of the local jurisdictions through their regional response plan. After substantial discussion, Judge Martinez moved, seconded by Judge Simpson, to appoint an ad hoc committee" of Coastal Bend county judges and mayors to meet and develop a recommendation as to how the region should proceed in addressing issues surrounding the executive order and related matters. This motion passed by unanimous vote of the members present. Judge Huff asked for volunteers and the following either volunteered or were volunteered. Judge Jim Huff, Judge Terry Simpson,. Judge Arnold Saenz, Commissioner Oscar Ortiz, Judge Terry Shamsie, Mayor Henry Garrett, Mayor Georgia Neblett, Mayor Geraldine Rypple, and Mayor David Krebs. [Judge Huff asked for the committee members to meet briefly after the meeting to set a time, date and place for their meeting. It was decided after the meeting that this group would meet on Monday, April 17, 2006 at 1:00 PM in the Corpus Christi Emergency Operations Center located at 2406 Leopard Street, Corpus Christi, Texas. ] 5. ANNOUNCEMENTS AND OTHER ACTION ITEMS Commissioner Betty Jean Longoria announced that Nueces County was having a live auction for surplus equipment on April 22, 2006 and she was leaving the details with the CBCOG staff if anyone wanted to review the information. Minutes Page 5 March 31, 2006 Captain Matthews reiterated again that he was the DDC for this area and as such was the local government conduit to state assets in time of need and he was committed to serving all the jurisdictions in his district in this capacity. There were a number of local festivals and fund-raisers identified by some present that were coming soon and the membership was invited to attend and partake in the celebrations. 6. ADJOURN There being no further business, the meeting adjourned at 3:40 PM. Duly adopted at a meeting of the Coastal Bend Council of Governments this 28th day of April 2006.
